155         i. Marvin5 Fittsxe "Fitts:Marvin ( -dec.)".  He is buried in the Cottondale Cemetery with the Marion Fitts family of Tuscaloosa, AL. He is said to be the son of Alfred Fitts of Gadsden. Marion Fitts was the son of Walker Fitts d. 1854 of Tandy d. 1803 Elbert Co. GA. Marion Fitts said he was a cousin to the Fitts of Tuscaloosa and the Fitts in Gadsden. (notes of Annette Smith)

          57.  Philip Augustus4 Fitts (Rev.) (John Henry3, Oliver2, Henry1) was born in Tuscaloosa Co., AL April 19, 1839.  Hexe "Fitts:Philip Augustus, (Rev.) (1839-dec.)" married Sophia Holland Cochranexe "Cochrane:Sophia Holland ( -dec.)" April 10, 1861.  She was the daughter of William Cochrane and Sophia L. Perkins. His first career was that of law until he was called to pastor Protestant Episcopal Churches in Alabama and Tennessee.           67.  Martha4 Brame (Anderson F.3, Nancey2 Fitts, Henry1) was born about 1829.  Marthaxe "Brame:Martha (ABT 1829-1878)" died March 11, 1878 in Henderson, Vance Co., NC.  Shexe "Brame:Martha (ABT 1829-1878)" married Theophilus Stallingsxe "Stallings:Theophilus (ABT 1830-dec.)" in Warren Co., NC, September 8, 1852.  Theophilusxe "Stallings:Theophilus (ABT 1830-dec.)" was born in NC about 1830.  1850 census, Warren Co., NC, p. 27, shows Theophilus, age 20, b. NC, Clerk, in the household of Eliza Dunnavant. The Dunnavant home was next to that of Thomas A. Blount, merchant. An Ann Stallings, age 18 in 1850, is living in another household on the same page.

Theophilus enlisted September 26, 1861, Co. B, 30th Infantry Regiment, NC, as a Private. He transfered October 16, 1861 to Co. S and promoted to Quartermaster Sergeant October 16, 1861. He was with Co. B, 30th Infantry Regiment NC on April 9, 1865 at the surrender at Appomattox Courthouse, VA. Three of her children were at Henderson, NC: Peter M. Stallings b. 1857, m. 1894 Emma H. Davis; Lizzie Stallings b. 1867, m. 1892 Norwood Thomas and Mattie Stallings b. 1870. Daughter Alice M. Stallings  b. 1858 m. 1893 Macon Vann, and Eugene Stallings b. 1861, m. Emma Roe, and went to Palmer Springs, Mecklenburg Co., VA. (James Harris Fitts, Fitts or Fitz Family in America, 1897, Fort Orange Press, Albany, NY)

William is buried in Twitty plot with son, William Jr. d. 1939; wife, Rebecca; daughter-in-law, Panthea and William Eldridge Twitty, III b. 6/8/1945, d. 6/10/1945.                  

                                The family plot immediately behind this Twitty group has: Harriet F. Eldridge 1893-1968; Harriet T. Fitts 1867-1955; William T. Fitts 1866-1953 and Sarah P. Fitts 1889-1974.

(1832-1907)" was born August 31, 1832.  William was the son of Mathew Mann Drakexe "Drake:Mathew Mann (1798-1865)" and Winefred Fittsxe "Fitts:Winefred (1802-1870)".  Hexe "Drake:William Caswell, (Mjr.) (1832-1907)" married his cousin Olivea Duke Fittsxe "Fitts:Olivea Duke (1837-1892)" January 29, 1863.  Williamxe "Drake:William Caswell, (Mjr.)           He married twice.  Hexe "Drake:William Caswell, (Mjr.) (1832-1907)" married his cousin Sally Fitts Twittyxe "Twitty:Sally Fitts (1831-1862)" October 18, 1854.  Sallyxe "Twitty:Sally Fitts (1831-1862)" was born 1831.  Sally was the daughter of John Eldrige Twitty (Sr.)xe "Twitty:John Eldrige, (Sr.) (ABT 1800-BEF 1874)" and Susan Fittsxe "Fitts:Susan (1800-AFT 1852)".  Sallyxe "Twitty:Sally Fitts (1831-1862)" died March 12, 1862.  SEE #90 SALLY FITTS TWITTY.  Dates taken from her tombstone. William and Sally are buried at the Fitts family cemetery next to the Henry Fitts house (now Perkinson farm) on Oakville Road.

          Hexe "Drake:William Caswell, (Mjr.) (1832-1907)" married his cousin Olivea Duke Fittsxe "Fitts:Olivea Duke (1837-1892)" January 29, 1863.  Oliveaxe "Fitts:Olivea Duke (1837-1892)" was born in Warren Co., NC May 10, 1837.  Olivea was the daughter of Oliver Duke Fittsxe "Fitts:Oliver Duke (1807-1854)" and Harriet Elizabeth Ann Collinsxe "Collins:Harriet Elizabeth Ann (1810-1860)".  Oliveaxe "Fitts:Olivea Duke (1837-1892)" died January 26, 1892 in Warren Co., NC.  SEE #110 OLIVEA DUKE FITTS.  Her children and dates all taken from James Harris Fitts, Fitts Family, Ft.           William raised a company and was elected Captain. Service record shows enlistment as Captain on August 16, 1861, age 29, Co. B, 30th Infantry Regiment, NC. He served until June 11, 1863 when he had to resign due to ill health. He was later appointed command of the 6th Battalion of NC troops and promoted to Major. He was acting as Judge Advocate of a General Courts Martial, appointed by Gov. Vance, when Lee surrendered. After the war he continued farming and teaching school in Warren County. He was elected as Superintendent of Public Instruction for Warren County. (James Harris Fitts, Fitts Family, Ft. Orange Press, Tuscaloosa, AL). William C. Drake was the census-taker for Six Pound District, Macon Post Office, Warren Co. for the 1870 census.

Palmer (Jr.)xe "Palmer:Horace J., (Jr.) (ABT 1833-AFT 1897)" in Warren Co., NC, April 18, 1855.  Horacexe "Palmer:Horace J., (Jr.) (ABT 1833-AFT 1897)" was born in Mecklenburg Co., VA about 1833.  Horace was the son of Horace Palmerxe "Palmer:Horace (1801-1882)" and Susan T. Russellxe "Russell:Susan T. ( -BEF 1838)".  Hexe "Palmer:Horace J., (Jr.) (ABT 1833-AFT 1897)" married Harriet Oliver Milamxe "Milam:Harriet Oliver (1844-AFT 1897)" September 14, 1873.  Horacexe "Palmer:Horace J., (Jr.) (ABT 1833-AFT 1897)" died after 1897.  In 1850, he is enumerated at Regiment 22, Mecklenburg Co., VA. On looking at this census, it appears to be a school with boys in their teens to early 20's listed as students, some occupations shown as professor, etc. Horace Palmer is shown as age 17, student. There is a Jacob Palmer, age 20, and a Reuben Palmer, age 22, on the same page.

He was enumerated in 1860, Merry Mount, Warren, NC: H. Palmer Jr., 26; L. Palmer (female), 23; N.M. Palmer, (male) 2; J.R. Palmer, (male) 1 year old. He was living next to R. W. Claiborn and two houses from Nathan Milam.

1880 census, Six Pound Dist., Warren Co., NC (p.17D) shows Horace J. Palmer, 46, VA, wife Harriet O., 36 NC; Nathan 22; Horace 16; Malvern H. 15; Jefferson Davis 13; W. Howard 11; Sallie M. 5; Suan R. 4; Jacob M. 12; with Elizabeth Milam, 74, mother-in-law; and Mary E. Milam, 41, sister-in-law. Marriage bond April 12, 1855 of Horace Palmer, Jr. and Sallie E. Milam, bond by James C. Robinson, witness: John W. White, Clerk. Marriage on April 18 performed by T. G. Lowe, Minister of the Gospel.

(Richard) (ABT 1834-AFT 1860)" and Sophie F.(?wife of R. Palmer)xe ":Sophie F., (?wife of R. Palmer) (ABT 1849-AFT 1880)".  This is probably the Helen R. Palmer, age 13, daughter of Sophie F. Palmer, 31 b. KY, with sisters Mary A. b.c. 1870 and Emma M. b.c. 1872, who have Horace Palmer, age 78, in their 1880 household, Six Pound Dist., Warren Co., NC. Sophie is obviously daughter-in-law of Horace Palmer, but her husband's name is not known. They were living at Oakville, NC. Children: Sallie Elizabeth Palmer b. 1884; Norville Finlay Palmer b. 1887; Henry Milam Palmer 1890-1891; Sophia George Palmer b. 1892.           110.  Olivea Duke4 Fitts (Oliver Duke3, Henry2, Henry1) was born in Warren Co., NC May 10, 1837.  Oliveaxe "Fitts:Olivea Duke (1837-1892)" died January 26, 1892 in Warren Co., NC.  She is buried at the Fitts cemetery at the Fitts home (now Perkinson) on Oakville Road. Shexe "Fitts:Olivea Duke (1837-1892)" married her cousin William Caswell Drake (Mjr.)xe "Drake:William Caswell, (Mjr.) (1832-1907)" January 29, 1863.  Williamxe "Drake:William Caswell, (Mjr.) (1832-1907)" was born August 31, 1832.  William was the son of Mathew Mann Drakexe "Drake:Mathew Mann (1798-1865)" and Winefred Fittsxe "Fitts:Winefred (1802-1870)".  Hexe "Drake:William Caswell, (Mjr.) (1832-1907)" married his cousin Sally Fitts Twittyxe "Twitty:Sally Fitts (1831-1862)" October 18, 1854.  Williamxe "Drake:William Caswell, (Mjr.)           111.  Francis "Frank" Michael4 Fitts (Sr.) (Oliver Duke3, Henry2, Henry1) was born in Warren Co., NC May 8, 1841.  Francisxe "Fitts:Francis Frank\" Michael, (Sr.) (1841-1923)\"" died December 16, 1923 in Warren Co., NC. 

          Hexe "Fitts:Francis Frank\" Michael, (Sr.) (1841-1923)\"" married his cousin Ann Sterling Throwerxe "Thrower:Ann Sterling (1846-1899)" in Warren Co., NC, November 30, 1864.  Annxe "Thrower:Ann Sterling (1846-1899)" was born in Warren Co., NC August 28, 1846.  Ann was the daughter of William Edward Throwerxe "Thrower:William Edward (ABT 1823-1853)" and Harriet Fittsxe "Fitts:Harriet (1823-1894)".  Annxe "Thrower:Ann Sterling (1846-1899)" died December 22, 1899 in Warren Co., NC. SEE #132 ANN STERLING THROWER. 

Nathan Milam was appointed Frank's guardian in 1860, after the death of his widowed mother. The division of his mother's estate divided Negroes into six equal shares for Frank and his siblings. The estate distribution to Frank after his brother, Henry's, death in 1862 is not clear. Nathan Milam was enumerated in 1860; however, Frank is not in the household. His cousins, James Monroe Fitts and L. D. Fitts are with Milam in 1860. Frank's whereabouts are unknown for the 1860 census and he may have been in school somewhere; he was a member of the Confederate forces by April, 1861.

Francis was a Private, Company G, 4th Regiment, Alabama, transferred in 1863 to Company B, 30th Regiment NC Troops on March 24, 1863 in exchange for Private Wyatt A. Floyd. He was promoted to Seargent Major in January, 1864, and transferred to Field & Staff. He was wounded in the head and left side at Snicker's Gap, VA on July 18, 1864. Francis returned to duty on September 14, 1864. He surrendered at Appomattox Court House, Virginia on April 9, 1865, shown on the Appomattox Parole List as Sgt. Mjr. Co. B, 30th Reg. His obituary called him Captain and family members say he was given a battlefield commission.

Frank M. Fitts is shown in the index of deeds for Mecklenburg Co., VA. He was grantee November 16, 1872, as was James M. Fitts, with E. H. Plummer et al as Grantor. (Deed Book 36, pps 174-175) E. H. Plummer was Edward Hall Plummer; he had married Sallie Fitts, daughter of James M. Fitts, Sr. and Martha Ann Davis. Sallie Fitts Plummer would have been Francis' 1st cousin. Frank M. & Ann B. Fitts took a mortgage from Sallie D. Plummer on November 19, 1872 (Deed Book 39, p. 174) and were released from deed by Sallie D. Plummer in March, 1873. (Deed Book 39, p. 285). Francis Michael's wife was Ann Sterling Thrower, so it is not clear if Francis Michael was one and the same as Frank M. Fitts or what the "B" stands for as Ann's middle initial OR it could be an "S". Again, these deeds need to be found and transcribed for more information. It would be interesting to see if Francis Michael Fitts disappears from Warren County census records for any period of time when he might have been in Mecklenburg County.

1880 census, Six Pound Dist., Warren Co., NC: Frank M. Fitts, 39, teacher & farmer; wife Ann S. Fitts, 33; William T. , 14; Hattie C., 12; Oliver D., 9; Ann S., 7; Sarah P, 4; Frank M. , 4; M. Willie (daughter) 2; Livy Alice, 4 mos. Living in the household are Harriet Thrower, mother-in-law, age 57; Cora Palmer, 19, Mulatto; and Hugh Towns, 16, Black.

Dates are from his tombstone. He is buried in the Fitts family cemetery on Oakville Road, Warren Co.

Application to Daughters of the Confederacy: Francis Michael Fitts joined the Marian Rifles under Capt. Young Royster as a Private and went with that company to Ft. Morgan, AL in 1861. In April, 1861, he assisted in organizing the Marian Light Infantry. On April 24, 1861, he left Marian with the Company for Dalton, GA, where it was mustered into service as part of the 4th Alabama Regiment under Col. Egbert J. Jane and Lt. Col. E. M. Lew. The 4th Alabama was sent to Harper's Ferry and served under Col. "Stonewall" Jackson. In the summer of 1862, Frank was transferred, at his request, to the 30th NC Regiment under Gen. Pede's Division, Jackson's Corps. In 1864, at the Battle of Cedar Creek, he was wounded, and for gallant service was, the same year, was promoted to Captain by Gen. Rodes. He was with the 30th NC Regiment at the surrender at Appomattox. *Family oral history reports that Frank had taken a wagon of supplies from Warren County to Richmond and his 16 year old brother, George, went with him. They were swept up in the evacuation from Richmond at both at Appomattox Courthouse at the surrender and walking back to their home on Oakville Road.

NOTE: The 1870 census shows Frank's family in house 126. His neighbors on all sides are Black families: #122 John Fitts, 40; #123 Charles Fitts, 60; #124 Charles Twitty, 40; #125 Gus Thrower, 60; #127, Joseph Nicholson, 35; #128 Richard Thrower, 60. The current "guess" that at emancipation, former slaves stayed on Frank's land and rented or were sharecroppers. John Fitts in house #122 was brother of Benjamin, William and Larkin Fitts, who were at Littleton PO in 1870 and sons of Mariah Nicholson, Mulato, b.c. 1810. Mariah was purchased by Henry Fitts from Benjamin Nicholson in the 1840s.
