       36.  Oliver Duke3 Fitts (Henry2, Henry1) was born in Warren Co., NC October 3, 1807.  Oliverxe "Fitts:Oliver Duke (1807-1854)" died February 28, 1854 in Warren Co., NC.  His date of death taken from headstone at the Fitts family cemetery at the Henry Fitts homestead (now Perkinson farm) on Oakville Road in Warren Co.

          Hexe "Fitts:Oliver Duke (1807-1854)" married Harriet Elizabeth Ann Collinsxe "Collins:Harriet Elizabeth Ann (1810-1860)" in Warren Co., NC, April 15, 1828.  Harrietxe "Collins:Harriet Elizabeth Ann (1810-1860)" was born in Warren Co., NC February 8, 1810.  Harriet was the daughter of Michael Collins (Jr.)xe "Collins:Michael, (Jr.) (1778-1856)" and Elizabeth Drakexe "Drake:Elizabeth (1785-1820)".  Harrietxe "Collins:Harriet Elizabeth Ann (1810-1860)" died 1860 in Warren Co., NC.  1860 Slave Schedule, Warren Co., NC shows M. M. Drake Adm. H. E. Fitts. The assumption is that she was deceased by 1860 and Matthew Drake was administering her estate. Slaves held in her estate: Black females ages 80, 50, 16, 13, 14, 18, 35, 8, 3, 1; Black males ages 60, 60, 32, 24, 18, 51, 8, 6, 4, 1.

Records of Estates for Warren Co., NC show guardianships and property distribution for her children: Nathan Milam was appointed guardian of Frank M. Fitts, Aug. Ct. 1860. Matthew M. Drake was appointed guardian of George C. Fitts, Aug. Ct. 1860. As the result of a petition for division of slaves. Negroes were divided into six equal shares among Henry Fitts, Olivia D. Fitts, the infant George C. Fitts with his guardian Matthew M. Drake, the infant Frank M. Fitts with his guardian Nathan Milam and to the infants Anna E. Fitts and Mary D. Fitts, with Henry Fitts their guardian, Nov. Ct. 1860. M. M. Drake was appointed guardian of Annie E. and Mary D. Fitts, Nov. Ct. 1862. William C. Drake and wife et al petitioned for a sale of slaves, Nov. Ct. 1863, Feb. Ct. 1864. Record notes the slaves in question were Ben, Sylvia, Lucy and Patsy, who were ordered to be sold and proceeds divided into 1/5 shares, with 1/5 allotted to Olivia D. Drake, wife of William C. Drake, 1/5 share to Francis M. Fitts, and the remaining incommon for George C., Annie E., and Mary D. Fitts, minors, Nov. Ct. 1863. The accounts of Henry Fitts, dec'd., as guardian of Annie and Mary Fitts were ordered to be examined, Nov. Ct., 1863. The accounts of M. M. Drake as guardian of A. E., Mary D. and G. D. Fitts were ordered to be examined, Feb. Ct. 1864, May Ct., 1864. William C. Drake was appointed guardian of Annie E., Mary D. and George C. Fitts, Feb. Ct. 1865. Guardian accounts ordered examined with William C. Drake, Nov. Ct. 1867.

Date of birth from notes of David Collins without cites or sources. 1798 administration of William Ellis shows Ellis' land bounded by O. (Oliver Duke) Fitts, Ephraim Ellis, Jno. Hicks, the Townes and Seth Perkerson.

The deed index for Mecklenburg Co., VA, shows Oliver D. was given or purchased land from his father in June, 1832. (Deed Book 27, p. 116) O.D. and Harriett E. Fitts purchased land in this county from William Hunt on December 16, 1850. (Deed Book 33, p. 375) Further research is needed to see how this land was disposed of after Oliver's death in 1854 and the film of these deeds transcribed in hope of further information.

An Oliver Fitts, age 20-30, with a female age 15-20, was enumerated in Mecklenburg County, VA in 1830. It is currently thought this is Oliver Duke Fitts and his wife Harriett, recorded in Virginia before the birth of their first child. Oliver had slaves in Virginia: 1M-10, 5M10-24, 2F-10, 3F10-24, 1F24-36, 1F36-55.

Next to Oliver is Henry Fitts, male age 40-50, with a female 30-40 and a male child under age 5. He has slaves: 3M-10, 1M10-24, 6M24-36, 3M36-55, 1M55-100, 1M100+, 1F-10, 3F10-24, 2F24-36, 1F36-55. Oliver's father, Henry, is not found in 1830 Warren County and this is probably him in Mecklenburg VA. Enumerated on the same page of the 1830 census is a Richard Fitts, age 50-60, with a female 70-80, and not too far away a John H. Fitts and a Robert N. Fitts. If or how any of these Fitts are related is not currently known. Robert Walker Fitts was the first Fitts shown in Mecklenburg by 1820, moving there from Halifax County sometime after 1810.

Warren County Deed Book 27, 1835-1840, p. 210: Know all men ... that I Benjamin Nicholson of Urban Nichols and by virtue of an order of the County of Warren, at Publick Sale, ..... I have this day sold to Oliver D Fitts, Negroes Mariah, Plummer William & child Jane, for the sum of twentysix Hundred and twenty dollars ..... as fully as I am authorized by Will ......this _  day of April 1837,  Witness Henry G. Fitts. NOTE: From oral history from descendants of Mariah Fitts, her husband (Cohabitation papers give date of 1846), Benjamin Nicholson, went with one of the Fitts sons, probably Henry, during the Civil War and was set free for his service. The 1870 census shows Benjamin & Mariah Nicholson and her son, Larkin, living next to Frank Fitts. It would appear that Frank received Mariah and Larkin from the distribution of his mother's estate in 1860. (research of Alexs P. Turner, Jr.)

Oliver D. Fitts recorded the 1840 Warren census in a beautiful hand. Oliver is listed in Dist. 4, p. 236: M5-10, M30-40, F-5, F30-40. Slaves: 4M-10, 5M10-24, 4M24-36, 4F-10, 3F10-24, F24-36, F36-55, F55-100.

In 1847, a transfer of land from will of Henry Fitts, to O.D. Fitts, on October 6, for $1,565, Hawtree Creek to State Line, for 285 1/4 acres.

Oliver served one term in the North Carolina Legislature in 1842. (James Harris Fitts, Fitts Family, Ft. Orange Press, Tuscaloosa, AL)

1850 census, Warrenton, Warren Co., NC (p.42) shows Oliver D. Fitts, age 43, b. NC, farmer, property value 12,000; Harriet E. A., 40; Francis M., 9; Anna 6; Mary 3; and George, 1. Oliver is one house away from his brother-in-law, John E. Twitty and three houses from his brother-in-law, Mathew M. Drake. 1850 Slave Schedule shows Oliver D. Fitts: Black females ages 100, 65, 40, 15, 12, 7, 7, 5; Mulato females ages 40, 16, 10; Black males ages 45, 40, 42, 30, 25, 32, 20, 18, 12, 5, 6; Mulato male age 23. Oliver's son, Henry, may be the Henry Fitts, age 17, in the 1850 home of William Hooper, 57, a Baptist Minister, which appears to be a school arrangement.

          Oliver Duke Fittsxe "Fitts:Oliver Duke (1807-1854)" and Harriet Elizabeth Ann Collinsxe "Collins:Harriet Elizabeth Ann (1810-1860)" had the following children:

             107         i. Elizabeth "Bettie Betsy"4 Fittsxe "Fitts:Elizabeth Bettie Betsy\" (1831-1831)\"" was born in Warren Co., NC May 3, 1831.  Elizabethxe "Fitts:Elizabeth Bettie Betsy\" (1831-1831)\"" died August 17, 1831 in Warren Co., NC.

             108        ii. Henry Fittsxe "Fitts:Henry (1832-1862)" was born in Warren Co., NC October 27, 1832.  Henryxe "Fitts:Henry (1832-1862)" died November 13, 1862 in Staunton, VA.  This may be the Henry Fitts, age 17, in the 1850 home of 1850 census of Warren County with William Hooper, 57, a Baptist Minister; also in the household are 21 individuals, including 15 year old James H. Fitts, student, (son of Henry Green Fitts). This was probably a school arrangement.

                                Henry was a Private, Company F, 12th Regiment, NC. He enlisted on April 18, 1861, as a 28 year old farmer. He was present and accounted for until hospitalized at Richmond, VA on June 28, 1862 with a gunshot wound. He was reported absent wounded or absent sick until he died at Staunton, VA of typhoid fever.

                                This is probably the Henry Fitts enumerated in 1860, Warrenton Post Office, Warren Co., NC, age 26, farmer, real estate $2,000, personal estate $4,000, born in Warren Co. (p. 489) 1860 slave schedule shows H. Fitts, with Black female, age 18; Mulato females 50, 18, 12, 4, 3; and Mulato males 28, 22, 16, 12, 6.

                                Henry was guardian for his two youngest sisters, Anna E. and Mary D., appointed August Court, 1860 (after the death of their mother). At November Court, 1863, William C. Drake and his wife petitioned the court for sale of slaves. February Court 1864 shows slaves, Ben, Sylvia, Lucy and Patsy were sold and proceeds divided into 1/5 shares allotted to Henry's siblings, and William C. Drake had become guardian to Annie E. and Mary D. Fitts, minors, who had been in the care of Henry.

                                A family oral history (Alex P. Turner, Jr.) handed down by descendants of slaves on the Fitts homestead indicated that their ancestor, Benjamin Nicholson, went with one of the Fitts brothers during his Civil War service. That Fitts was wounded, hospitalized at Richmond and later died. Only two brothers served, Frank and Henry. Both were wounded, but Henry was hospitalized at Richmond and died in 1862. If this oral history holds, Benjamin Nicholson would have been with Henry Fitts and was supposedly set free in reward for his service to Henry during the war. Benjamin and his wife, Mariah, are found in 1870 living by Frank Fitts in Macon, Warren Co., as is their son, Larkin. Mariah was purchased by Oliver Duke Fitts from Benjamin Nicholson as part of the estate of Urbane Nicholson. It would appear from the 1870 census that Mariah and her son, Larkin, were part of the slave distribution to Frank Fitts after his mother's death in 1860.

    +      111        v. Francis "Frank" Michael Fitts (Sr.)xe "Fitts:Francis Frank\" Michael, (Sr.) (1841-1923)\"" was born May 8, 1841.

             112       vi. Tempe Louisa Fittsxe "Fitts:Tempe Louisa (1843-1843)" was born in Warren Co., NC February 1, 1843.  Tempexe "Fitts:Tempe Louisa (1843-1843)" died May 12, 1843 in Warren Co., NC.

    +      113      vii. Harriet Anna E. Fittsxe "Fitts:Harriet Anna E. (1844-dec.)" was born October 26, 1844.

             114     viii. Mary Duke Fittsxe "Fitts:Mary Duke (1848-1935)" was born in Warren Co., NC May 12, 1848.  Maryxe "Fitts:Mary Duke (1848-1935)" died January 29, 1935 in Warren Co., NC.  After the death of her mother in 1860, she was appointed her older brother, Henry, as her guardian, along with her sister, Anna E. (Harriet). After Henry's death in 1862, William Caswell Drake was appointed her guardian. Drake had married her older sister, Olivea.

                                She is living with Benjamin Collins, her mother's brother, in 1880 and 1900. The head of household in 1920 is Benjamin's son, Thomas, and Mary is shown as age 70 and cousin. She is in the household of Mary W. P. Collins (widow of Benjamin) in 1830 and shown as niece-in-law, age 81.

                                Known as "Cousin Mary," she lived 'to be incredibly old and everyone who knew her loved her. for many years she was blind and had to be helped with everything she did. By some miracle that could not be explained, she regained her sight at a very old age. It was considered remarkable that she could read the newspaper without glasses. She and her family always referred to this miracle as "second sight."' (notes of David Collins) Dates from tombstone at Fitts cemetery at homeplace on Oakville Road.

          37.  Henry Green3 Fitts (Henry2, Henry1) was born in Warren Co., NC August 11, 1811.  Henryxe "Fitts:Henry Green (1811-1849)" died November 15, 1849 in Warren Co., NC. 

          He married twice.  Hexe "Fitts:Henry Green (1811-1849)" married Minerva Temperance Jonesxe "Jones:Minerva Temperance (ABT 1816-BEF 1844)" in Warren Co., NC, December 4, 1834.  Minervaxe "Jones:Minerva Temperance (ABT 1816-BEF 1844)" was born about 1816.  Minerva was the daughter of William Duke Jonesxe "Jones:William Duke (1788-dec.)" and Mary Ann Speedxe "Speed:Mary Ann ( -1826)".  Minervaxe "Jones:Minerva Temperance (ABT 1816-BEF 1844)" died before 1844.  Hexe "Fitts:Henry Green (1811-1849)" married Lucy E. M. Davisxe "Davis:Lucy E. M. ( -dec.)" in Mecklenburg Co., VA, 1837.  Lucy was the daughter of Thomas Davisxe "Davis:Thomas ( -BEF 1808)" and Ann (Palmer or Plummer)xe "(Palmer):Ann ( -dec.)".  1850 census, Warren Co., NC, Warrenton, shows Lucy E. M. Fitts, 30, with Rosa 8, Sally D, 5, and James M. Fitts 4, children of her sister, Martha, who had married Henry's brother, James Fitts, d. 1846. Lucy married 2nd William T. Howard, license granted December 24, 1850, Warren Co., NC. (Brent H. Holocomb, "Marriages of Warren & Bute Cos., NC," 1991) Henry purchased property from his father and brother in Mecklenburg Co. 1836-1840 Deed from James Burney to Henry Green Fitts for 3 Negro slaves for $1,400, names: Mariah, Emerly, and children Ann and Fillis. (Deed Bk 27, pps 481-482) 1837 deed from Sheriff G. Perry to Henry G. Fitts for $2,448, for six slaves: Boy Lewis, Man Ephrapen, Woman Hannah and three children. (May Court 1839, Bk 27, p. 450) 1840 deed from William Falkener to H. G. Fitts for $700, Negro woman Evernice. (Deed Bk 27, p. 541) NOTE: some of these names appear later in the account book of Henry's son, James. (called Commonplace book, the original is held at the Virginia Historical Society at Richmond VA)

1840 census of Warren Co. (p. 236) shows Henry G. on the same page as his father, Henry, and brother, Oliver D.: M-5, 3M20-30, F20-30. Slaves: 4M-10, 2M10-24, 4M24-36, M36-55, 4F-10, 4F10-24, 2F24-36, F36-55.

          Henry Green Fittsxe "Fitts:Henry Green (1811-1849)" and Minerva Temperance Jonesxe "Jones:Minerva Temperance (ABT 1816-BEF 1844)" had the following child:

          38.  Eveline3 Fitts (Henry2, Henry1) was born in Warren Co., NC 1813.  Evelinexe "Fitts:Eveline (1813-1853)" died 1853 in New Orleans, LA.  Shexe "Fitts:Eveline (1813-1853)" married Thomas Turnbull Twittyxe "Twitty:Thomas Turnbull ( -1889)" in Warren Co., NC, December 15, 1827.  Thomas was the son of William Twitty (Sr.)xe "Twitty:William, (Sr.) (ABT 1762-1817)" and Anna "Nancy" S. Turnbullxe "Turnbull:Anna Nancy\" S. (1782-1853)\"".  Thomasxe "Twitty:Thomas Turnbull ( -1889)" died 1889 in Farmville, VA.  He was a wholesale tobacconist in New Orleans. Marriage license granted December 13, 1827, Warren Co., NC. (Brent H. Holocomb, "Marriages of Warren & Bute Cos., NC," 1991) Eveline died of Yellow Fever. A Lula Twitty, age 22, b. Louisiana, was called cousin and in the household of William H. & Alice Palmer in 1880, Six Pound Dist., Warren Co., NC. Lula is very likely a granddaughter of Thomas Turnbull Twitty, who was in Louisiana and the children of Thomas' sons are not known.

          Eveline Fittsxe "Fitts:Eveline (1813-1853)" and Thomas Turnbull Twittyxe "Twitty:Thomas Turnbull ( -1889)" had the following children:

Sallie Duke4 Twittyxe "Twitty:Sallie Duke (1831-1870)" was born April 13, 1831.  Salliexe "Twitty:Sallie Duke (1831-1870)" died December 23, 1870 in Ashland, VA.  Shexe "Twitty:Sallie Duke (1831-1870)" married James Armstrong Duncanxe "Duncan:James Armstrong ( -1877)" December 17, 1850.  Jamesxe "Duncan:James Armstrong ( -1877)" died September 24, 1877 in Ashland, VA.  Their children: Mary Elizabeth, Eveline Fitts, Theela Epia, David Twitty, Nannie, James Armstrong, and William Wllace Duncan. She is buried at Hollywood Cemetery, Richmond, VA. (James Harris Fitts, Fitts Family, Ft. Orange Press, Tuscaloosa, AL)

                                According to the history of Hebron Methodist Church, she established the first Sabbath School at the church. She had a "2-horse wagon driven all over the neighborhood some time going this way herself to convey children to the school who lived too far away to walk and had no other way of going. She taught them the catechism, read the Bible to them and in many instances taught them the alphabet and how to read."

             123       vi. Elizabeth "Betty" Twittyxe "Twitty:Elizabeth Betty\" (1843-1878)\"" was born March 24, 1843.  Elizabethxe "Twitty:Elizabeth Betty\" (1843-1878)\"" died December 18, 1878 in Warren Co., NC.  Shexe "Twitty:Elizabeth Betty\" (1843-1878)\"" married Paul Palmerxe "Palmer:Paul ( -dec.)"              124      vii. James Fitts Twittyxe "Twitty:James Fitts (1848-1892)" was born May 4, 1848.  Jamesxe "Twitty:James Fitts (1848-1892)" died July 12, 1892 in Suffolk, VA.  Hexe "Twitty:James Fitts (1848-1892)" married Annie M. Beamanxe "Beaman:Annie M. (1855-dec.)" March 24, 1875.  Anniexe "Beaman:Annie M. (1855-dec.)" was born 1855.  His children: William Horace, Annie "Louise" m. Frank May Hobbs, James Duncan, Nathaniel Beaman, Eveline Fitts, Sallie Beaman and Laura Leigh Twitty. (James Harris Fitts, Fitts Family, Ft. Orange Press, Tuscaloosa, AL)

                                A DAR submission by Louise Twitty Hobbs (DAR ID #120477) shows Louise Twitty born in Murfreesboro, NC, wife of Frank May Hobbs and a descendant of William Duke, as follows: James Fitts Twitty m. Annie Beamon, son of Thomas Turnbull Twitty & Eveline Fitts; Eveline Fitts the daughter of Henry Fitts & Sallie Duke; Sallie Duke daughter of William Duke and Mary Green; William Duke 1756 Brunswick VA-1845 Granville NC served several enlistments as a private under different commands in NC & VA, applying for a pension in 1832. Mrs. Hobbs descent is incorrect, as she missed a generation: Sallie Duke's father was Green Duke and the  William Duke who had Revolutionary service was Green's first cousin, the son of Samuel Duke who was brother of William Duke, Green's father.

             125     viii. Emily Twittyxe "Twitty:Emily (1849-AFT 1897)" was born June 20, 1849.  Emilyxe "Twitty:Emily (1849-AFT 1897)" died after 1897.  Shexe "Twitty:Emily (1849-AFT 1897)" married Henry Clark Panlettxe "Panlett:Henry Clark ( -dec.)" December 23, 1873.  Their children of Farmville, VA: Epia Panlett, Hattie Williamson Panlett, Mary Twitty Panlett and Richard Landon Panlett. (James Harris Fitts, Fitts Family, Ft.           39.  James M. (Monroe)3 Fitts (Henry2, Henry1) was born in Warren Co., NC 1815.  Jamesxe "Fitts:James M. (Monroe) (1815-ABT 1846)" died about 1846 in Mecklenberg Co., VA. 

          Hexe "Fitts:James M. (Monroe) (1815-ABT 1846)" married Martha Ann Davisxe "Davis:Martha Ann ( -dec.)" about 1842.  Martha was the daughter of Thomas Davisxe "Davis:Thomas ( -BEF 1808)" and Ann (Palmer or Plummer)xe "(Palmer):Ann ( -dec.)".  Her mother, Ann Davis, named her and her sisters in her will: Lucy E. M. Fitts and son-in-law Henry G. Fitts, Mary (or Martha) Ann Davis and Minerva Hinton. Several deeds in Mecklenberg Co., VA can be found with James M. Fitts as grantee. In 1845 Henry Fitts Sr. is grantor; 1846 P. L. Hinton; 1846 H. G. (Henry Green) Fitts; 1872 & 1873 E. H. Plummer; 1848 John E. Jones. James is shown as grantor in 1843 with Henry Fitts Sr. as grantee; 1844 grantees are Henry G., Lucy E. et al. On February 27, 1848, James M. Fitts Estate is grantee, John E. Jones grantor.

Will of James M. Fitts, 1846, Will Book 16, p. 255, Mecklenberg Co., VA. Appraisal and Estate Distribution, Will Book 16, p. 333, Will Book 17, p. 131, Will Book 17, p. 138. He named beloved brother Henry G. Fitts as executor and guardian to children: James M., Rose C. and Sally D. He named his "mother" or "brother" _  A. Fitts. It looks like James. Codicil dated March 4 (can't read year or the contents).

There are several court cases in Mecklenburg Co. VA in 1875 & 1876 vs. administrator of estate of James M. Fitts. Surnames include Hinton, Davis, White, Seymour, Jones, Plummer.

James Harris Fitts' book shows James died after 1897; however, the will book for Mecklenburg County shows his will recorded between 1843 and 1845 and the above deed shows James' estate in 1848. It would appear that James died before 1845 and his son, James M. Fitts, Jr. is probably the one who died in 1897.

          James M. (Monroe) Fittsxe "Fitts:James M. (Monroe) (1815-ABT 1846)" and Martha Ann Davisxe "Davis:Martha Ann ( -dec.)" had the following children:

             126         i. Rose C. "Rosa"4 Fittsxe "Fitts:Rose C. Rosa\" (ABT 1843-AFT 1897)\"" was born about 1843.  Rosexe "Fitts:Rose C. Rosa\" (ABT 1843-AFT 1897)\"" died after 1897.

          51.  James Harris4 Fitts (Jr.) (James Harris3, Oliver2, Henry1) was born in Jackson, Clarke Co., AL October 12, 1830.  Jamesxe "Fitts:James Harris, (Jr.) (1830-AFT 1897)" died after 1897 in AL.  Hexe "Fitts:James Harris, (Jr.) (1830-AFT 1897)" married Mary Elizabeth Burgesxe "Burges:Mary Elizabeth (1837-AFT 1897)" May 2, 1855.  Maryxe "Burges:Mary Elizabeth (1837-AFT 1897)" was born in Avoyelles Parish, LA April 1, 1837.  Mary was the daughter of Lovatt Burgesxe "Burges:Lovatt ( -dec.)" and Fannie Coxxe "Cox:Fannie ( -dec.)".  Maryxe "Burges:Mary Elizabeth (1837-AFT 1897)" died after 1897.  Susan LeBrec received a letter from a Mrs. Oieta Fitts Finnell dated September 13, 1981. Mrs. Finnell at the time was 63 years old. Her letter stated that her 3rd great grandfather was Oliver d. age 45 in the Mississippi Territory. Her 2nd great grandfather was James Harris Fitts, who was killed by a 'discharged overseer." That her great grandfather was James Harris Fitts, Jr., who wrote the Fitts book and was probably led to trace his family because he was about two years old when his father died. Mrs. Finnell did not, however, fill in the gap from J. H. Fitts, Jr. to herself. She only wrote that her Fitts grandfather had died at age 34, when my father was only 7. Mrs. Oieta Fitts Finnell was living in Tuscaloosa, AL in 1981.
