Lying on Swan Quarter Bay at Christopher MIDYETT's corner running southerly and westerly with Thomas FODDREY's line to the bay; thence with the courses of the bay westerly to Jesse MIDYETT's corner; thence with Jesse MIDYETT's line running to a marked gum; thence running with Richard MIDYETT's line to Christopher MIDYETT's corner; thence with Christopher MIDYETT's and Richard MIDYETT's division line to the first station, containing 64 acres.

This indenture made this 23rd day of January in the year of our Lord, one thousand, eight hundred and twenty-seven, between Richard MIDYETT of the county of Wilson and State of Tennessee, of the one part and Sarah Swindell, was formerly Sarah O'NEAL, wife of Christopher O'NEAL, both of the county of Hyde and State of North Carolina, of the other part. Witnesseth that the said Richard MIDYETT for and in consideration of the sum of one hundred and thirty dollars, to me in hand paid by the said Sarah SWINDELL, formerly the wife of Christopher O'NEAL, deceased, the receipt and payment whereof is hereby acknowledged and have and do by these presents bargain, sell and convey and confirm unto her, the said Sarah SWINDELL, her heirs, executors, and administrators and assigns forever, all the right title and interest that I have in and to the undivided fourth part of two parts of land lying and being in the state of Tennessee and in the county of White & Warren. The one in White county being & lying on both sides of the Calf Killers Fork of the Caney Fork. Grant #2813 bounded as follows, to wit: Beginning at a stake & pointers at a ______hole, Joseph ROBERTSON's northwest corner of his one hundred acres preferred (?) Right, running thence west two hundred poles to a hickory sapling and two black jacks in the barrens; Thence two hundred and Ninety-six poles to a hickory sapling in the barrens, the North boundary of Richard BURTON's land as supposed, the boundary not being known, north east croping away, on and over the Calf Killers Fork, North 426 degrees and __________ persuing this line. It was mutually agreed by all the parties concerned that there was no majority for persuing the lines any further, them being in litigation concerning the remaining line and corner and here the persuasion ended. The said grant by re-survey is found to contain two hundred eighty-eight and 1/4 acres. Surveyed 23rd June 1826 by Turner LANE, Surveyor

    Elizabeth MIDYETT (formerly Elizabeth GASKILL), daughter of Jacob GASKILL, dec'd., of Hyde County, N.C., being one of his legal heirs & representatives, also being the legal heir & representative of my brother, David GASKILL, dec'd., of Hyde County and also one of the legal heirs & representatives of my nephew Riley J. GASKILL, dec'd., of Hyde County & I, the said Elizabeth, having many years since intermarried with Richard MIDYETTof Hyde County but now residing in White County, Tennessee, do hereby nominate & appoint my worthy friend & husband, Richard MIDYETT, my lawful attorney to demand & provide for me jointly, with himself, being my husband, from the administrator of the estate of Jacob GASKILL, my deceased father, or from any other person having charge of said estate, all such sums of money or property which may be due me or which may hereafter be coming to me from my father's estate & the said Richard MIDYETT, by virtue of the intermarriage. And also to demand & receive from Anthony GASKILL, administrator of my brother, David GASKILL, dec'd., all money & property which descends to me and the said Richard by virtue of the intermarriage, as heirs-at-law & legal representative of David GASKILL, administrator of my nephew, Riley J. GASKILL, dec'd., all money or property which descends to myself & the said Richard MIDYETTby virtue of our marriage as heirs-at-law & legal representative of Riley J. GASKILL, dec'd., all late of Hyde County. Elizabeth MIDYETT empowers Richard MIDYETT to sell or dispose of all or any part of land obtained by him as attorney to take & receive money or take notes on other property or to bring suit or suits to prosecute in order to gain possession of & to establish my title to all the estates aforementioned, being my deceased father, brother & nephew.

This indenture was made February 4, 1800. Registered May 22, 1800.

Francis CREDLE of Hyde Co., N.C. sold to Christopher MIDYETT of Hyde Co., N.C. for $200.00, a tract of land lying on Swan Quarter joining on the westward side of the said MIDYETT's land which he bought formerly of said CREDLE--beginning at said Christopher MIDYETT's line and at Jesse MIDYETT's northeast corner of the land he bought of Jacob MIDYETT, running with Jesse MIDYETT's back line north 55 degrees west 50 poles; thence north 40 degrees east 68 poles to FODREY's line; thence with FODREY's line south 18 1/2 degrees east 62 poles to said Chrsitopher MIDYETT's line; thence with said Christopher MIDYETT's line to the beginning, containing 43 3/4 acres. This indenture was made February 18, 1806. Proved May Term 1806.
