To all People to whom these presents shall come greeting . Know Ye that Jesse Lockhart of Hyde County and State of North Carolina, Planter, for and in consideration of the sum of three hundred and thirty (330.00) silver dollars to me in hand paid by John Marshall of Carteret County and State aforesaid, the presents whereof I do hereby acknowledge and myself to be therewith fully content, satisfyed and paid fare grantest bargained and sold and by these presents do grant, bargain, and sell, convey and com____nents the said John Marshall, his Heirs and Assigns for ever a certain tract or parcel of land formerly possessed by my father John Lockhart of the County and State aforesaid and desended to me by Heritage the __ tract or parcel of land containing one hundred and fifty acres (150) lying and being on the Northside of Wysockeen Creek Mattamuskeet bounded on Morris Jones land and running a strait course of mark and trees? ___ line to the marsh which is the North East part of the said Land afterwards moving along the marsh to Sam'l. Weston's line thence along the said Weston's line to Sam'l Jones line from thence to first station. To have and to Hold to the said John Marshall, his Heirs and Assigns, the above granted parcel of land and Premises with the appertenances to his and their only proper use and ___ forever. This Indenture made this 23rd day of Dec. in the Year of our Lord 1794 Between Thomas Jones of the State of North Carolina & County of Hyde of the one part and John Marshal of the said State & County of Carteret of the other part. Witnesseth the said Thomas Jones for & in consideration of the sum of two hundred Spanish Milled Dollars to him in hand by John Marshal at & before the Sealing and delivery of these presents the receipt whereof the said Thos. Jones doth hereby acknowledge, Bargained, sold, Conveyed and by these presents doth Bargain, sell, Convey & Confirm unto the said John Marshal his heirs or assigns forever a certain piece or parcel of Land situated in Hyde County lying on Mattamuskeet Beginning at a marked Ceder post standing at the South Corner of the said Thomas Jones land it being the corner between the said Thomas Jones land & Samuel Weston's land on Wysocken Creek runing N ____ E 12.2? to a Black Gum at the Cypress _ain? then S? ____ to the Salter's? line S ___ E 2__ W to L? This indenture made this 26th day of September in the year of our Lord 1797 between John Maeshall of the County of Carteret and State of NC, Physician, of the one part & Joseph Masters of the County of Hyde & State aforesaid, Merchant, of the other part. Witnesseth that the said John Marshall for & in consideration of the sum of two hundred & thirty Spanish mill dollars to him in hand paid by the said Joseph before the unsealing & delivery of these presents the piece? whereof the said John doth hereby acknowledge, hath granted, bargained sold aliened, ______, conveyed & confirmed & by these presents doth grant bargain, sell, alien, convey & confirm unto the said Joseph Masters a certain tract or parcel of land which the said John purchasd of Thomas Jones of the County of Hyde on the north side of Wysocken Creek in Mattamuskeet & is bounded on the northern & eastern sides by other lands of the said Thomas Jones, on the west by the lands of Darcas Jones & on the southern side by the lands of Samuel Weston & a piece of land which the said John Marshall bought of Jesse Lockhart & which the said John hath this day also conveyed & sold to the said Joseph, a more particular & ______ description of which piece of land would have been here given had the deed from T. Know all men by these present that Nehemiah Benson of the one part & William Price Marshall of the other part both of the State & County aforesaid witnesseth that I the said Nehemiah Benson for and in consideration of the summ of three thousand four hundred and forty nine dollars and twenty six and one half cents to me in hand paid by the said Wm. Price Marshall before the sealing & delivery of these presents the receipt where of I the said Nehemiah Benson for myself my heirs & asignees have bargained and sold and do by these presents bargain & sell and the said William Price Marshall a certain piece or parcel of land lying and being in the state & county afore & on the South side of Mattamuskeet Lake & adjoining the lands of James McClaud on the East and Matthew Boomer on the West beginning at the lake. James McClaud line running back with said McClaud line to the southermost line of said land then with said southermost or back line to Matthew Boomer's line then northwardly with said Boomer line to the Lake then with the lake to the first station for 120 acres of land as described above unto the said Wm. This indenture made and recorded 17 Jan. 1836 between Arnold Grayof the county of Hyde and state of NC of the first part and John Marshall of the same county and state of the second part. ____________that I the said Arnold Gray for and in consideration of the sum of one thousand six hundred dollars to be paid or incurd to be paid by _____writings obligations executed and declared by the said John Marshall the first for Five hundred and thirty three dollars due and payable the first January, one thousand eight hundred and thirty seven (1837) the second obligation due and payable the first January, one thousand eight hundred and thirty eight (1838) for five hundred and thirty four dollars, the third and last obligation due and payable the first January, one thousand eight hundred and thirty nine (1839) for five hundred and thirty three dollars all of which obligation bearing interest from the first day of January 1836 the result whereof is hereby acknowledged have bargained and sold and by these presents do bargain, sell, grant and confirm unto John Marshall aforesaid and his heirs and assigns forever a certain piece or parcel of land situated on the north side of Far Creek in said county and containing one hundred acres more or less. It being all the land conveyed in a deed of left by Benjamin Spencer due to his daughter Margaret Gibbs and by a deed of bargain and sale. Conveyed? by said Margarette and her husband Thomas? Gibbs to Lain? Gray beginning at a ceder post on the north side of Far Creek in Jones Spencer's ______line and running with said line westerly a parrallel course with the old ditch of Jones Spencer's line including ten feet on the south side of said line from the cedar post to the said Jones Spencer's line and then with said Spencer's line northerly untill it intersects the land of Samuel Spencer and then with a division line made by Samuel Spencer and Benjamin Spencer ____between themselves running in an easterly direction until it intersects the land of the heirs of Joshua Swindell and then with the division line between heirs and Benjamin Spencer and to the creek thence with the meanders of the creek to the first station. To have and to hold the above described land with all rights and privileges and appertenences there unto belonging or ______ there unto belonging to him the said John Marshall his heirs and assigns forever, and I the said Arnold Gray do convenent and agree to warrant and defend the above bargained land and premises to the said John MARSHALL his heirs and assigns forever from the lawfull claim or claims of all persons whomever. Report of Commissioners:
To the Honorable Clerk of the Superior Court of Hyde County. Obedient to a summons of the sheriff of Hyde County, we the undersigned commissioners appointed to divide and allot in severalty the lands of the petitioners in this cause assembled on the premises in Lake Landing Township said county on the day of May 1904 and after being duly sworn proceeded to partition the said lands among the said tenants in common according to their respective rights and interest therein and the following is our report of the same.
Lot No. 1 - We assign and allot to Beamon Watson and Hector Watson the first tract of land described in the petition herein as follows, to wit: Situated in Currituck Township Hyde County and said State and bounded on the North by the public road leading from O'Neal's Fork to Smith Creek Fork on the East by the lands of the heirs of Ephraim O'Neal on the South by the lands of Susan Roper heirs and the heirs of _____ Fisher, deceased, and on the West by the lands of the heirs of Susan Roper formerly the ZACK Gibbs land containing ____ acres more or less and known as the Solomon Northan Homestead land with the improvements thereon excepting that portion of said described land & improvements thereon allotted to Ola Gibbs and described in this report as a part of Lot No. 2 and also the East half of the land known as the O.C. Farrow land beginning on the Road leading from O'Neal's fork to Smith Creek at J.M. Lupton's South West corner opposite the Solomon Northan homestead place running with said road: N 651/4 W 8.00 chains then with said road N 71-40 W 4.05 chains to an iron post then N 291/2 E 281/2 chains to B.H. Bell's W.J. Martin line then with the line S 891/2 E to the said J.M. Lupton's north west corner then with his line S 291/2 W to the beginning at the road containing by estimation 363/4 acres with a privilege to all former drainways in both described tracts of land.
Lot No. 2 - We assign and allot to Ola Gibbs the following described tracts or parcels of land, to wit: First a part or portion of the Solomon Northan tract described in lot No 1 Beginning at the North East corner of the said Susan Roper or Zack Gibbs land, the same being the North West corner of the said Solomom Northan land and at the South edge of the canal which runs with the road & at the South side of the same then with said canal S 70 E 3.50 chains then S 59 E 4.00 ch. then S 693/4 E 3.23 ch. to a point opposite the center of the ditch on the East side of the Lot or yard fence, then S 251/2 W and with the center of said ditch 12.50 chains to an angle in said ditch then with the center of said ditch S 613/4 W 77 links to another angle in said ditch then with the center of said ditch S 331/2 W 29.87 chains then N 55 W 8.00 chains to the said Roper line then with the said Roper line N 35 E 26.50 ch. to the south side of the canal that runs through the farm at the center of a small ditch then with the said Roper line & center of a ditch N 26 E 6.90 chains to the center of said ditch N 663/4 W 2.60 chains to the Roper corner then with the said Roper line and the center of an old ditch N 25 E 8.13 chains to the beginning containing 35 acres with all the improvements thereon and a privilege to all former drainways.
- Second Tract - The West half of the land known as the O.C. Farrow land Beginning on the road leading from O'Neal's Fork to Smiths Creek and at an iron post the South West corner of Lot No. 1 of said land running thence with the said road N 71-40 W 1-95 chains then with said road N 641/2 W 10.35 chains to B.H. Bell's corner then with his line N 181/2 E 21.70 chains to his corner (a first and marked gum) there with his W.J. Martin line S 891/2 E to a point that bears N 291/2 E from the beginning then with a line of marked trees S 291/2 W to the beginning, containing by estimation 363/4 acres.
- Third Tract - A tract of land known as the Sparrow land situated in Lake Landing Township in said County and State & bounded as follows on the North by Mattamuskeet Lake, on the East by the lands of W.S. Jennett & wife, on the South by the lands of Thos. B. Gibbs and on the West by the David S. Gibbs lands now owned by Jas. A. Gibbs and the land known as the Episcopal Church lot, containing (110) one hundred and ten acres more or less. For a better description of said land reference is hereby made to the deeds given to John S. Nortan for the same and ________ in the Registers Office of said County with all the improvements thereon.
- Fourth Tract - All of that part of the tract of land that lies North of John M. Mann's ditch that leads to the Lake that was conveyed by Wm. H. Cox to John S. Northan by deed dated Feb 9, 1885 and registered in the Register's office of Hyde County NC Book No. 17 pages 192 & 193 & described as follows: In Hyde County NC on Mattamuskeet Lake Beginning at James Clayton's beginning at a marked cypress then S 42 E 25 poles then S 4 E 20 poles then S 4 W 47 poles then S 40 E 38 poles then S 25 W 20 poles then S 29 W 28 poles S 16 E 35 poles then S 35 W 42 poles to a marked poplar then Wt 35 poles to a cypress post standing on the flats then north 172 poles then wt 68 poles North 56 poles then east 100 poles binding on Ezekial Harris former survey to the beginning. The part that lies North of Said Mann's ditch contains by estimation 70 acres.
Lot No. 3 - We assign and allot to Mrs. Elizabeth Pugh wife of Rupert Pugh with all the improvements therein the following described tracts or parcels of land in Lake Landing Township said County and State to wit:
- First tract - Described in the petition herein as the Gaskins land beginning at the public road at the South East corner of the Murry? land now held by Samuel Windley it being the north west corner of said Gaskins land hereby allotted running with south side of a ditch S 851/4 E 31.61 chains to the Joseph S. Mann line then with said Mann's line S 41/4 W 15.02 ch to the Brooks line then N 85 W with North side of a ditch to the public road then with the road to the beginning containing by estimation 431/2 acres.
- Second Tract - Described in the petition herein as the third tract and as follows to wit: In Lake Landing Township said county and State Beginning at a cast iron post the South East corner of the Francis Weston land or land of the heirs of James Weston, deceased, and running S 23/4 W to R.B. Carawan's back line then S 191/2 W to the south west corner of the Lucas Tract of land then N 25 W to the south west corner of the Francis or heirs of James Weston land to a post set by arbitrators then N 25 E to the beginning containing (35) thirty five acres more or less.
- Third Tract - Described in the petition herein as the fourth tract and as follows to wit: Situated in Lake Landing Township said County and State adjoining the third tract above described and bounded & described as follows, beginning at Poplar, near? an iron post an old established corner on the main road running S 23/4 W 80 poles to an iron post set by arbitrators then S 663/4 W 181/2 poles to a rock and post set by commissioners dividing line between R.B. Weston and L.J. Weston thence N 23/4 E 80 poles being a parallel line with the line running south to a post thence a continued line N 23/4 E to a post in the Lake side thence East to a point a post bedded with shells set by commissioners thence S 23/4 W on a line with the poplar and an iron post the beginning the said piece or parcel of land being all that was set apart to R.B. Weston by commissioners in the division of the estate of James Weston, deceased, containing 113/4 acres.
- Fourth Tract - Situated in Lake Landing Township in said County & State on the White Plains Road leading from Middleton to Wysocking and is a part of the James Young land shown in a map hereto appended containing 292/3 acres and designated on said map as Lot No. 3 & described as follows, to wit: Beginning at the Public Road at the center of a ditch adjoining the pasture thence running with the center of said ditch N 283/4 W 28.75 ch to the north edge of another ditch then with the north edge of said ditch N 473/4 E 9.33 chains to the East edge of the ditch that leads to the Public Road then with the East edge of said ditch S 283/4 E 34.43 chains to the said public road then with the said road to the beginning with the original drainway also and Store House and lot at Middleton it being the 11/2 acre lot that adjoins the Abram Cox heirs for a better description see deed from H.B. Spencer & wife Mary Matilda to John S. Northan dated Jan 23 1867.
Lot No. 4 - We assign and allot to Thomas Marshall with all the improvements thereon the following described tracts or parcels of land in Lake Landing Township said county & state to wit:
- First tract - Lying on the north side of the White Plains Road leading from Middleton to Wysocking it being the Abram Jone & Jacob Young land and a part of the Jones Young land shown in the map hereto appended as estimating 591/3 acres Beginning at the north side of the said Road & at the east edge of a ditch the same being the South East corner of Lot No. 3 running thence with the line of Lot No. 3 & the East edge of said ditch N 283/4 W 34.43 ch. to the north edge of a cross ditch & corner of said Lot No. 3 thence with North edge of said cross ditch S 473/4 W 9.33 ch. to the center of the ditch on the west side of the farm & corner of said Lot No. 3 then with the center of said ditch N 283/4 W 5.75 ch. then S 55 W 1.69 ch. to a stone opposite the center of a ditch that divides the land from Jacob Young's land then with the center of said ditch N 32 W 17.31 ch. to the center of the back ditch then with the center of said back ditch N 541/4 E 16.55 ch to the Rattle Snake Canal then with the said canal S 421/2 E 10.13 ch. then S 521/2 W with south side of another ditch 3.46 ch. to the center of another ditch then with the center of said ditch S 331/2 E 26.75 ch. to an angle in said ditch then with the center of said ditch S 411/4 E 18.65 ch. to the said road then with said road S 501/2 W 10 chains to the beginning.
- Second Tract - Is on the White Plains Road leading from Middleton to Wysocking and is bounded as follows, on the West by the road leading from Brooks' to Middleton on the South East by the lands of the heirs of David A. Gibbs, deceased, and on the North East by the lands of the William Cahoon, deceased, heirs containing 21 acres more or less. It being the land purchased by Edward J. young of Anson Credle & wife Eliza Credle.
- Third Tract - Is a part of the woods land of the tract of land whereon the said Jno. S. Northan resided at his death and commonly known as the Oliver Swindell land bounded as follows on the South west by Jno. M. Mann's land on the north west by the Lucas land on the north by the part of the said Swindell land herein after allotted to Solomon Marshall on the East by the Henry Cox land and on the south by a part of the said Swindell land herein after allotted to Braxton Marshall containing by estimation 371/2 acres. Beginning at the north west corner of Lot No. 5 which is allotted to said Braxton Marshall and in Jno. M. Man's line running thence with said Braxton Marshall's back line N 22 E 14.72 chains to the Henry Cox line then with the Cox line west 7.50 ch. to the corner then with said Cox line north 5.47 ch. to Solomon Marshall's corner then with said Marshall's line west parallel with the Anson Gibbs new road 21.75 ch. to the Lucas line the with the Lucas line S 12 E 17.65 ch. to a post (holly, poplar & gum) marked in Jno. M. Mann's line of his P. Spencer land then with his line N 15 E 4.06 ch. to another post & white laurel then with another of Mann's lines S 701/2 E 21 chains to the beginning.
- Fourth Tract - One ware house, Store House and lot in Middleton known as the Shanklin warehouse and the Jones Young store house and lot bounded and described as follows lying on the south side of Middle Creek and on the East side of the road Beginning at the foot of the Bridge and is 50 feet by 100 feet on the road.
- Fifth Tract - Is four-fifths of a lot situated in the village of Middleton bounded and described as follows: Beginning at the foot of Middle Creek Bridge & running with the west side of the Public road leading from Middleton to Nebraska to James W. Gibbs line then with his line to Middle Creek thence with the creek to the beginning.
- Sixth tract - A certain House & corner lot at Middleton adjoining the Benjamin Saunderson lot and known as the W.P. Burrus lot also to have a right of pass way 12 feet in width across Braxton Marshall's Swindell land on the north side of the same and along the Cox line to the Public Road.
Lot No. 5 - Shown in the map hereto appended as containing 63 acres of Bonner land and 63 acres of Sswindell land with all the improvements thereon is allotted to Braxton Marshall and is described as follows, to wit: Beginning at the East edge of the Public Road and at the north edge of the canal or lead ditch that runs through the Bonner field which is shown on said map running thence with the north edge of said canal or lead ditch S 64 E to the angle in said canal or ditch then with the north west edge of said ditch N 511/4 W 48.20 ch. to Jno. M. Mann's line then with his line N 633/4 W 14.50 ch to his corner then with his line N 173/4 E 50 links to the corner of the Swindell land, then with his line N 66 W 9.50 ch. to said Mann's corner then with his line S 253/4 W 2.68 ch. to his corner (post sticking in the side of a pine stump) then N 701/2 W (Va 31/2 W) 23.50 W to a post in said Mann's line then N 22 E 14.72 ch. to the Henry Cox line then with the line East 32.60 ch. to a point on the East side of the road opposite the _om? Bean corner then with the east side of the said road N 2 W 4.35 ch. to the beginning with an independent drainway for his land through his main leading ditch.
Lot No. 6 - Shown in a map hereto appended as containing 61 acres with all the improvements thereon is allotted to John O. Marshall and is described as follows, to wit: Beginning at the corner of Dr. O.H. Gibbs land by the side of the canal running thence with his line N 553/4 W 10.12 ch. to his corner then with another of his lines N 5 E 21.75 ch. to a stake then a parallel line with the Billie John Spencer's back line S 87 E 37.70 ch. to the line on the east side of the tract then with that line S 7 40 W 9.55 ch. to a post then N 59-50 W 11.66 ch. to a post & corner of the B.F. Gibbs land then with his line S 22 W 19.55 ch. to the D.M. Carter or the W.B. Spencer land, then with that line N 17 W 25 links to the beginning. With an independent passway and a right of Drainway to Middle Creek.
Also another tract of wood land known as a part of the Green Hill land described as follows, to wit: Beginning at the old wash of the lake at Charles W. Gibbs northeast corner running thence with said old wash of the lake N 9 E 90 poles then N 73 W 200 poles to Green Hill's patent line on the lake then a southwardly course with said patent line to the said Chas. W. Gibbs line thence with his line S 62 E 200 poles to the beginning containing by estimation 831/2 acres it being the South half of the land conveyed by W.B. Lavender, Atty. to John S. Northan Feb 19, 1884.
Lot No. 7 - Shown in a map hereto appended as containing 86 acres with all the improvements therein is allotted to Annie Gibbs wife of O.H. Gibbs and is described as follows to wit: Beginning at a stake in said O.H. Gibbs line the same being the north west corner of Lot No. 6 and running thence with the said O.H. Gibbs line N 5 26 E 13.82 ch. to his corner then N 853/4 W 6.17 ch. to a post then with the line of the Lucas land N 223/4 E 8.00 ch. to the corner then with the Benja. Spencer or Wm. Cox line S 87 50 E 45.00 chains to a post at the corner then with the line of the Midyett land S 29 W 9.68 chains to the corner then S 861/2 E 75 links to a stone then S 7 40 W 12.66 ch. to a stake & corner of Lot No. 6 then with the line of Lot No. 6 N 87 50 W 37.70 ch. to the beginning with the former drainway that back to Far Creek.
Also all of that part of Henry Cox land that lies on the South west side of Jno. M. Mann's ditch that leads to the Lake containing by estimation 26 acres and the description for said land in the deed from Wm. H. Cox to Jno. S. Northan is fully set out in the description of the 4th tract in Lot No. 2 herein.
Lot No. 8 - We assign and allot to Solomon Marshall with all the improvements thereon the following described tracts or parcels of land in Lake Landing Township said county and State to wit:
- First tract - Is a part of the Bonner land shown in the map hereto appended as containing 61 acres and described as follows: Beginning at the East edge of the Lake or ridge road & at the north edge of the leading ditch herein before allotted to Braxton Marshall the same being said Braxton Marshall's beginning corner running thence with his line & the north edge of said ditch to the angle in the same then with the north west edge of said ditch to the Far Creek road, then with said road then with the Lake or ridge road S 2 E 15.91 ch. to the beginning with independent drainway.
- Second tract - Situated at the East end of Mattamuskeet Lake known as the Thomas Gibbs land adjoining the lands of Seth W. Gibbs. Beginning on a ditch bank near the ditch and near the road and running S 66 W 160 poles then N 25 W 102 poles to a corner then S 25 E 69 poles & 18 links to the beginning containing 90 acres more or less.
Also a tract lying on the Flats beginning at the Southern corner of the second tract or the Thomas Gibbs tract and running S 66 W 80 poles to the Lake then along the Lake easterly 20 poles then N 66 E 80 poles to a stake near the woods and then to the beginning containing ten acres more or less.
- Third tract - Bounded & described as follows, adjoining the lands of Seth Gibbs & Samuel Mann on the south and James Harris on the north it being the Jacob Braddock land and containing 211/2 acres more or less being the same tract of land purchased by John S. Northan from Burrage L. Gibbs on the 24th day of May 1868.
- Fourth tract - A tract or parcel of land situated in Lake Landing Township in said county & state adjoining the lands of H.S. Gibbs & wife & Far Creek on the South & West and on the north by the Midyett heirs and on the East by Far Creek containing _____ (blank) acres more or less.
- Fifth tract - A tract of land lying on the north side of Waupopin Creek and known as the George Williams tract of land and bought at the Trustees sale of Thomas Ballance by Solomon Northan adjoining the lands of Carney Gibbs and others containing 100 acres more or less.
- Sixth tract - A part or parcel of said land known as the Oliver Swindell land bounded and described as follows, on the north by the Anson S. Gibbs new road on the east by the Cox land on the South by the part of said Swindell land that is herein allotted to Thomas Marshall & on the west by the LUCAS land. Beginning at a slab at the north east corner of said Swindell land and at the edge of said new road running thence south 14.90 ch. then a parallel line in the said A.S. Gibbs road west to the LUCAS land then with that land N 12 W to a Black Gum at the side of said road then with said road East 25-25 ch. to the beginning containing 35 acres with a privilege of a right of passway twelve (12) feet in width on the east & north side of said Swindell land along the COX line across the lands of Thomas & Braxton Marshall land to the public road.
- Seventh tract - A part or parcel of the land known as the Green Hill land described as follows: Beginning at the old wash of the Lake and at the North East corner of the part of said land herein allotted to Jno. O. Marshall running thence with the old wash of the Lake N 9 E 90 poles to David Neal's Ditch then with his ditch N 871/4 W 200 poles to Green Hill's patent line on the Lake thence a southerly course with Green Hill's patent line to the north west corner of the part of said land herein allotted to Jno. O. Marshall then with his line S 73 E to the beginning containing by estimation 831/2 acres it being the north half of the land conveyed by W.B. Lavender, Atty. to John S. Northan Feb 19, 1884.
- Eighth tract - A tract of land on Middle Creek adjoining the lands of John S. Northan and bounded & described as follows. Beginning at the Public Road & running with said Jno. S. Northan's line to the Creek Road, thence with the creek and to the road, so as to make 50 feet on the creek & 50 feet on the road containing one fourth of an acre more or less with a ware house on the same.
- Ninth tract - A tract of land situated on Middle Creek and adjoining the above described tract or lot of land & bounded & described as follows on the north by the public road on the east by a lot formerly belonging to P. Spencer on the south by said creek and on the west by the lot of W.S. Cox containing one half acre more or less.
- Tenth tract - A tract or lot of land situated on Middle Creek and known as the Bonner lot bounded and described as follows on the north by the Benjamin O'Neal land on the east by the J.F. Cox land on the south by Middle Creek and the lands of Jno. S Northan and on the west by the lands of the said Jno. S. Northan containing 6 acres more or less.

Windley of the first part and Walter Jones of the second part and John A. Leeand S.S. Marshall, Trustee for Thomas W. Marshall and Braxton Marshall of the third part, all of the County of Hyde and State of North Carolina.
Witnesseth that whereas the said S.A. Windley of the first part is indebted to the said J.A. Lee of the third part in the sum of Fourteen Hundred Dollars ($1400.00) for which he has executed and delivered to the said J. A. Lee as aforesaid his bond of even date with this deed in the said sum of $1400.00 payable on the 8th day of April 1908 with interest thereon from date, interest payable annually and whereas the said S.A. Windley is indebted to the said S.S. Mann? (should be Marshall?), Trustee for Thomas W. and Braxton Marshall in the sum of Four hundred thirty and 70/100 ($430.70) for which he has executed and delivered to the said S.S. Mann? Trustee as aforesaid his bond of even date with this deed in said sum of $430.70 payable on the first day of March 1909 with interest annually and whereas it has been agreed that the payment of said bonds shall be secured by the conveyance of the land herein after described. Now therefore, in consideration of the promises and for the purpose aforesaid and for the sum of one Dollar to the parties of the first part paid by the party of the second part the said S.A. Windley and wife Ella M. Windley (the latter became party to this deed to convey and pass all right of ___and homestead in said land and bar her claim thereto) have bargained, sold, given, granted and conveyed and by these presents do bargain, grant and convey to the said Walter Jones, his heirs and assignees the following described tracts or parcels of land lying and being in the County aforesaid and most particularly described as follows:
- First Tract - A certain tract or parcel of land in Hyde County, State of North Carolina adjoining the lands of C.A. Mann, Sarah E. Mann and others bounded as follows, viz: Bounded on the North by the lands of C.A. Mann and the public road leading from Lake Landing NC to Farrace's? Fork, on the East by the lands of Sarah E. Mann, on the South by the lands belonging to the devisees of J.S. Northan, deceased, and on the West by the public road leading from Wyesocking ,NC to Lake Landing, NC and the lot known as the Murray store lot, now around by said Samuel A. Windley and the C.A. Mann store lot, containing forty five acres, more or less, being the same tract of land conveyed by Joseph S. Mann and wife Sophia L. Mann to Dixon Swindell by deed dated the 30th day of March 1872 and recorded in Book No. 11 page 467 in the office of Register of Deeds for Hyde County said deed and ______thereof are hereby referred to for a mere definite description of said land.
- Second Tract - A certain tract or parcel of land situated in Hyde County in Lake Landing Township bounded and described as follows: on the South by the lands of J.S. Mann and W.H. Rollins? now owned by Dr. J.H. Mann, on the East by the lands of A. Dudley (now owned by A. Dudley & wife), on the North by the lands of Thomas R. Boomer and wife and others, and on the West by the lands of S.A. Long, containing fifty acres, more or less, being the same tract of land conveyed by W.P. Burrus, D.W.W. Watson and wife Zadia L. Watson to Samuel A. Windley dated the 13th day of May 1885 recorded in Book No. 17 page 235 Hyde County Record of Deeds.
To have and to hold said lands and premises to the said party of the second part, his heirs and assignes forever. And the said parties of the first part convenant to and with said party of the second part, his heirs and assigns that they are the owners and seized of said premises in fee simple that they have the right to convey the same: that the same are free from any encumbrance whatsoever and that they will forever warrant and defend the title to the same from the lawful claims of all persons whomsoever. But this deed is made upon this special Trust and Condition, that is to say, if the said S.A. Windley shall fail or neglect to pay the said bonds, or either of them, or the interest on said bonds, or the interest on either of them or any part of the principal as interest on said bonds or either of them at the maturity of said bonds then both the said bonds shall become due and payable at once and it shall be lawful for and the duty of the said Walter Jones of the second part on application of the said J.A. Lee as the said S.S. Mann, Trustee as aforesaid, or either of them or the asignees of either of them or other persons or persons who may be entitled to the moneys due on said bonds, to advertise the aforesaid lands for a period of not less than thirty days at the Court House door and four other public places in Hyde County and sell said land at said court house door to the highest bidder for cash upon such sale to convey title to the firm chosen no fee simple and the said Walter Jones shall out of the funds arising from such sale retain the usual commission received by trustees for making such sales and shall apply so much of the residue of such funds as may be necessary to pay off and discharge said bonds and all interest then accrued and due them and shall pay the ______if any remain to the the said S.A. Windley or his personal representatives and it is stipulated and agreed that if the said S.A. Windley shall pay off said bond and interest and discharge fully the trusts herein declared then this deed shall be null and void. Otherwise to be in full force and virtue. In testimony whereof the said S.A. Windley and wife do hereto subscribe their respective names and affix their several seals. Note: Cancelled January 15, 1909
