VA., Louvina A., 66, b. VA., parents b. VA. The age and location are exactly right, and our Mary was Mary E. WILLIAM CHARLES KELLY, B. c. 1815 D. ? M. EDITH (Eady) HARWARD (Harrad, other spellings), dtr. of Bry Harward and Betsy Barbee Harward,  2-17-1840, Wake Co. NC., later in Chatham Co. NC as ACharles@, not found after Civil War.  Many Kellys, Kelleys and O=Kellys in Wake and Chatham, but unknown how he fits in. Perhaps desc. (Grandson?) from Henry Kelly who m. Mary Barbee in Chatham Co, 12-21-1717, as the families later intermarried.  Henry d. 1794, Rev. war vet. He left a will, but, unfortunately, simply leaves everything to his wife and children without naming them. Other possible relatives in the area were Sims Kelly, Abner Kelly, and Joseph Kelly. A Giles Kelly was born in Ireland, moved to Brunswick Co. VA; he had sons William and James, and the William could possibly be the older William C. found in Chatham.  This older William C. Kelley in the 1830 Chatham Co. census, who could possibly be the father of our William C.? This William C. Kelley, b. Ireland 1775, d. 1843 in Union Parish, LA, was married to Temperance Parish in Johnston Co, NC in 1811 and had known sons John and Joel.  He lived in Chatham and then moved on to Alabama and then Louisiana.  1860 Chatham census, Williams Mills Post Office, # 151: Charles Kelley, 45, Farmer.  Eady, Wife, 40.  Children: Addie, 18, James, 17, Jane, 12, John, 9, Eddy, 8. Living with him in the previous census was Bry Harward, and, next door, living alone, Elizabeth Harward (possibly ABetsy?@) In 1860, Census #=s 142 through 150 are ALL Harwards or Barbee=s, except # 145 (James Parish, probably a relative of the older William C. Kelley=s wife ). Also nearby is Joseph Kelley, 80, living with Cindy Kelley, 48.
 

EDWARD ASHWORTH KELLY (Pap): b. 1851, Chatham Co. NC, D. 1947, Fayette CO. WV.  M. ARTA ADLINE VEST, Raleigh CO. WV.  Bur. Vest Cemetery, Mt. View Rd, Summers, WV (marker).  APap@ apparently remembered his birthdate a bit differently in later years.  It=s consistent in census records up through the 1920's or so, when it takes a leap.  The result was his obituary reporting his death at age 109, but I think he was actually Aonly@ 97 or so.  He talked of being a Confederate soldier at Appomattox, but I=ve found no record of his service and believe he would have only been about 14 when the war ended, but, as we know, that doesn=t necessarily preclude his serving, at least near the end.  Some say Pap married a second time after Arta Vest died, but I=ve not found a record.  He was a widower for many years, living with a daughter in Thurmond, WV at the end of his life.  He walked railroad tracks over several counties, re-caning chair bottoms with hickory splits.  The only photo I have of him shows a small, wrinkled man with a remarkably thick head of dark hair, something that did not follow many of his male descendants in the Bennett line into their middle years...or late 20's for that matter.   DTR: ROSETTA (ZETTIE), Allie Settle, sons Joseph and Lon, several others.

Brittain, Henry, John, Martha (m. a Barbee), Milly (m. a Yates), Rhoda (m. a Wheeler), Rosannah, Nancy, (m. a Castleberry) and BRY.  Will signed in Wake Co., 8-30-1831: I give and bequeath to my beloved son Bry Harward one hundred and five acres of land whereon he now lives, one feather bed and furniture, one horse, one cow and calf, two sheep, one Negro girl Sarah, all received.  Bry and Brittain named executors.

BRY HARWARD, B. c. 1779, NC.  M. Betsy BARBEE, 12-8-1801, Wake Co. NC.  Betsy was the dtr. of GOIN BARBEE and his wife/1st cousin ANNY BARBEE.  Bry and Betsy were also Afirst cousins once removed,@ as Betsy=s grandfather John Barbee was also Bry=s great-grandfather. Bry was living with dtr. EDY (EDITH) KELLY and son-in-law (William) CHARLES KELLY in Chatham CO. NC, 1860 census, age 84. In List of the Taxable Property for Chatham Co., NC, 1815 as having 115 acres on APanter Creek@ valued at $287.50.  Jack, William and Brittain also listed as Ataxables.@  The name is spelled AHarrod@ in this document.

BARBEE
  (English)

Some say this family originated in France, but has been in England for many centuries.  They are found in the town of Barby (note alternate spelling) in Northamptonshire.  As shown below, there is a first-cousin intermarriage in this family, so the line is a bit complicated.  Also, the Barbee, Sears and Harward families are so intermarried (even by Old South standards!) it is difficult to keep them all straight, so hang on:
 

WILLIAM BARBEE  b. England, early settler, New Kent Co., VA., where a headright by George Morris and John Pigge naming him was on file, 12-11-1660.  Sons: WILLIAM BARBEE and Andrew, at least
 

WILLIAM BARBEE JR., b. c. 1655, England, D. 1720, Middlesex, VA.  M. ELIZABETH BEAUMONT (Belmont), c. 1682, VA.  She was the dtr. of JOHN BEAUMONT SR., b. c. 1628, d. 1649, England, and HOPE BLAND, b. 1630, England.  Hope was the dtr. of PEREGRINE BLAND, b. 1600, England. Son: JOHN (m. Ann Miller, father of Goin, below). After Elizabeth=s death, William Jr. remarried to Mary Ann Gray, and produced George, James, Benjamin, Elizabeth, Mary and Gray Barbee.

JOHN BARBEE, b. c. 1683, d. 1750, M. Ann Miller (b. c. 1693, Middlesex, VA d. 10-20-1766, Essex CO VA), Middlesex VA,  2-25-1709. Sons: CHRISTOPHER, father of ANNIE, and JOHN, father of GOIN (see entry below on Goin Barbee, m. Annie Barbee). Daughter:  ROSANNA, m. HENRY SEARS, whose daughter, SARAH, m. JOHN HARWARD, father of BRY HARWARD. Thus, three of the children of John Barbee and Ann Miller (Christopher, John, and Sarah) are our direct ancestors. Will made 2-19-1750, Essex Co. VA.  Leaves estate to wife, Ann. Other children include William, Elizabeth (m. Thomas Redd), Francis, Joseph, Mary (m. Edward Sears), Rosannah ( m. Henry Sears), Mical (m. John Pitts).

CHRISTOPHER BARBEE, b. between 1712-1722, Essex Co VA, D. after 1777, Wake NC.  M. Margaret VAWTER (d. before 1780, Wake NC.  Will, June 1772, Wake Co. NC., names dtr. AANNEY,@ leaving her slaves.  Other children include Joseph, Sarah, Sukey, Thomas, Martha, Christopher Jr., Rosannah and Benelge. Numerous other slaves are designated.  Some of Christopher=s land near what was then called New Hope Chapel Hill (it was a hill with an Anglican church called New Hope Chapel on it) in Wake County was later donated by his heirs for the construction of part of the University of North Carolina.  The family cemetery is on the campus.

NC, 4-8-1806: mentions sons Josiah, Mordecai, wife ANNE, dtrs. Rebekah McApron, Delilah McGehee, Nancy Weatherspoon and BETSEY HOWARD (alt. spelling of HARWARD).

GOIN BARBEE, son of John BARBEE JR, married his cousin ANNIE BARBEE, dtr. of Christopher Barbee and Margaret Vawter.  Dtr:  Betsey (Elizabeth) Barbee, who m. Bry Harward.  Will: 4-8-1806, names wife Ann and dtr. Betsey AHOWARD@ (HARWARD).  Also children Josiah, Mordecai, Rebekah McApron, Delilah McGehee and Nancy Weatherspoon.

AThe twenty eighth day of April in the year of our Lord one thousand eight hundred and six, I Goin Barbee of Chatham County being in health and perfect senses thanks be to God for it and calling to mind the uncertain state of this life and that all flesh must unto death when it shall pleas God to call us, declare this my last Will and Testament in manner and form following.  First being sorry for all my sins and humbly desiring forgiveness for the same I commend my soul to almighty God my Saviour and redeemer in whom and by which merits I trust to be saved to have full remission and forgiveness for my sins and have and in trust in the kingdom of Heaven and my body I commit to the earth to be decently buried at the discretion of my Executor here after named and for the setting of my temporal estate and such goods chattles and debts as it hath pleased to bestow on me.  I do order and dispose of the same in manner and form following that is to say.  First, I give untio my beloved son Josiah Barbee all my Land lying in Wake County and also 25 dollars in Cash to buy him a Desk.  Item, I give unto my son Mordecai Barbee as good a horse saddle and bridle as Josiah and as much stock of every kind and as much household furniture when he marries or comes of age and all the remainder of my estate after my just debts are paid.  I lend unto my beloved Anne Barbee during her natural life in widowhood except the executors should think the estate us wasting but, if she marry or at her death my executor will divide my estate as underneath declared.  That is to say I give unto son Mordecai Barbee the Land and plantation whereon I now live and my Desk, the balance of my estate to be divided as follows: my Negroes to be valued and put in Lots and divided equally amongst all the legatees and the overplus to be sold and equally divided between my six children: Josiah Barbee, Mordecai Barbee, Rebekah McApron, Delilah McGehee, Nancy Weatherspoon and BETSEY HOWARD and I nominate and appoint my beloved son Josiah Barbee and John O=Kelly my full and sole Executors of this my last Will and Testament.  In witness whereof I have hereunto set my hand the day and date above written.  GOIN BARBEE   Done in the presence of us: Merrell Beasley

She was the dtr. of JOHN BEAUMONT SR., b. c. 1628, d. 1649, England, and HOPE BLAND, b. 1630, England.  Hope was the dtr. of PEREGRINE BLAND, b. 1600, England, d. c. 1649, Virginia.  However, some research says Elizabeth was the dtr. of WILLIAM BEAUMONT instead.  Regardless which, they were descendants, sons or grandsons, of RICHARD BEAUMONT, b. c. 1585 in Yorkshire, England.  He m. ANNE KAYE.

Eliza Bowler and Mary Berry, and Hannah Rodes, and son Christopher.  Will specfically leaves his Ahoggs@ to his Adear loving wife during her life.@

ANN MILLER, m. JOHN BARBEE, son of WILLIAM BARBEE and ELIZABETH BEAUMONT, 12-25-1709.  Will, Essex Co. VA, 8-17-1761.  Names children: Christopher, John, Joseph, Francis, Mary and Rose Sears, and Mical Pitts. In her will, she gives varies slaves to her children, including Milley to Mary Sears, Lydia to Rose Sears, etc.  At least 12 slaves are designated in the will. Executors are son Francis Barbee and son-in-law, Henry Sears.

JOHN VIER, 1758-3/7/1834, b. VA, M. SARAH WRIGHT, 3-4-1784, Buckingham CO, VA.  REV. WAR VET, enlisting in Amherst Co., VA, serving under Col. Francis Taylor and guarding prisoners surrendered by General Burgoyne, discharged in Winchester, VA.  Awarded Revolutionary War pension, 1834.  Will, Franklin Co. VA names wife Sarah and Dtrs. Sarah Newberry and ELIZABETH (VIER)VEST.  The Vier (Viar, Via) name is French, probably descended from Amer Via, b. France c. 1663, a Heugonaut, arrived in Virginia around 1675, wife Margaret ____.  Children recorded in New Kent, Va.: Naomi, Robert, William, Judith, Margaret, Mary.  Our John could possibly be a son of Robert, who=s other children were Robert Jr., Gideon and Littleberry, as these are also found early in Buckingham County and later in the Patrick-Franklin Virginia areas.

State of Virginia, County of Franklin, to wit:

AOn this 24th day January 1834 Personally appeared before me Samuel Saunders a Justice of the Peace for the Said County, John Via a Resident of the County and State of Virginia aged 76 years who being first duly Sworn according to law doth on his oath make the following declaration in order to obtain the benefit of the provision made by the act of Congress passed June 7, 1832.  That he enlisted in the army of the United States for term of three years in the County of Amherst Virginia under Capt. Jesse Allen who being deprived of the command he was transfered to Capt. Solmon Rice and upon the resignation of Capt. Rice he was marched under the command of Captain Burton in a detachment of the Virginia line commanded by Col. Francis Taylor to guard the Prisoners surrendered by Burgoyne that he was marched and countermarched through the north western part of the State of Virginia and quartered at different times near the towns __?__ at the Warm Springs, Shepardstown and Matinsburg and being dischared at Winchester Virginia.  Having lost his discharge that he served the whole term that he enlisted for, at the different places States as Private Soldier.  He hereby relinquishes every claim whatever to a pension or an annuity except the present and he declares that his name is not on the pension roll of any agency in any state.  Sworn, Samuel Saunders, Justice of Peace.@

Franklin County.  On this the 21st day of 1843, personally appeared before me James Cannaday, a justice of peace, and as such one of the justices of the County Court of Franklin County, and Sarah Viah, alias Sarah Vyer, a resident of said County, aged abour ninety five or ninety six, who being first duly sworn, doth make the following declaration: That she is the widow of John Viah, alias John Vyer, who was a soldier in the Army of the Revolution....that she was married to said John Viah on the fourth day of March seventeen hundred and eighty four, that her husband died on the seventh day of March eighteen hundred and thirty-four, and that she remained a widow since.@
