Agreement made between John Wilkinson on behalf his wife Elizabeth and his daughter in law Hannah Lock being fully empowered on the one part and Benjamin Smith on the other part. First that said John Wilkins for the said Elizabeth and Hannah sells unto the said Benjamin Smith & his heirs all their rights title claims & shares of land to several tracts or parcels of land which lye on Sturgese Creek and the Grate or Rice Field branch thereof being seven hundred & 30 acres in the whole belonging to the Estate of Roger Roots, and to certain parties whereof they are entitled by the oath of the said Roger and his sons to have & to hold the undivided share of the before mentioned Elizabeth & Hannah, be the same more or less to him the said Benjamin Smith his heirs and assigns forever, and the said John Wilkinson promises & binds himself that the said Hannah & Elizabeth shall at anytime when required sign seal and execute any instrument of writing produced by said Benjamin Smith & his assigns for the more perfect conveyance assuring the premises to him the said Benjamin Smith his heirs & assigns forever.

For & in consideration whereof the said Benjamin agrees to sell unto the said John Wilkinson an equal number of acres that he shall get by virtue of the above engagement on his part out of a tract of land belonging to him bounded by Wards Creek & the Northwest River to be laid off or taken from The part of the tract which joins said Creek ? & so runs to the back line of the Grant for C? & on his receiving a further satisfactory deed or deeds for the above land sold by said Elizabeth & Hannah immediately thereafter when ? be required to sign seal & execute a good & sufficient title to the said John Wilkinson his heirs forever and for the true performance of the above each of the parties bind themselves their heirs & assigns to the other & his heirs & assigns in the sum of Five Hundred Dollars in testimony whereof they have hereunto set their hands & seals this 23rd Decr (?) 1803 the said Smith reserving he right to cut mill timber ? was ? of the said land sold to.
