Benjamin Rowell to John Simmons, 1808

This indenture made the 11th June in the year of our Lord one thousand eight hundred and eight between Benjamin Rowell of the county of Brunswick and State of North Carolina of the one part and John Simmons of the county of New Hanover and state aforesaid of the other part. Witnesseth that he the said Benjamin for and in consideration of the sum fifty pounds current money of the state to him in hand paid by the said John, the receipt the said Benjamin doth hereby acknowledge he the said Benjamin hath granted, bargained, sold, enfeoffed, conveyed, and confirmed and by these presents doth grant, bargain, sell, enfeoff, convey, and confirm unto him the said John the following tract or parcel of and situate lying and being in the county of Brunswick and state aforesaid and containing by estimation two hundred and thirty six acres be the same more or less which said tract of land was laid off out of an old survey of 620 acres granted to Samuel Watters beginning at a cypress on the waters of Livingston Creek near the mouth of Bogg Branch, thence south seventy nine west three hundred and twenty poles to a pine one of the upper corner of said tract, thence with the back line north fifty nine west one hundred and twenty eight pole to a pine corner of a fifty acre tract layed of for James Smith, thence with one of his lines north twenty nine east one hundred and twenty seven poles to a pine another of his corners near a bay, thence north forty four east two hundred and eighty poles to a small ash on the side of Livingston Creek and with the meanders of the same to the beginning. To have and to hold the said tract or parcel of land with the appertenance unto him the said John his heirs and assigns forever. And the said Benjamin doth for himself, his heirs, executors, and administrators warrant and forever defend the said tract or parcel of land unto him the said John his heirs and assigns from the lawful claim or claims of any person or persons whatsoever. In witness whereof the said Benjamin hath hereunto set his hand and seal the day and year first above written.
