This deed made and executed this 21st day of June 1890 by Henry Weil and wife Mina Weil, Solomon Weil and wife Sarah Weil, of Goldsboro, NC parties of the first part and the City of Goldsboro of Wayne County, NC of the second part, in consideration of one dollar ($1), land lying near the City of Goldsboro near its north eastern side adjacent to Board Tree branch, the proposed extension of Beach Street, Pate and Latham's corner, Leggett's line, Leggett and Peacock's corner containing 18 acres more or less. To have and to hold said land and its privileges and appurtenances to said City of Goldsboro in perpetuity on condition and it is hereby declared to be the true intent and meaning of this conveyance that they shall apply and use said land for a Public Park and Pleasure Grounds and that said City of Goldsboro shall beautify and adorn the same in a suitable way for such purpose and that it shall be called Herman Park.

It is also made a condition precedent to this deed that in case said City of Goldsboro shall fail to lay off said land for a Public Park and beautify and adorn the same for said use or comply with any of the conditions of this deed the said land is then to revert to said Henry Weil and Solomon Weil and their heirs and assigns and this deed shall then be null and void and of no effect; otherwise to remain in full force and virtue. In witness whereof the said parties of the first part have hereunto set their hands and seals this day and date first above written.
