1st- I give & bequeath to my son Jacob Swain one feather bed & furniture.
2nd- I give & bequeath to my daughter Patsey West one ewe & lamb-
3rd- I give & bequeath to my daughter Mahala Brickhouse one cow & calf & one ewe & lamb-
4th- I give and bequeath to my son Abram Swaim one fether bed & furniture one cow & calf & one ewe & lamb-
5th- I give & bequeath to my daughter Nancy Swain one fether bed & furniture, one cow & calf, one ewe & lamb
6th- I give & bequeath to my son Joshua S. Swain one fether bed & furniture & one cow & calf & one ewe & lamb-
7th- I give & bequeath unto my will beloved wife all the rest of my chattel property together with my horse to her full use during her lifetime or widowhood- I leave the mare which was my son Johnathons to be sold I leave my plantation to the use of my wife her life time & after her death it is my will that my land should be equally divided between my sons Abram Swain & Joshua S. Swain & if either of them should die without a lawful heir to return to the other one I give my beloved wife a note which I have in my possession against W. W. Walker giving her full Power to collect the same I do hereby empower my son Abram to pay all my debts. It is my will that after my wifes death that all of my chattel property should be equally divided among my lawful heirs & I hereby make & ordain my well beloved wife & my belove son Abram Executor & executrix of this my last Will & Testament in witness whereof I the said A. J. Swain have to this my last Will & Testament set my hand and seal the day & year above written.
Signed sealed published & declared by the said Abram J. Swain the testator as his last Will & Testament in the presence of us who were present at the time of singing & sealing there of.

Then was this paper writing exhibited in open court by Abram Swain the executor therein name & upon the oath of William Reynolds one of the subscribing witnesses thereto was proved as the last Will & Testament of Abram J. Swain and he further swares that the said A. J. Swain was at the time of signing the same was of sound disposing mind & memory & that he signed the same without compulsion of any person. It is therefore admitted to probate in said court as the last Will & Testament of A. J. Swain decd. & that the same be recorded-

Bond dated 25 Jan 1854 in the amount of $250 appointing Austin Perisher guardian to Joshua L. Swain a minor orphan, W. W. Walker & John H. McCalister securities.
Petition January Term 1854 of Mary Swain, widow of Abram J. Swain, of Abram Swain, executor and son of said Abram J., of Austin Perisher and wife Nancy, Charles Brickhouse and wife Mahala, Allen West and wife Martha and of Joshua Swain a minor by his guardian Austin Perisher who show that the said Abram J, died about the year 1849, having first made and published a last will and testament which has been admitted to probate in this court and the said Abram his son qualified as executor. In his will said testator devised all his chattel property to his wife for life, then to his lawful heirs. The said chattel property consists of a horse that is now blind together with other articles of personal property. The said horse is expensive and the said widow is old and desirous of getting clear of the expense of maintaining him and is willing that a sale of said horse and chattel property shall take place and a division of the proceeds of said sale take place at once without waiting and keeping said property on hand until her death, she being willing to take a child's part of said proceeds. Petitioners pray a court order for said sale.
Account of the sale of the property of A. J. Swain deceased on 4 Feb 1854. Purchasers and the number of purchases are Jesse Ansley (1), Noah Ansley (2), Charles Brickhouse (2), James L. Bond dated 23 Oct 1854 in the amount of $250 appointing Mary Swain guardian to J. L. Swain a minor orphan, James F. Davenport & Wm. W. Walker securities.
Bond dated 25 Oct 1858 in the amount of $125 appointing Jacob Swain guardian to Joshua L. Swain a minor orphan, Charles T. Basnight & Richd. J. Hassell securities.

Tyrrell County marriage bonds show the marriage of Abram Swain Jr. to Polly Basnight on 7 Sep 1814, Abram Swain Sr. security; also Allen West to Patsy Swain on 22 Feb 1845, Solomon H. Sample security; also Charles Brickhouse to Mahala Brickhouse on 10 Dec 1848, John M. Brickhouse security; also the marriage of Austin Perisher to Nancy Swain on 25 Oct 1853, W. W. Walker security. It appears that Mahala Swain had a previous marriage to a different Brickhouse, but no bond exists for the marriage of Mahala Swain.
