Swain, James F., 1848
Bond dated 23 Oct 1848 in the amount of $2,000 appointing Malachi Swain administrator of the estate of James F. Swain deceased, J. F. davenport & S. Melson securities.
Petition October Term 1848 of Martha Swain, widow and relict of James F. Swain, who shows that James F. Swain departed this life intestate in June 1848 leaving your petitioner, his widow, unprovided for. The said intestate left personal property of some value, out of which your petitioner is entitled to a year's allowance. She prays a court order.
Laying off of the year's allowance of Patsy Swain, widow of James F. Swain deceased, on 15 Nov 1848 by Thomas H. Alexander J. P. and Jos. Alexander & A. J. Swain.
A 100-acre tract of land was levied for want of goods & chattels on 15 Apr 1850 by W. G. Armstrong, Deputy Sheriff to satisfy a judgement obtained by Charles McClees, administrator of W. W. Lewis.
Petition October Term [no year] of Malachi Swain, administrator of James Swain, who shows that administration on the estate of the said J. F. Swain was committed to him about two years since. The personal estate has now been exhausted still leaving debts & claims unsettled to the amount of $75 to $100. The said intestate died seized and possessed of about 100 acres joining Asa Etheridge, T. H. Alexander and your petitioner. James F. Swain left as his heirs at law John Swain and James, Joseph, Martha, Mary & Amelia Swain who are infants of tender years without guardian. Petitioner prays appointment of a guardian ad litem, issuance of subpoenas and and order for sale of said land. Land was levied for want of goods & chattels on 15 Apr 1850 by W. G. Armstrong, Deputy Sheriff.
Report of the sale of the land of James F. Swain by the sdministrator on 6 Sep 1852 subject to the widow's dower. Sold to Robt. S. Halsey for $104.
