In the name of God amen I Nathan Spencer of the county afsaid being very sick and weak in or in perfect strenth of body but (or and) of perfect mind and memory thanks given unto God calling unto mind the mortality of my bod and knowing that it is appointed for all men once to die do make and ordain this my last will and testement that is to say principlly and first of all I give and recomend my soul into the hands of almighty God that give it and my body I recommend to the earth to be buried in decent Christian burial at the discretion of my executors nothing doubting but at the general resurrection I shall receive the same again by the mighty power of God and as touching such worldly estate whearewith it hath pleased God to bless me in this life I give devise and dispose of the same in the following manner and form First I give and beqath to my two sones Carny Spencer and Nathan Spencer Jur. my land in Mathusmacatt and all the rest that my father Nathan Spencer willed to me at in Hide County except my part of the negro and him to be sold the plantation wheare on I live I give to my two sons Sillomon and Wm. Spencer the line betwen them to beginn at the barns an the well leaving a west corse cross betwen the 2 ? houses one house to each the south side of the sd land to my son Solloman Spencer one cow to my son Solloman Spencer one cow to my son Wm. Spencer and one bead and cow to my son Burd, and one bead and cow to my daughter Sally Spencer

I give to my wife Sina Spencer three bead and furniture during her widowhood or natral life and a part of my plantation to susport on her widowhood or natral life and my mare and sadle and bridle the same manner as before five cows and calves five ? her choice and eight stocks of bease and twelve head of hoggs six head of sheep anew pott 1 dito one tey kittle one small kittle 2 pales 2 tubbs 2 trays 1 meal sive 2 chests 2 basketts 1 plough with the harness 1 cart 1 sett of ? 4 cheares one cubard and all the earthen ware in the sd cubard 1 huney tubb 4 barrils one loomb with the stays and geares one hand mill 2 pot iron tramills this to be equill devised after my wife deceast to my sons Nan Spencer and Issading (?) Spencer and Edward Spencer Polly Spencer to them and ther hears for ever and the above articles giveon to my other outed children to them and theare hears for ever the residue of my property as for as to pay my honest debts I leaving to be sold and the remains to be equill devidd betwen all of sons and daughters to them and thear hears for ever I leave my beloving wife Sina Spencer and Joseph White my executorix to this my last will and tesment wheare of I have sot my hand and seale this 8th day of March 1817

April Session 1817

The last will & testament of Nathan Spencer was exhibited into open court & proved by the oath of Turner Cohoon & filed.

Rosena Spencer came into open court and quallified as executrix to the estate of Nathan Spencer deceased in due form of law.

Ordered that Rosina Spencer exeutrix to Nathan Spencer deceased sell the estate of said deceased agreeable to law and make return to the next term.

July Session 1817

The inventory and account of sales of the estate of Nathan Spencer was returned to court by Rosina Spencer the executrix & filed.

Rosina Spencer widdow of Nathan Spencer deceased came into open court and signified her disent from the last will & testament of Nathan Spencer deceased.

Ordered that the Sheriff sumon a lawful jury to go on the premises of Nathan Spencer & view the estate of said deceased and set off to the widdow of said deceased her proportionate part to the said estate agreeable to law and make return to next term.

October Session 1817

Ordered that the Sheriff summon a lawful jury to go on the premises of Nathan Spencer deceased & view the estate of said deceased and set off to the widdow of said deceased her proportionable part of said estate agreeable to law & make return to the next term.

January Session 1818

Ordered that the sheriff summon a jury to lay off and set apart to the widow of Nathan Spencer deceased her right of dower in the lands of the said deceased and make return to next court.

April Session 1818

Edmund Alexander deputy sheriff returns in court Rosanna Spencers dower in land filed.

October Session 1820

Ordered that John A. Patrick Charles Hoskins and Thomas Sikes be appointed to audite & settle the accounts of Nathan Spencer deceased with his administrator & make report to the next term.

January Session 1821

Ordered that John A. Patrick Charles Hoskins and Thomas Sikes be appointed to audite & settle the estate of Nathan Spencer deceased with his administrator & make report to the next term.

April Session 1822

On motion of G. W. Navsey attorney it was ordered that see fas issue versus the heirs & devisees of Nathan Spencer deceased to show cause why the land of the said Spencer shall not be sold to satisfy an execution Jeremiah Wynne vs. said Spencer.

October Session 1825

Ordered that the children of Edmund Hopkins named Major & Lydia and the ophan of David Ambrose at the house of Zebedee Tarkenton and the child named Edward of Rosina Spencer be brought to the next term.

Spencer, Nathan, 1818


Laying off of the dowry of Rosina Spencer widow of Nathan Spencer in his lands on 13 Mar 1818. Jury was summoned by Edmund Alexander, Deputy Sheriff, and composed of John A. Patrick, Joseph White, Tarte White, David Clayton, Thos. Sykes, Thos. Liverman, John Banks, Jeconias Neal, Bartlett Jones, Isaac Jennet, Demcy Liverman & William Meekins. The land was 100 acres in Gum Neck joining Thos. Liverman. The land layed off to the widow was thirty three acres more or less, including the dwelling house.

Court order issued 7 Jul 1822 to the Sheriff of Tyrrell County to summon Carney Spencer, Nathan Spencer, William Spencer, Burd Spencer, Sally Spencer, Polly Spencer, John Spencer & Edward Spencer, heirs of Nathan Spencer deceased, represented by their guardian ad litem, Carney Spencer, to the next court on the first Monday after the fourth Monday in September 1821. There they are to give any reason they know why the lands of Nathan Spencer deceased should not be sold sufficient to satisfy an execution against his estate. The execution is for $30 with interest from 25 May 1816 & $4.80 cost.

There are also numerous documents relating to suits brought against the estate of Nathan Spencer deceased which have no apparent genealogical value.
