State of N. Carolina. Tyrrel County-- --- April the 14th. 1842. In the name of God amen. I Francis Smith of the state & county aforesaid do ordain this my last will and Testiment in manner following that is to say first I give my sole to Almighty God who gave it & my body to be desently burried-

Item- 1st. I give to my wife Rosy Smith one negro girl named Budget and her increase. I lend to my wife Rosy Smith my land & plantation during her natural life; and after all my just debts are paid I give all the balance of my property not named in this will to my wife Rosy Smith and after my wifes death I give all my land to John Arnold & Charles Johnson to be equally divide between them. I give to my sister Charity Wards children one dollar. I give to my sister Keziah Wards children one dollar. I give to my brother Leary Leachfields children fifty cents. And I hereby make & ordain my wife Rosy Smith Executrix to this my last Will and Testament set my hand & seal the day & year above written- Signed sealed published & delivered by the said Testator to be his last Will in the pressence of us.

The last Will & Testiment of Francis Smith decd. Was proved in open court by the oath of Jos. J. Pledger a subscribing witness there to who also swore he saw Jos. Tweedy sign the same as concerning testimony & Rosy Smith widow of the sd. Francis came into court & qualified ax Exrx-

The last will and testament of Francis Smith was exhibited in open court and proved by James I. Pledger a subscribing witness there to who swore that the said F. Smith was of sound disposing mind and memory at the time he signed said will - he further said that he saw James Tweedy sign said will as concurring testimony.
Rosy Smith came into court and qualified as executrix to said will.
