In the name of God Amen. The twenty third day of February Ano Doming 1768 I John Shegex of Tirrel County in North Carilinah planter being very sick and weak in body but of parfet mind and memory of my body and knowing that it is aponted for all men once to die I do mak and ordain this my last will and testament that is to say prenecaly and first of all I gave and recommend my soul into the hands of God that gave it and my body I recommend into the earth to be buried in a Cristion desent maner at the desretion of my ? executer and executress nothing doubting but at the general resorection I shall receive the same again by the mighty power of God -

And touching such worldly astate whare with it hat pleased God to bles me with in this life I gave and demise and dispose of the same in the following manner and form -

Impremis I gave and bequieve unto my well beloved wife Ann Shegex one negro boy called Tom and asseasable and quick prossession of all my moveable estate during the term of her life she the said Ann Shegex is not to make any wast of any part of the said estate as long as she liveth and then at her deseas to be equelly devided between my daughter Mary Williams and she the said Ann Shedgex shall apoynt as her legacy (?) excepting one negro garl named Jenney

Item I gave and bequeve unto my well beloved daughter Mary Williams one negro garl named Jenney as a legasy she the said negro garl and her increas unto her the sd Mary Williams and her heirs lawfully begoten and not to be disposed of in any ways -

I gave and bequeve unto my daughter Mary Williams all my lands that I am possesed with unto her and her heirs lawfully begotto of her body and to no other parson what so ever after the deseas of my wife Ann Shegex and likewise the half of all my other estate that I am posessed with at the deseas of my wife Ann Shegex to be eaquelly devid by my wifes executor and my daughter Mary Williams for her part

? my well beloved wife Ann Shegex my executrix and Joseph Hassell my other executor of this my last will and testament

Item I do hear by utterly disanol ? and disalow all and every other will and testament any wise before this time named willed and bequeved will and do alow this and no other to be my last will and testament in witness whereof I hare unto set my hand and fixed my seal the day and year first above writen

Tyrrell County Court of Pleas & Quarter Sessions


January Session 1786

Ordered that Joseph Pledger, Francis Cummins, John Hoskins, Richard Howett & William Howett or either three of them divide the estate of John Sedgex deceased between his wife's Ann Sedgex deceased heirs & the heirs of his daughter Mary Williams deceased agreeable to the last will & testament of John Sedgex deceased.

April Session 1786

Ordered that Col. John Warrington guardian of the orphans of Owen Williams deceased & orpans of John Sedgex have leave to sell the perishable part of the said orphans estates, the said order omitted the last term to be entered after being granted.

Ordered that the estate of John Sedgex deceased now undivided be sold by the executors of Ann Sedgex deceased & the money arising from said sale to be divided between the orphans of Owen Williams and among the heirs of John Sedgex & the executors of Ann Sedgex {unreadable} dividers divide.

October Session 1786

Division of the estate of John Sedgex deceased between his wife Ann Sedgex deceased heirs and the heirs of his daughter Mary Williams deceased was exhibited in court by Francis Cummins one of the dividers and ordered to be filed.

January Session 1787

Ordered that the estate of John Sedgex deceased now in the hands of Col. John Warrington guardian of Thomas Williams & Mary Williams orphans of Owen Williams deceased be divided between the said orphans of Owen Williams deceased and Martha Whidbee orphan of Joseph Whidbee deceased - and that Francis Cummins, Joseph Pledger, and William Howett or either two of them divide the estate of the said John Sedgex deceased between the above said representatives of Owen Williams deceased & Joseph Whidbee deceased and make return to next court.

April Session 1787

Francis Cummins one of the dividers, returns into court a division of the estate left by John Sedgex to Mary Williams deceased heirs to wit Thomas Williams, Mary Williams & Martha Whidbee ordered to be filed.

July Session 1790

Ordered that the estate of John Sedgex deceased remaining in the hands of the persons now in possession of the same until the suit now hanging in the Court of Equity held for Edenton District against Hezekiah Spruill & Simeon Spruill brought by Nathan Hooker be fully determined.

Memoriam of necessary papers in the estate of Ann Sedgex deceased and Mary Williams taken 8 Jan 1800:

January Term 1787

John Hoskins was appointed guardian of Martha Whidbee at the same time it was ordered the estate of John Sedgix in the hands of John Warrington guardian be divided between the heirs of Owen Williams and Martha Whidbee orphan of Joseph Whidbee.

At the same time John Warrington obtained leave to sell a negro named Jenny to pay the debts of Owen Williams deceased.

April Term 1787

Division of the estate of John Sedgix petitioned by Frances Cummen (?).

At the same time John Snell returned in court account sales of Owen Williams to amt. 67 pounds.

July Term 1788

John Warrington's account as guardian of Mary Williams at which time a ballance was reported to be due from him of 84 pounds, 10 shillings & 10 pence and to Thomas Williams to whom he was guardian also of 45 pounds, 10 shillings & 10 pence.

The accounts of John Hoskins as guardian of Martha Whidbee was also settled at the same time and a ballance found due him of 8 pounds, 14 shillings & 1 1/2 pence.

October Term 1788

Henry Norman appointed guardian to Mary & Thomas Williams in the room of John Warrington Senior deceased by his securities.

July Term 1789

John Warrington's account as administrator of Owen Williams deceased & as guardian of Mary & Thomas was audited and exhibited into court by their order and ordered to be filed.

The above appears to al the necessary minutes respecting the settlement of the estate of Ann Sedgex decease and Mary Williams.


Trancriber's Notes:

Tyrrell County estate papers of Mary Hooker in 1786 establish that John Sedgex was her father; that Mary first married Owen Williams and was married to him at the time John Sedgex wrote his will; Owen williams died and Mary then married Joseph Whedbee who died; Mary then married Nathan Hooker in Jul 1783 and then Mary died; Ann Sedgex was the wife of John Sedgex and died 178_, appointing Hezekiah Spruill and Simon Spruill her executors; Nathan Hooker petitioned to receive his deceased wife's share of the estate. Tyrrell County marriage bonds have Joseph Whedbee marrying Mary Williams with bond dated 15 Aug 1775 and Archd. Corrie security; also Nathan Hooker marrying Mary Whedbee with bond dated 19 Mar 1781 and Joseph Pledger security.
