Concidering the uncertainty of this mortal life and being in sound and perfect mind and mimary, blessed be God for the same I make an ordan this my last will and testament I apoint Thomas Swain and Samuel A. Truett my executors I first of all give and bequeath to my beloved wife Nancy all of my land on the south side of the river road up to the Culipher line during her life time or widow hood ten head of her choice out of my stock of cattle also ten head of hogs her choice ten stocks of bees her choice eight head of sheap her choice and I also give to my beloved wife Nancy one negro girl by the name of Joicy and her increase during her life time or widow hood and then to be equally divided between James L. Brickhouse and Eliza Jane Brickhouse and I give my wife Nancy three beds ? ? of her choice one loom two wheels two trunks two chest one table one beaufat and crockery five chairs & I give to my beloved son James L. Brickhouse my land on the south side of the new road up to the Culipher line after the death or marriage of my wife I also give to my son James L. Brickhouse two guns and dutch fan (?) I thirdly give to my beloved daughter Eliza Jane Brickhouse all of my land on the north side of the main road along the swamp up to the lower ? Branch and then along the old patent line to the Culipher line I also give to my daughter Eliza Jane one trunk and three pots and one kettle and all the balance of my real and personal estate to be sold and equally divided between my children and Dorcas Brickhouse two children is to come in as heir and have eaqual shares with the other heirs

The foregoing paper writing was offered to the Court of Pleas & Quarter Sessions of Tyrrel County July Term 1853 by S. A. Truitt one of the executors therein for probate as the last will and testament of Simeon Brickhouse and probate thereof was refused by the Court.

Bond dated 26 Jul 1853 in the amount of $4,000 appointing S. A. Truitt administrator of the estate of Simeon Brickhouse deceased, S. S. Simmons & Benj. A. Spruill securities.
Petition July Term 1853 of Nancy Brickhouse, widow of Simeon Brickhouse deceased, who shows that her late husband departed this life intestate in the month of June last possessed of a large personal and chattel estate. She prays allotment of the year's provision for herself and her two small children.
Petition July Term 1853 of Nancy Brickhouse against the heirs at law of Simeon Brickhouse. Petitioner shows that her late husband Simeon Brickhouse departed this life in June 1853 seized in fee simple of three tracts of land, one of 300 acres being the home place joining Jonathan Meekins & Mathias Cahoon, another tract of 40 acres upon which Warren Brickhouse lately lived joining Jonathan Meekins & Jordan L. Jones, and 30 acres joining Mathias Cahoon & Franklin Sawyer. She shows that she is entitled to dower in said lands and the heirs at law of said Brickhouse are Mathias Cahoon and wife Julia Ann, Thomas Crane and wife Lavinia, Amanda Brickhouse, Daphney Brickhouse of full age and James & Eliza Brickhouse, infants without guardian, and Jesse & Elsberry Brickhouse, infant children of Warren Brickhouse. Petitioner prays process and a writ of dower.

Summons dated the 4th Monday in October 1853 and issued 30 D ec 1853 for Matthias Cahoon and wife Julia Ann, Thomas Crane and wife Lavinia, Amanda Brickhouse, Daphney Brickhouse and James & Eliza Brickhouse and Jesse & Elsberry Brickhouse to appear at court if they see proper on the 4th Monday in January next to answer the petition of Nancy Brickhouse plaintiff and the heirs of Simeon Brickhouse defendants.
Petition January Term 1854 of Saml. A. Truitt, administrator of Simeon Brickhouse deceased, who shows that there remains in said estate unadministered three negro slaves, Edy, Joicy & Kate whom the following persons are entitled to in the following proportions: Nancy Brickhouse, widow of the intestate, Daphney & Amanda Brickhouse & Matthias Cahoon who have sold their interest to petitioner Saml., thomas Crane who has sold his interest to W. G. Armstrong, James L. Brickhouse & Eliza Jane Brickhouse, infants without guardian, all entitled to one eighth each, and Ellsberry and Jesse Brickhouse, children of Warren Brickhouse deceased, minors without guardian and entitled to one eighth. Said slaves can't be divided among the distributees without a sale of the same. Petitioner prays a court order for sale of said slaves.
Laying off of the dower of Nancy Brickhouse in the lands of Simeon Brickhouse deceased on 14 Jul 1854 by Bartlet Jones deputy sheriff and Abel Cahoon, Thomas White, John T. Tarkenton, Frederic Liverman, Wm. P. Brickhouse, F. N. Davenport, Ashbe Jones, F. F. Patrick, Thos. Jones, Stephen Godfrey, Henry Meekins & Bartlet Owens.
Bond dated 25 Jul 1854 in the amount of $2,000 appointing Thomas Swain guardian to Eliza Jane Brickhouse & James L. Brickhouse, minors or orphans, Eli Spruill & James F. Davenport securities.
Petition April Term 1855 of S. A. Truitt, administrator of the estate of Simeon Brickhouse, who states that he has fully administered the said estate and is now prepared to settle withe the distributees. That Thos. J. Crane, Timothy Jones, Nancy Brickhouse, James La Fayette Brickhouse, Eliza Brickhouse and Jesse & Elias Brickhouse, infant children of Warren Brickhouse, whose guardian is W. G. Armstrong is - are the distributees of the said intestate. To the end that a settlement be had and the accounts stated he prays that copies of this petition be served upon the parties.
