Bodwell, Banister, 1844

Bond dated 23 Jan 1844 in the amount of $500 appointing Fred E. Alfred administrator of the estate of Banister Bodwell deceased, Jefferson Cooper & Allen Cahoon securities.

Laying off of the year's provisions for Sabra Bodwell, widow of Banister Bodwell deceased, on 20 Apr 1844 by Chas. McClees, Ash B. Liverman & Thomas J. Cooper.

Summons issued 1 Dec 1846. Chas. McClees to the use of L. Bodwell recently recovered $15 in a suit against Frederick E. Alfred administrator of Banister Bodwell for non-performance of certain promises made by Banister Bodwell during his lifetime. There are no goods or chattels to satisfy this charge but Banister Bodwell died seized and possessed of lands & tenements in Tyrrell County. The sheriff is commanded to cause Sabra Bodwell, Mary Bodwell, Leml. Bodwell, Sarah Bodwell, Prudence Bodwell & S. Bodwell to appear in court on the 4th Monday in January next to show cause, if any, why the said damages should not be levied against said land. [There are several documents the same as this but with different plaintiffs.] Other documents show the land was in Frying Pan near the heirs of John Richardson.

Transcriber's Notes:

Tyrrell County marriage bonds show the marriage of Banister Bodwell to Sabry Sawyer on 7 Sep 1843, Jesse Sikes security.

The 1850 Census of Tyrrell County shows the family of William Boddle (51), Priscilla Boddle (50), Josiah Sawyer (24), Mary Sawyer (23), Swanner Boddle (15), Sarah Boddle (11) and Mary J. Boddle (7). The only other Boddle in Tyrrell County is the family of Samuel Boddle (23), and Sarah Boddle (20). Tyrrell County marriage records show the marriage of William Bodwell to Priscilla Sawyer on 11 Jan 1820, D. Clayton security. It is possible that Priscilla was married twice and Josiah and Mary Sawyer were children of her first marriage.

It appears that Banister Bodwell's heirs were his wife and his siblings since he died soon after marrying and the hiers names match with the census records.
