Sale of land from William Smith to Samuel Hogg, John Hogg and William Killingsworth

 

Know all men by these presents that we Saml Hogg of the County of

Wilson in Tennessee. Thom.s Talbott of Nashville said State. John Hogg

&                Killingsworth of the county of Halifax in North Carolina

am held & firmly Bound unto William Smith of the county of Gran=

=ville in North Carolina in the just & full sum of Ten Thousand

Pounds for the payment of which sum will & truly to be made to the

said Smith his Heirs. Exrs. Admr. Or Assigns we do hereby Bind ourselves

our Heirs, Exrs. Admr & both Jointly severally and firmly as witness our

hands & Seales below

            the condition of the above obligation is such that whereas

the above bound Saml Hogg. John Hogg & Wm Killingsworth hath this

day Bargained & sold to the said Smith Two certain tracts of parcels of

of Land containing in the whole Nine Hundred & Eleven Acres.  both of which are

situate lying & being on the waters of Big Harper in Williamson County in

said state the first of which said tracts is to contain 266 Acres Beginning at the North

east corner of a survey which has lately been made by Sherwood Green deputy

to Col. Wm Christmas for the Benefit of the Heirs or Representatives of Thos.

Hogg dec’d. Thence south 190 poles to Ogleves(sp?) line thence with his line East 224 poles

To a stake thence North 190 poles to a stake on Northern the Boundary of Hoggs

survey thence with his line west to the Beginning so as to include the 266

Acres which Saml. Hogg proposed selling Richard Oglace(sp?) & sapposed to be the whole of that part

of Mary Allins claim. which lies within the survey lately made for the Benefit of

said Hggs representatives ~ The Other had to   contain 645 Acres a more beginning in

its Boundaries on the Bank of the Big Harper on the North Boundary line of

said survey made for Hggs representatives (as we suppose the North East

corner of the tract sold by Andrew Jackson to Shoemake & then Runing so

as to Include the whole of Wilsons 640 Acre tract Adjoining shoemaker tract except

that part which he purchased from (Shoemake) also to include the small Strip

which lies between the tract claimed by Wilson & Hoggs North Boundary line. & Runing

from the said first Beginning on the River Bank thence East  with Hogs line or the line lately

Run for Hgggs Representatives or Heirs 320 poles to a stake on said line thence

thence south 324 poles to a stake. thence west 320 poles to a stake. thence North to the Befining - Now if the Above Bound or Named persons should make or cause

to be made from the proper person a good legal and general warranter deed of

conveyancein ---------- to him said Smith & his Heirs, forever for the abovedescribed two tracts of Land to contain the Boundaries of which to be most particularly described by actual survey

not less than 911 Acres on or before the 1st Next January & forever After  ---------t &

---- ------less the  said Smith his Heirs or Assigns in the peacable possession & Engagment of the

same with all such improvements as he or they may make or cause to be

made with all the Appurtenances thereunto now belonging or in Anywise

Appertaining free from any little charge or Incumberance of any

kind or nature whatsovever. The the Above Obligation to be void else to remain in full force & Virtue as witness our hands & Seales

Col C. Hogg assures Wm Smith there is at least one good spring on each of the within

mentioned tracts
