BECTON<br \/>\nJones Co \u2013 Dec 1857<\/p>\n<p>COURT EQUITY CASE<\/p>\n<p>Frederick I. Becton, Richard D. Becton, James S. Becton, Susan G. Becton,\u00a0Nancy R. Becton the four last named infants of tender years by their next best\u00a0friend Rascoe  Barry vs John E. Becton, William B. Becton, Simon S. Becton,\u00a0Elijah Loftin and Sarah his wife, Julia Becton, Jacob G, Becton, Amos Heath\u00a0and Elizabeth his wife defs \u2013\u00a0Frederick Isler Becton dec of Jones Co died sometime in 1843 leaving Eliza A.\u00a0G. Becton his widow, the defendants Sarah wife of the def Elijah Lofton and\u00a0Julia Becton daughter of his deceased daughter Julia Becton who died in the\u00a0lifetime of the sd Frederick Isler Becton and his granddaughters and the def\u00a0William B. Becton, Elizabeth Heath who intermarried with the def Amos Heath,\u00a0Jacob G. Becton and your orator as his 8 children surviving \u2013 the sd Frederick\u00a0Isler Becton had a will<\/p>\n<p>Included a copy of the will<\/p>\n<p>The sd Eliza A. G. Becton was entitled only to a life estate in the property\u00a0subject to the limitations \u2013 sd Eliza failed and negelected to take an\u00a0inventory \u2013 the defendant John E. Becton intermarried with the sd Eliza, widow\u00a0of sd Frederick Isler Becton \u2013 at the Dec Term of 1846 of the Court of Pleas\u00a0and Quarter Sessions was appointed guardian of your orators (plural),\u00a0Frederick I. Becton, Richard D. Becton, James I. Becton, Susan G. Becton, Nancy R. Becton, another def Jacob G. Becton by the court with William B.\u00a0Becton and Simon S. Becton as sureties \u2013 the sd guardian should improve the\u00a0estate that should come into his possession until they become of age \u2013 the\u00a0plfs were advised that it was not only the duty of the defs John E. Becton,\u00a0William B. Becton and Simon S. Becton to collect and take into their\u00a0possession all the slaves, household and kitchen furniture, money notes and\u00a0all property given to us by the will \u2013 the def John E. Becton did not renew\u00a0his guardian bond \u2013 the sum of $1036.49 was due from the def Jacob G. Becton\u00a0plus $54.27 \u2013 we request the Clerk and Master of the Court be the receiver of\u00a0the estate and hire out the slaves and land and manage the estate &#8211;  no one\u00a0was looking out for them as their mother who intermarried with sd John E.\u00a0Becton was dead and their only brother who had attained legal age and was\u00a0executor of their father&#8217;s will was also a surety for the guardian John E.\u00a0Becton \u2013 the will directed the def Jacob G. Becton be educated out of the\u00a0income of the estate given the wife for her lifetime \u2013 after the death of\u00a0Eliza the plfs were entitled to 1\/8 of the slaves and 1\/7 of the other\u00a0property \u2013 Eliza died sometime in 1850 but not all the children were 21 years\u00a0of age &#8211; Roscoe Barry was appointed receiver of the estate \u2013 there were 32\u00a0slaves \u2013 Jacob G. Becton was only entitled to 1\/7 of the property<\/p>\n<p>(It appears some of the pages have been mixed up in the file and it was\u00a0difficult to follow)\u00a0the children of Frederick  by his first wife were William B., Elizabeth Heath,\u00a0Julia Becton dec leaving her children Sarah Loftin and Julia Becton \u2013 by the\u00a02nd wife were Fred. I. Becton, Richard D., James , Susan G., Nancy R. and<\/p>\n<p>Jacob G.<\/p>\n<p>ANSWERS<\/p>\n<p>Defendant L. G.???? Becton  \u2013 Nancy Becton was also called Mary \u2013 he said\u00a0Frederick dec departed this life in 1843 leaving his widow Eliza and Sarah\u00a0wife of Elijah Loftin and Julia Becton daughters of Julia Becton dec daughter,\u00a0William, Elizabeth the wife of Amos Heath, Jacob as his children \u2013 he admits\u00a0to the will and to the marriage with Eliza, the death of Eliza on 19 Oct 1846\u00a0and that the letters of administration were granted to John E Becton \u2013 the\u00a0said Exec of Fred I. Becton, the sd William delivered to the sd Eliza a large\u00a0number of bonds, slaves and other property but he does not know exactly how\u00a0much \u2013 it is his understanding the Exec, William, has settled with the sd\u00a0Eliza and her husband J. E. Becton \u2013 he admits the John E. Becton was\u00a0appointed guardian and he failed to renew the bond because it was burdensome\u00a0for him \u2013 Joseph stated that the brother William was the only one of age \u2013 he\u00a0does not know if John E. Becton ever gave a full accounting to the receiver \u2013\u00a0he does not know if John E. Becton after the death of his wife sold any of the\u00a0slaves or other property of Fred I. Becton but he was told by John E. that he\u00a0did sell things and he believes he did and the amount was $730.93 \u2013 he also\u00a0stated he believes John E. has accounted for all the hire of the slaves since\u00a0the death of his wife but he didn&#8217;t have to account for them before the death\u00a0of his wife \u2013 stated that Jacob was maintained and educated according to the\u00a0will \u2013 stated that John E. and Jacob acted properly \u2013 he stated he had no\u00a0interest in the slaves or property other than as the father of the Def Sarah\u00a0wife of Elijah Loftin and Julia Becton<\/p>\n<p>NOTE: It is not clear who this &#8220;def&#8221; was giving the deposition<\/p>\n<p>ANSWER OF ELIJAH LOFTIN and wife SARAH and JULIA BECTON<\/p>\n<p>NOTE: Information in the above response will not be repeated \u2013 they stated\u00a0that the def Jacob G. Becton was not included to a portion of the slaves as\u00a0ample provisions had been made for his maintance and education \u2013 the said\u00a0Elijah Loftin shortly after his intermarriage with Sarah petitioned the court\u00a0for her fair share of the estate of her father but he has still not received\u00a0anything<\/p>\n<p>ANSWER OF WILLIAM B. BECTON \u2013 said he made a full and final settlement with\u00a0the said John and Eliza Becton on  16 May 1845 \u2013 they received the slaves they\u00a0were entitled to except for Matilda who was dec \u2013 the slaves were\u00a0Coalar aged 45, Solomon age 44, Virgil age 37, Big Jim age 33, Peter age 33,\u00a0Venus wife of Peter 30, Alfred about 13 in Sept next, Thomas age 12 in August,\u00a0Susan age 9 in June, Israel age 7 in May, William age 5 in May, Caroline age 4\u00a0in Dec, Mary Ann age 2 in Sept, Mary age 49 in Dec, Little Sarah age 26 in\u00a0April, Amanda age 15 in March, Big Sarah age 49 in Dec next, Phillis age 29 in\u00a0June, Louisa age 10 in June, Britton age 5 in April, Absalom age 3 in May,\u00a0Jiskey age 20 on 25 Feb next, Child Charity about 3 months, Boy Greene age 15\u00a0in May next, Simon age 12 in Oct next, Emperor age 3 in Nov\u00a0There were notes on the following which came into his hands \u2013 from Simon S.\u00a0Becton, John B. Morehouse, Henry Budd or W. C. Cox, Nancy Wood, Martin F.\u00a0Brock, B. C. Simmons, John Andrews or Jas Mumford, Elijah Stanly or Elizabeth\u00a0Reynolds, John Loftin or Bryan B. Becton, William Morgan or John Westbrook, D.\u00a0Y. Shever, James C. Bryan, Emanuel Jarman, B. Coleman, John A. Averett, Amos\u00a0Rhem, M. F. ?? Brock, Jacob Gooding, William Huggins, James Harrison, Jacob\u00a0Grady, John E. Becton, Abner Green or David Green, Wright Stanly, John L.\u00a0Loftin, Ivy ??? Harrison, G. Herritage, Eleay Lane or Jacob Huggins, J.\u00a0Harrison (on same line was Ivy Harrison and Lewis Koonce),  A. I. Koonce, J.\u00a0B. Reynolds, Benjamin Koonce<\/p>\n<p>Plus the bonds paid to John E. Becton for his wife \u2013 Simon L. Becton, John A.\u00a0Averett, L. ?? C Bryan, Martin F. Brock, William Huggins, James Harrison,\u00a0James B. Shine ??, Blount Coleman, Silas Heath, Freeman Smith, Nancy Wood,\u00a0Stephen Forbes, Simmons Moore, Elizabeth Stanly, Henry Budd, Elias Lane,\u00a0Thomas Morgan \u2013 plus some additional bonds for people already mentioned &#8211; he\u00a0stated the sum of $5707.45 had come into his hands as exec and he delivered to\u00a0the sd John E. Becton the amt of $5018.36 keeping $500 for himself and $300\u00a0for Elizabeth Heath, plus $412.22 charged against the estate \u2013 he then\u00a0provided a list of property delivered to the said John E. Becton for his wife\u00a0Eliza \u2013 farm items, household items, crops etc \u2013 the said John Becton was\u00a0appointed guardian and requested someone else be appointed<\/p>\n<p>NOTE: Could not find an exact date of the deposition<\/p>\n<p>ANSWER OF JOHN E. BECTON<\/p>\n<p>He had removed to Wayne Co which is why he did not want to continue to be\u00a0guardian \u2013 he only has the following of the estate of Eliza \u2013 a horse, $20\u00a0collected in Lenoir Co on Silas Heath \u2013 after the death of Eliza he sold all\u00a0the perishable estate for $730.93 but he did not keep an inventory as it was\u00a0not his duty to do so \u2013 the slaves that came into his possession from Eliza\u00a0were \u2013 Cesar aged at that time about 50, Jine ? aged about 40,\u00a0Peter about 35, Venus about 35 and her five young children among them Israel\u00a0about 6 years, Sarah about 50 and her four young grandchildren, Sarah about\u00a020, Mary about 50 and one child, Amanda about 15, Jesky about 18, Louisa about\u00a012, Susan about 12, Alfred about 15, Simon about 18, Lem ?? about 12, Phillis\u00a0about 25, Wright about 20 \u2013 of these the last two died before Eliza the wife \u2013\u00a0prior to 1850 the woman Venus gave birth to one child and also the women Sarah\u00a0and Jesky a child each \u2013 he denied receiving any money but did receive bonds\u00a0and notes amounting to $5018.36\u00a0John gave this deposition in Wayne Co<\/p>\n<p>Followed is a list of notes he received<\/p>\n<p>ANSWER OF JACOB G. BECTON<\/p>\n<p>Spring Term 1857<\/p>\n<p>No additional information<\/p>\n<p>There are a number of pages of accounts for the minor children by their\u00a0guardian John Becton\u00a0GIST of the case \u2013 a partition of the slaves \u2013 Court said that Jacob G.,\u00a0Frederick I. Richard, James, Susan and Nancy were to receive 1\/8 of the\u00a0slaves, Elijah Loftin and Sarah his wife and Julia Becton 1\/8 part \u2013 at the\u00a0partition there were 38 in total including 5 set off for JacobJacob had in his\u00a0possession viz Mary, Simon, Solomon Jr., Susan, Virin?? \u2013 the rest to be\u00a0divided keeping mothers and small children together<\/p>\n<p>Lot  #4 \u2013 to Frederick \u2013 Absolum, Caroline, Jacob and Phillis<\/p>\n<p>Lot # 3 \u2013 Richard \u2013 Alfred, Amanda, Sarah, Jecky<\/p>\n<p>Lot # 5 \u2013 James \u2013 Tom, Louisa, Harriet, Betsy, Jim<\/p>\n<p>Lot  #1 \u2013 Susan &#8211;  Britton, Emily, Ted<\/p>\n<p>Lot # 2 \u2013 Nancy \u2013 Israel, Peter, Venus, Henry<\/p>\n<p>Lot  #6 \u2013 Elijah Loftin and wife and Julia Becton \u2013 Bill, Sarah, Mary,\u00a0Holland, Lamos, Daniel, old Solomon<\/p>\n<p>Lot  #7 was set off as the 8th part consisting of Emperor, Mary Ann, Caran ??<\/p>\n<p>At the time of the division the heir Susan will be 21 in a few months, Nancy\u00a0was still the youngest and the rest are over 21.\u00a0It appears that the heir Nancy may have married John Hardy by 1860<\/p>\n<p>B. L. Perry was the administrator of Simon Becton<\/p>\n<p>Richard, Susan, Frederick, Jacob were alive and called to testify at the\u00a0Supreme Court<\/p>\n<p>In 1869 Sarah Loftin was dec and Elijah P. Loftin was her administrator\u00a0Julia Becton had md Wm. H. Barker\u00a0Amos Heath was dec and Joel A. Heath was his administrator.\u00a0F. I. Becton was bankrupt,\u00a0Susan G. Becton was dec and Wm G. Murphy was administrator\u00a0Richard Becton was dec and James Stanly was his adm<\/p>\n<p>Mary R.
