C. SUPREME COURT CASE #1869 &#8211;  VANN vs HARGETT -\u2013 Jones County, NC.<br \/>\nFound at the NC Archives, Raleigh, NC<br \/>\nJones County 23 May 1831<\/p>\n<p>On the 2nd Wed after the 2nd Mon of Sept 1827 &#8211;  John Vann and wife and Lewis\u00a0Gregory against Benj. W. Harget, Wm. Armstrong and Levicy his wife, Willis\u00a0Gregory, Ashton Gregory and William Gregory \u2013 defendants do not reside in\u00a0State \u2013 Peter Harget was the agent for Benjamin W. Harget<\/p>\n<p>Charges made by John Vann for keeping Negroes from 10 Dec 1827 to 17 Oct 1830 &#8211;\u00a0$200 proven reasonable \u2013 from the $200, 1\/7 was Vann\u2019s share of expenses\u00a0leaving $170.43 to be paid to Vann on this acct<\/p>\n<p>Deposition of John Vann \u2013 14 July 1834 &#8211; the following persons to receive\u00a0residue of the purchase money \u2013 William Gregory and Ashton Gregory both of\u00a0South Carolina, Louisa Armstrong daughter of Levicey Armstrong who was Levicey\u00a0Gregory, heirs of Celia Smith of South Carolina who was Celia Gregory, heirs\u00a0of Polly Pugh who was Polly Gregory, and William Gregory of Alabama (Note it\u00a0was not clear where Polly was from but it reads as if she lived in Ala)<\/p>\n<p>On 27 Oct 1783, Joseph Gilbert of Jones Co made his will which was probated\u00a0June Term 1784 \u2013 Among other things he left Negroes Moll and Nell to his\u00a0daughter Mary Ann Gregory for her life and then to her children except her\u00a0son John Mills Tippet for whom I have already provided \u2013 Mary Ann died and\u00a0had three children when her father died \u2013 John Mills Tippet, Levicy Gregory,\u00a0Penelope Gregory who was the wife of John Vann \u2013 after her father died,\u00a0Mary Ann had additional children \u2013 Willis, Ashton, Eliza, Polly, William,\u00a0Lewis, Allen and Joseph Gregory \u2013 Polly, Allen and Joseph died before their\u00a0mother without issue; Levicey married William Armstrong of Wake County;\u00a0Eliza married Samuel Smith of Cumberland Co \u2013 William and Levicy Armstrong,\u00a0Samuel and Eliza Smith, Willis, Ashton and William Gregory all removed\u00a0from the state.<\/p>\n<p>Mary Ann\u2019s husband, John Gregory, disposed of the negroes left to his wife in\u00a0her father\u2019s Will \u2013 Moll and her children to a Hargett of Jones Co and\u00a0Benjamin W. Harget now has said Negroes. According to the Will, the said\u00a0Negroes belonged to the children of Mary Ann. Benjamin W. Harget is fixing to\u00a0leave the State and he should not take the Negroes with him \u2013 15 March 1829\u00a0The husband of Mary Ann had no right to sell Moll. There was a Bill of Sale\u00a0from John Gregory to Peter Harget for Moll and one child on 9 March 1784.<\/p>\n<p>Isaac Kornegay delivered Moll and her child Anaka to Benjamin Williams Harget\u00a0on 19 Dec 1820. (Isaac Kornegay was the exec of the\u00a0Will of Peter Hargett &#8211;  mmm)<\/p>\n<p>DEPOSITION OF Benjamin Williams Hargett \u2013 his answer\u00a0Said Moll was not the same Moll in the Will \u2013 the Moll in question was in\u00a0possession of Mary Ann when her father died &#8211; she then sold her to Peter\u00a0Harget (sic)<\/p>\n<p>Dec 1831 &#8211; Report of sale of Negroes by the Sheriff &#8211; $676.50 payable in 6\u00a0months after the 17 Oct 1831 \u2013 Sheriff to pay 2\/7 of the residue to John Vann\u00a0and wife and Lewis Gregory \u2013 Ordered that Benjamin W. Harget would pay court\u00a0cost<\/p>\n<p>Negroes were Moll\u2019s four children \u2013 John Vann took them into his possession.\u00a0He paid the charges of $132.50 on Dec 1827.  He kept them until 17 Oct 1831\u00a0when they were sold and he is charging $200 for expenses. The Sheriff sold\u00a0them to the following people<\/p>\n<p>Moll \u2013 sold to Hubard Stanly for $81.50<br \/>\nAnakey \u2013 sold to Willis J. Vann for $241.00<br \/>\nPeter \u2013 sold to Willis J. Vann for $151.00<br \/>\nViolet  sold to Willis J. Vann for $102.00<br \/>\nTyner \u2013 sold to Willis J. Vann for $101.00<\/p>\n<p>DEPOSITIONS<\/p>\n<p>1. Selathel Ezzell \u2013 5 July 1834 &#8211; in Sampson County \u2013 said John Vann had\u00a0following Negroes in his possession \u2013 Moll, Anakey, Peter, Violet and Teynar \u2013\u00a0stated that by 1833 Celia Smith of South Carolina was dec \u2013 appears Louisa\u00a0Armstrong and Polly Pugh lived in Ala and Polly was dec.<\/p>\n<p>2. Ezzell Sutton \u2013 26 Nov 1834 \u2013 Sampson County \u2013 stated Vann had the Negroes\u00a0and their ages were Moll 50, Anakey 7 years, Peter 5 \u00bd years, Violet 3 1\/2\u00a0years and another one about 18 months<\/p>\n<p>3. William Kirby \u2013 26 Nov 1834 \u2013 Sampson County \u2013 stated the same information<\/p>\n<p>4. Selathel Ezzell \u2013 26 Nov 1828 \u2013 Duplin County \u2013 Mary Ann Gregory wife of\u00a0John Gregory and daughter of Joseph Gilbert Sen of Jones Co \u2013 Mary Ann\u2019s father\u00a0left her and her children Negroes by Will in Jones Co \u2013 names were Moll and\u00a0Nell \u2013 Mary Ann wanted Ezzell to go to Jones Co and get her Negroes for \u00bd of\u00a0said Negroes for her lifetime \u2013 question (this is not clear) did Mary Ann\u00a0Gregory and Penelope Vann wife of John Vann own each other as mother and\u00a0daughter \u2013 answer \u2013 yes \u2013 Ezzell stated that Mary Ann died 28 Dec 1826 \u2013 when\u00a0Ezzell first met Mary Ann she was a widow<\/p>\n<p>5. Sarah Hines \u2013 26 Nov 1828 \u2013 Sampson Co \u2013 Mary Ann had a daughter Penelope\u00a0who married John Vann \u2013 Sarah knew Mary Ann for 20 years and her husband was\u00a0already dec \u2013 Mary Ann lived in Sampson Co<\/p>\n<p>5. Nathan Harget \u2013 14 Sept 1829 \u2013 signed with a mark \u2013 nothing new<\/p>\n<p>6. John Chestnut \u2013 13 Nov 1829 \u2013 Duplin Co \u2013 Mary Ann married before she md\u00a0Gregory and her first husband was Teppit; Polly was married to John Pugh<\/p>\n<p>7. Elisha Gregory \u2013 13 Nov 1829 \u2013 Duplin Co \u2013 mentioned Lewis Gregory was also\u00a0Mary Ann\u2019s son<\/p>\n<p>8. Elisha Robertson &#8211; 12 Nov 1828 \u2013 Jones Co \u2013 was 55 years old; Ann Hargett\u00a0was the widow of Peter and had in her possession the Negro Moll and her children\u00a0who were Phillis, Isaac, Dennis, Clo, Hannah and others \u2013 Mr. Armstrong came\u00a0and claimed some of them but he went away<\/p>\n<p>9. Robert Gilbert \u2013 12 Nov 1828 \u2013 was 60 years old \u2013 Joseph Gilbert had several\u00a0Negroes who were the children of Moll and they were \u2013 Tom afterwards owned by\u00a0Benjamin Harrison, dec now by his widow the wife of Abner Greene; Ann was owned\u00a0by John Stanly; Lenes owned by William Hellen; other children were Nell, Violet\u00a0and Phillis; stated that Mary Ann\u2019s first husband was John Tippet; Robert\u00a0stated he was a relative of Joseph but did not state how related<\/p>\n<p>10. Richard Reynolds \u2013 5 June 1828 \u2013 Jones Co \u2013 stated he was 75 years old \u2013\u00a0said Joseph Gilbert was in the Rev. War;\u00a0Note: There was more than one Deposition from Richard Reynolds with no additional\u00a0information and it is not clear if there was more than Richard although there\u00a0was more than one Richard in Jones Co at the time<\/p>\n<p>11. Barbara Stanly \u2013 Jones County &#8211; aged 57 years \u2013 nothing new<\/p>\n<p>12  Edward Gilbert \u2013 3 Feb 1829 &#8211; Jones County \u2013 aged 40 years \u2013 son of Joseph\u00a0Gilbert (was he the son of Joseph Jr?) \u2013 Old Joseph gave Moll to his son\u00a0Benjamin Gilbert and John Gregory to be divided equally<\/p>\n<p>13. Elijah Perry \u2013 3 Feb 1829 \u2013 Jones County \u2013 aged 51 years \u2013 said old Joseph\u00a0did not like Gregory \u2013 mentioned that Jesse Gilbert worked for Joseph Gilbert\u00a0There was a mention of a Deposition of Mourning Turner and Rhoda Hawkins who\u00a0were between the ages of 60 and 70 years old but I didn\u2019t see those Depositions \u2013\u00a0Sept 1827<\/p>\n","protected":false},"excerpt":{"rendered":"<p>N.
