{"id":191,"date":"2009-08-26T00:20:24","date_gmt":"2009-08-26T06:20:24","guid":{"rendered":"http:\/\/www.ncgenweb.us\/jones\/?page_id=191"},"modified":"2009-08-26T00:20:24","modified_gmt":"2009-08-26T06:20:24","slug":"will-of-jane-adams-1883","status":"publish","type":"page","link":"https:\/\/www.ncgenweb.us\/jones\/wills\/will-of-jane-adams-1883","title":{"rendered":"Will of Jane Adams &#8211; 1883"},"content":{"rendered":"<p style=\"text-align: center;\"><em>Transcribed by <a href=\"\/jones\/contributors\">Vickie Bright<\/a><\/em><\/p>\n<p>According to the Pleasant Hill Church Minutes, Jane Adams died February 1883.\u00a0The following is her will, which is recorded in the Jones County Wills.<\/p>\n<p>I, Jane Adams, of the county of Jones and the State of North Carolina being of\u00a0sound mind and memory, but considering the uncertainty of my earthly existence,\u00a0do make and declare this my will and testament in the manner and form that is\u00a0to say:<\/p>\n<p>First. That my Executor (hereinafter named) shall provide for my body a decent\u00a0burial suitable to the wishes of my friends and relatives and pay all funeral\u00a0expenses out of the monies that may first come into his hands as a part or\u00a0parcel of my estate.<\/p>\n<p>Item 2nd.   I give and devise to my beloved daughter Betsy Adams one third part\u00a0of my cleared land (including my dwelling house) also one third part of my\u00a0woodland to have and hold the same to her, her heirs and assigns in fee\u00a0simple forever.<\/p>\n<p>Item 3rd.  I, give and devise to my beloved son George W. Adams two thirds of my\u00a0cleared lands and two thirds of woodland (which is all the remainder of my lands\u00a0after my daughter Betsy Adams has received her portion as given in Item 2nd of\u00a0this my last will and testament) to have and to hold the same to him, his heirs\u00a0and assigns in fee simple forever.<\/p>\n<p>Item 4th.  I, give and bequeath to my beloved son George W. Adams one bed and\u00a0furniture that belonged to his father, one bureau, one cross cut saw and two\u00a0chairs and a bread tray.<\/p>\n<p>Item 5th.  I give and bequeath to my beloved daughter Betsy Adams one bed and\u00a0furniture that was given to me by my father and mother, also one loom and Slaie\u00a0and the harness belonging to the loom, and one spinning wheel, one table and\u00a0three chairs and two pots.<\/p>\n<p>Item 6th.  I give and bequeath to my beloved nephew Stephen H. Adams, son of my\u00a0daughter Betsy Adams one bed and the furniture belonging to him, also one cow\u00a0and calf claimed by him, also one steer.<\/p>\n<p>Item 7th.  I give and bequeath to my daughter Hetty wife James Houston five\u00a0dollars in cash.<\/p>\n<p>And lastly I do hereby constitute and appoint my beloved son George W. Adams my\u00a0lawful Executor to intent and purpose to execute this my last will and testament\u00a0according to the ?????  intent and meaning of the same and every part and clause\u00a0thereof; hereby revoking and declaring utterly void all other wills by me\u00a0heretofore made.<\/p>\n<p>In witness whereof I, the said Jane Adams, do hereunto set my hand seal this 11th day of June A.D. 1880.<\/p>\n<p>her<\/p>\n<p>Jane    (X)   Adams<\/p>\n<p>mark<\/p>\n<p>Signed, sealed, published and declared by the said Jane Adams to be her last\u00a0will and testament, in the presence of us who at her request and in her presence\u00a0do subscribe our names as witnesses thereto.<\/p>\n<p>Benj. Brock, Jr.<\/p>\n<p>Susan Eubanks<\/p>\n<hr style=\"width: 75%;\" \/>\nState of North Carolina\t\t\t\t\tIn the Probate Court<\/p>\n<p>Jones County<\/p>\n<p>A paper purporting to be the last Will and Testament of Jane Adams deceased is\u00a0exhibited before me the undersigned Judge of Probate from said county, by George\u00a0W. Adams, the executor therein mentioned, and the due execution thereof by the\u00a0said Jane Adams by the oath and examination of Benj. Brock, Jr. and Susan\u00a0Eubanks  the subscribing witnesses therein; who being duly, oath depose and\u00a0say, and each for himself deposeth and saith, that he is a subscribing witness\u00a0by the paper writing now shown him (&amp; her) purporting to be the last Will and\u00a0Testament of Jane Adams that the said Jane Adams in the presence of this\u00a0deponent subscribed her name at the end of said writing, which is now shown as\u00a0aforesaid and which ???? date of the 11th day of June 1880.\u00a0\u00a0\u00a0And the deponent further saith, that the said Jane Adams the testatrix aforesaid\u00a0at the time of subscribing her name as aforesaid, ???? the said paper writing\u00a0so subscribed by him and exhibiting to be her last Will and Testament, and this\u00a0deponent did there upon subscribe his (or her) name at the end of said Will as\u00a0attesting witness thereto, and at the request and in the presence of said\u00a0testatrix and this deponent further saith that the said time when the said\u00a0testatrix subscribed her name to the said last will as aforesaid, and at the\u00a0time of the deponent&#8217;s subscribing his (or her) name as an attesting witness\u00a0thereof, as aforesaid, the said Jane Adams was of sound mind and memory, of full\u00a0age to execute a Will and was not under any restraint to knowledge, information\u00a0or belief of this deponent: and further these deponents say not.<\/p>\n<p>Generally sworn and subscribed \t\t\t\t\tBenj. Brock\u00a0this 12th day of March 1883\t\t\t\t\t\tSusan Eubanks\u00a0before me.<\/p>\n<p>Thos. J. Whitaker<\/p>\n<hr style=\"width: 75%;\" \/>Jones County\t\t\t\t\t\t\tIn the Probate Court<\/p>\n<p>The State of North Carolina<\/p>\n<p>To all whom these presents shall come Greeting:  It being satisfactorily proven\u00a0to the undersigned, Judge of Probate for Jones County, that Jane Adams, late of\u00a0said county, is dead.  Having made her last Will and Testament, which has been\u00a0attested(?)  to probate, a true copy where of is hereunto annexed and George W.\u00a0Adams, the Executor named therein, having qualified as such according to law.<\/p>\n<p>How these are therefore to empower the said Executor to enter in and upon all\u00a0and Sin????on the goods and chattels rights and ????? of the said deceased, and\u00a0the same to take into possession wherever to be found and are the just debts of\u00a0said deceased to pay and satisfy, and the residue of said estate to distribute\u00a0according to the discretion of said Will. \u00a0Witness my hand, and the seal of said county, this the 12 day of March 1883.<\/p>\n<p>Thos. Adams, do solemnly swear (or affirm) that I believe this writing\u00a0to be and contain the last Will and Testament of Jane Adams, deceased; and that\u00a0I will and truly execute the same by first paying her debts and then her\u00a0legacies, as far as the said estate shall extend or the law will charge me and\u00a0that I will well and faithfully execute the office of an Executor agreeable to\u00a0the trust and confidence reposed in me, according to law, so help me God.<\/p>\n<p>George W.
