Will of WILLIAM CARELEY

In the name of God Amen. I WILLIAM CARELEY Senior of Wilkes County this twenty forth day of February in the year of our Lord Christ one thousand seven hundred and ninety three being weak of body but of perfect mind and memory thanks be given to almighty God for the same do make this my last Will and Testament in manner and form as follows, First, It is my will and desire that all my just debts be paid and satisfied.
Secondly, it is my will and desire that my beloved wife MARTHA should enjoy a Negro Man named MOSES, as also a Negro woman named ISBELL with all my goods and chattles, and also my lands and all my debts as long as she bears my name.
Thirdly it is my will and desire that at the decease of my wife MARTHA to give and bequeath the above named Negro man MOSES to my son LARKIN and his heirs forever and it is my will and desire that if the said Negro should be more than one childs part that the above written son should pay up equally and if not if the said Negro come under one childs part that the rest of my children may pay up to the above named son equally his full part hereafter named WILLIAM, JOSEPH, JOHN, MARTHA, LUCY, SARAH and WILMUTH.
Fourthly, it is my will and desire that after the death of my wife MARTHA that the above named Negro man MOSES as also the above named negro woman ISBEL with all my goods and chattles should be equally divided among my eight children herafter named (To wit) WILLIAM, JOSEPH, JOHN and LARKIN, MARTHA, LUCY, SARY, and WILMUTH.
Fifthly it is my will that MARTHA should enjoy her part till death and after to the heirs of her body and LUCY I bequeath to the heirs of her body. Likewise SARAH and WILMUTH I give and bequeath to them and to the heirs of their bodies forever.
Sixthly, I do hereby utterly disallow and revoke all and every other will or wills gifts or bequeaths Legacies heretofore by me make given granted or bequeath in any way or wise whatsoever allowing and confirming this and none other to be my last will and testament that I will have executed after my death in Witness whereof I have hereunto set my hand and seal the day and year above written.

I JOSEPH ELLEDGE of the state and County aforesaid, tho weak in body yet perfect in mind and memory give my soul to God my Creator and my body to be buried in a decent manner, and after my lawful debts are paid I will that my effects be disposed of as follows, to wit,
I give to my well beloved wife SARAH all the stock & increase that I had with her and also all the household furniture that I had with her and five pounds of my other estate. I also give to my grandson JOSEPH ELLEDGE son of JACOB, all my turning tools and after my decease the rest of my effects to be sold at publick vendor and the amount to be equally divided among my three sons, ISAAC, JACOB & BENJAMIN my wife SARAH and my son BENJAMIN Executors. Witness my hand this 13th Day of January 1791.

Affidavit of THOMAS FOSTER & THOMAS DULA
January Term 1797

Capt. THOMAS DULA and MR. THOMAS FOSTER came into open court and made oath on the holy evangelist of Almighty God, that they were in Company with THOMAS ISBELL Esq'r, JOHN DULEY and sundry other persons at MAJOR JOHN ROBINS on the twenty eighth of November 1796 when a surmish (sic) happened between said THOMAS ISBELL & said JOHN DULEY and that these deponents saw said surmish, and at that time heard said ISBELL say let go my ear, and that after said surmish they saw that said ISBELL ear was bitten and both assisted in putting ear together in order to make it grow together again and that they heard said JOHN DULEY say that he had bitten said ISBELLS ear. These deponents further swear that not withstanding their endeavour to make said ear grow together that the lower part of said ISBELLs right ear hath since came entirely off in consequence of said bite. These deponents further swear that they were intimately acquainted with said ISBELL and never knew believed or heard that any part of said ISBELLs ear was off before said surmish.

The last will and testament of JAMES FREEMAN of Wilkes County and State of North Carolina in perfect mind and memory thanks be given unto God therefore calling to mind the mortality of my body and knowing that it is appointed for all men once to die I do make and ordain this my last will and testament in manner and form following That is to say to my well beloved wife I do give and bequeath all my estate real and personal and I utterly disalow and revoke all former wills legacies and requests and Executors by me in any ways made. In witness whereof I have hereunto set my hand and seal this 29 of October Anno Dom. 1797.

In the name of God Amen
I JOSHUA GREER of Wilkes County and state of North Carolina being in perfect soundness of mind and memory and calling to mind that all flesh must dye do make this my last will and Testament Viz, first I bequeath my soul to God who gave it and my body to the earth to be buried in a decent manner at the discretion of my Executors hereafter to be named first my will is that all my just debts be lawfully paid and as for my worldly estate as God has been gratiously pleased to bless me with I dispose of as follows, viz my will is that my beloved wife SARY GREER have and enjoy all my estate both real and personal during her natural life or widowhood and after her decease or marriage my will is that my land be sold and all my estate be equally divided to all my children begotten by the body of my wife SARAH except my daughter ANNE HICKERSON I give and bequeath to her ten shillings and no more my will further is that my wife SARAH shall when she thinks proper give any one of my children at their marriage or otherways as much as she thinks right & just so as not exceed an equal share and my mind and will is that whatever any one of my children should receive of my estate before the death or marriage of my wife SARAH shall be counted as part of their shares or in whole if they should receive as much as before mentioned.
And do appoint my wife SARAH GREER my true and lawfull Executrix also I do appoint my trusty friend JAMES WELLBORN my true and lawfull Executor to this my last will and Testament revoking all other wills heretofore made by me and acknowledge this to be my last will and Testament in witness whereof I have set my this the seventh day of October one thousand seven hundred and ninety six.

In the name of God Amen. I THOMAS HOLEMAN of the County of Wilkes and State of North Carolina, being very sick and weak, but of perfect mind and memory, thanks be given unto God, calling unto mind the mortality of my body and knowing that it is appointed for all men once to die, do make and ordain this my last will and testament. That is to say principally and first of all I give and recommend my soul into the hands of Almighty God that gave it, and my body I recommend to the earth to be buried in a decent Christian burial at the discretion of my executors nothing doubting but at the general resurrection I shall receive the same again by the Almighty power of God. And as touching such worldly estates wherewith it has been pleased Go to bless me in this life I give demise and dispose of the same in the following manner and form.
First. I give and bequeath to SUSANNAH HOLEMAN my dearly beloved wife the third part of my land, horses and cattle and all that I possess. Also I give to my two sons and one daughter ABSALOM, REUBEN and SUSANNAH HOLEMAN all and the remaining part which is two thirds of my lands, horses, cattle, and all the remaining part of my possessions.
Secondly. I give to well beloved daughter RACHEL and to my son JOSEPH 1 shilling sterling.
Thirdly. I give to my son DANIEL HOLEMAN and to my daughter REBEKAH 1 shilling sterling.
Fourthly. Also I give to my sons ISAAC and THOMAS HOLEMAN 1 shilling sterling.
Fifthly. And also I give to my daughters GRACEY and ELIZABETH HOLEMAN 1 shilling sterling. Also I give to my son JACOB and MARGARET my daughter 1 shilling sterling. Also I give to my son JAMES HOLEMAN 1 shilling sterling.
Likewise I constitute make and ordain, EPHRAIM DAVIS, and SUSANNAH my beloved wife the sole Executors of this my last will and Testament, all and singular my lands horses, cattle &c by them freely to be possessed and enjoyed by my wife and children as aforesaid and I do hereby utterly disallow revoke and disannul all and every other former testament, Will Legacies, bequests and executors by me in any wise before named, willed and bequeathed, ratifying and confirming this and no other to be my last will and testament. In witness whereof I have hereunto set my hand and seal this tenth day of January in the year of our Lord one thousand seven hundred and ninety eight.

In the name of God Amen. I THOMAS MAHAFFEY of the State of North Carolina in the County of Wilkes farmer, being very sick and weak in body, but of perfect mind and memory thanks be unto God for all his mercies, calling into mind the mortality of my body do make and ordain this my last will and testament, that is principally and first of all I give and recommend my soul into the hands of Almighty God that gave it and my body I recommend to the Earth to be buried in decent Christian burial at the discretion of my Executors hereafter named, and as touching such worldly estate wherewith it as pleased God to bless me in this lifer, I give demise and dispose of the same in the following manner and form.
First of all I give and bequeath unto my beloved son JAMES MEHAFFEY (whom I constitute and appoint my sole Executor of this my last Will and Testament) all my goods and chattles households furniture and all my debts due to me with all my moveable effects, he taking care to maintain and providing for my beloved wife HANNAH MEHAFFEY and ELIZABETH MEHAFFEY my daughter during their natural lives and paying unto my son THOMAS MEHAFFEY, my daughter MARTHA DAVIS and ISABELLA KELL the sum of five shillings each, and I do hereby disallow utterly and revoke all former Wills and testaments by me made declaring this to be my last will and testament. In witness whereof I have hereunto set my hand and seal this twentieth day of February in the year of our Lord one thousand seven hundred and ninety four.

In the name of God, Amen. I ISAAC MARTIN of the County of Wilkes being in perfect health and memory do make and ordain this to be my last and testiment, disanulling all former Wills and Testaments heretofore made by me, and my desire is that it shall be in manner and form as followeth Vizt,
Imprimis. I lend to my beloved wife PEGGY MARTIN during her widowhood all my estate both real and personal with the increase for her support only it is my desire that she shall not lend nor destroy any part of my estate and its my desire that if my beloved wife during her life or widowhood should make anything of my estate more than her support that she may not give nor lend to anyone of my children more than another, and after her my beloved wifes death or widowhood to be divided in the following manner, To wit:
Item. I give and bequeath unto my beloved son JOHN MARTIN and his heirs JAMES Negro man, ANTONEY another man, LUCEY a Negro girl and her increase and twenty four hard money to make her part equal in the Negroes.
Item. I give my beloved daughter FANNEY GREEN and her heirs JUDY nd her increase and DAVID a Negro boy and PHEBE a Negro girl and her increase.
Item. I give to my beloved daughter ELIZABETH BAGGBY [sic] and her heirs EGGE a Negro woman and her increase, AMEY and her increase and JACOB a Negro boy.
And all my estate both real and personal to be equally divided between my three children namely JOHN MARTIN, FANNEY GREEN and ELIZABETH BAGBY to them and their heirs forever. Lastly I do constitute my beloved wife PEGGY MARTIN Executrix and my son JOHN MARTIN and THOMAS GREEN and JOHN BAGBY executors to this my last will and testament. In witness whereof I have hereunto set my hand and affixed my seal this twenty fifth day October One thousand seven hundred and ninety four.

In the Name of God Amen. I PETER NOLAND of the State of North Carolina and County of Wilkes being weak in body yet perfect in mind and memory, and calling to mind the mortality of my body knowing that it is appointed for all once to die, I commit my soul to God my redeemer and my body to be buried at the discretion of my Executors hereafter mentioned. First my will and desire is that all my lawful debts be paid by my Executors. Item. I give to my son SAMSON five shillings. I give also to my daughter, MARTHA CARREL five shillings. I give to my daughter DELILAH DAVIS one cow with first calf also one pewter dish and three plates or one breeding sow and three barrows year old in August next one saddle and bridle three pounds price and twelve pounds of feathers. I give to my daughter SARAH CARREL one red spotted cow and calf and yearling a stear also two you sows and eight pigs, also three barrows going on two years old. Also one feather bed and bed quilt, one large iron pot. I give to my grandson PHILIP NOLAND son of DELILAH DAVIS fifteen pounds to be paid to him by my Executors in a horse and saddle at hi coming to twenty years of age. I will that my crop of small grane be equally divided between my son HENRY and MOSES and JAMES CARREL except five bushels to WILLIAM DAVIS if he will assist to take care of said grain. I give to my daughter SARRAH CARREL one two year old sorrel horse colt. I give to my son HENRY one three year old heifer with calf also one dutch oven also one two gallon pot. As for the remainder of my estate I give it all to be equally divided among my three sons HENRY, PIERCE and MOSES as they may divide it themselves. I appoint my son PIERCE and JOHN BROWN Esqr. my Executors. I acknowledge this to be my last will and testament. Witness my hand and seal this 16th day of April one thousand seven hundred and ninety six.

In the Name of God Amen I EMANUEL ROSE of Wilks County and North Carolina being in perfect mind and memory but some what afflicted in body. Calling to mind the mortality of man and that it was appointed once for all to die I make and ordain this my last will and testament first of all I I recommend my sole to God that gave it and my body to the Earth to be buried in a decent Christian burial at the discretion of my Executors nothing doubting but I shall receive it again at the last Resurrection by the almighty power of God.
And as touching this worldly Estate which it has pleased God to bless me with I give demise and dispose of in the following manner and form, to wit first I lend to my beloved wife MARY ROSE my hole Estate during her natural life or widowhood and after her decease or marriage the whole to be equally divided between my five beloved children, to wit, KESIA ROSE, MARY HOLLOWAY, SARY ROSE, ELIZABETH ROSE, SUSANNA ROSE. In the first place before it is divided each one of them that is single at this time is to have as much as MARY who is marked, to wit one good horse & saddle one good bed and furniture one cow one sow & pigs one ewe & lamb and after each of them the above mentioned children has had as much as MARY then the balance to be equally divided between the whole five children. In witness here of I have here unto set my hand and affixed my seal this 28 day of August 1794.

In the name of God Amen, I PETER WIANT of the County of Wilkes and State of North Carolina being through the abundant mercy and goodness of God though weak in body yet of a sound and perfect understanding and memory do constitute this my last will and testament and desire it to be received by all as such. In primis I most humbly bequeath my soul to God my maker beseeching his most gracious acceptance of it through the all sufficient merits and mediation of my most compassionate Redeemer Jesus Christ who gave himself to be an attonement for my sins and is able to save to the uttermost all that come unto God by him seeing he ever liveth to make interession for them and who I trust will not reject me a returning penitent sinner when I come to him for mercy in this hope and confidence I render up my soul with comfort, humbly beseeching the most blessed and glorious trinity one God most holy most merciful and gracious to prepare me for the time of my disolution and then to take me to himself into that peace and rest and incomparable felicity which he has prepared for those that love and fear his holy name Amen Blessed be God. Imprimis I give my body to the earth from whence it was taken in full assurance of its resurrection from thence at the last day as for my burial I desire it may be done without pomp or State at the discretion of my dear wife and executors hereafter named who I doubt not will manage it with all requisite prudence. As to my worldly estate I will and positively order that all my debts be first as paid. Item I give to my dear and loving wife this house where I now live with all the furniture therein and all the land and convenients that ly about it with all my world goods after my death as long as she remains my widow, and if she marries or dies then to be equally divided between my three sons PETER WIANT, PHILIP WIANT and JOHN WIANT. And I do constitute JOHN CONLEY and DAVID EDWARDS Executors of this my last will and testament and trustees for my wife and children. In witness whereof I have hereunto set my hand and seal the 19th day of February 1796.
