County North Carolina.
 

MARY BULLOCK late of Vance County is dead and she left a last will which was executed in Virginia.
You will please issue a commission to JOHN S. BURROUGHS, Esq. Norfolk, Virginia authorizing him to take the examination of the witnesses touching the validity of same will.

Greeting:
We, reposing special trust and consider in your integrity, do authorize and empower you to cause RICHARD H. BURROUGHS, J. W. DOWELL and DR. B. M. BAKER, to appear he??? you at such time and place or you may appoint and under oath to examine touching all such matters and things as they shall however of and concerning the proof of a will in our Inferior Cort for the County of Vance, executed by MARY BULLOCK Plaintiff and Defendant and the definition in writing by you so taken the same to trasmit with your seal, to our Inferior Court to Witness HENRY PERRY Clerk of said Court at office in Henderson, this 7th day of June 1909.

In the name of God, Amen, I MARY BULLOCK, being in sound mind do make this my last will & testament, I give & bequeath to my dar nephew WALTER SNEED, all of my property both real & personal. In witness whereof I hereby affix my signature, witness my hand this 24th day of  August 1899.

a paper writing purporting to be the last will and testament of MARY BULLOCK deceased is exhibited before me JOHN J. BURROUGHS, Commissioner by A. J. HARRIS and the due execution thereof by the said MARY BULLOCK is proved by the oath and examination of RICHARD H. BURROUGHS the subscribing witnesses thereto who, being sworn, doth depose and say for himself deposeth and saith that he is a subscribing witness to the paper writing now shown him purporting to be the last will and testament of MARY BULLOCK hereto attached, that the said MARY BULLOCK in the presence of this deponent subscribed her name at the end of said paper writing, now shown as aforesaid, and which bears date of the 21st day of August 1899.

And the deponent further saith, that the said MARY BULLOCK the testator aforesaid, did at the time of subscribing her name as aforesaid, did on the said paper writing so subscribed by her and exhibited to be her last will and testament, and this deponent did thereupon subscribed his name at the end of said will as an attesting witness thereto and at the request and in the presence of the said testator, as did also SALLIE SNEED, who likewise witnesses said paper writing as a witness by making her mark at her request and in her presence.

And this deponent further saith, that at the said time when the said testator subscribed her name to the said last will as aforesaid, and at the time of deponents subscribing his name as an attesting witness thereto, as aforesaid, the said MARY BULLOCK was of sound mind and memory of full age to execute a will and was not under any restraint to the knowledge, information or belief of this deponent, and further the deponent say not.

DR. B. M. BAKER being sworn cnfirm and says, that on or about the 21st of August 1899, he was attending MARY BULLOCK a colored woman, in what proved to be her last sickness, and that while he was there attending her she expressed a desire to make her will, and asked affiant to perform(?) it which at her request affiant did. The paper writing hereto attached is the paper so drown at her request as her last will and testament by affiant. Affiant further deposeth that on the 21st of August 1899, said MARY BULLOCK was of sound mind and memory, of full age to execute a will and was not under any restraint to the knowledge information or belief of affiant. SALLIE SNEED whose name is attached to said will was at the time of its execution attended said MARY BULLOCK as her nurse.

Pursuant to the commission hereto attached from HENRY PERRY Clerk of the Inferior Court of Vance County, State of North Carolina dated the 7th day of June 1909 to me directed. I summoned RICHARD H. BURROUGHS and DR. B. M. BAKER to appear before me in my City aforesaid to testify touching the execution of the will of MARY BULLOCK, hearing date the 21st day of August 1899, hereto attached, and I further certify that the said RICHARD H. BURROUGHS and DR. B. M. BAKER, severally signed and made oath to the fact set forth in this respective affidavits hereto appended, all of which is respectfully submitted.

A paper writing purporting to be the last will and testament of MARY BULLOCK deceased, is exhibited before me the undersigned Clerk of the Inferior Court for said County by ANDREW J. HARRIS, atty. for SALLIE SNEED and the due
execution thereof by the said MARY BULLOCK is proved by the oath and examination of SALLIE SNEED one of the subscribing witnesses thereto who being duly sworn, doth depose and say that she is a subscribing witness to the paper writing now shown her purporting to be the last will and testament of MARY BULLOCK that the said MARY BULLOCK in the presence of this deponent, subscribed her name at the end of said paper writing, now shown as aforesaid, and which bears date of 21st day of August 1899. And the Deponent further saith that the said MARY BULLOCK the testator aforesaid did at the time of subscribing her name as aforesaid, declare the said paper writing so subscribed by her and exhibited to be her last will and testament, and this deponent did thereupon subscribe his name at the end of said will as an attesting witness thereto and at the request and in the presence of the said testator, and this deponent further saith, that at the said time when the said testator subscribed her name to the said last will as aforesaid and at the time of deponents subscribing her name as an attesting witness thereto, as aforesaid, the said MARY BULLOCK was of sound mind and memory of full age to execute a will and was not under any restraint to the knowledge, information, or belief of this deponent. And further these deponents say not

The paper writing purporting to be the last will and testament of MARY BULLOCK dec'd is exhibited in Open Court. And the due execution thereof by MARY BULLOCK is duly proven by the annexed proofs. And on motion it is ordered that the said will be admitted to probate & recorded in Book Y Wills of Vance County as provided by Law.
