To all to whom these presents shall come, or may concern: Greeting:

Know Ye, that we, having examined the records and files in the office of the Surrogate of the County of Kings, do find there remaining a certain record of the last Will and Testament of Martha M. Young, deceased, together with the petition, the depositions of the subscribing witnesses, the decree admitting said Will to probate, and the letters Testamentary granted thereon.

In Words and figures following, towit: United States $3.00 Internal Revenue.

In the Name Of God, Amend, I, Martha M. Young, of Brooklyn, Kings County, and State of New York, being of sound mind and memory, and considering the uncertainty of this life, do therefore make, ordain, publish and declare this to be my last Will and Testament, That Is To Say:

First, after all my lawful debts are paid and discharged I give and bequeath to Sarah M. F. Scott, of the City, County and State of New York, all my property, real and personal, of which I am now possessed or shall be seized at the period of my demise; To Have and To Hold The Same for herself her heirs and assigns, as of her and their own right and in fee simple.

Likewise I make, constitute and appoint the said Sarah M. F. Scott, to be executrix of this my last will and testament, hereby revoking all former Wills by me made.

In Witness Whereof, I have hereunto subscribed my name and affixed my seal the twenty first day of October, in the year of our Lord, one thousand eight hundred and sixty five.

Subscribed By Martha M. Young, the Testator named in the foregoing Will in the presence of each of us, and at the time of making such subscription the above instrument was declared by the said Testator to be his last Will and Testament, and each of us, at the request of the said Testator, and in her presence, and in the presence of each other, signs his name as a witness thereto at the end of the Will.

In The Matter of the Application for the probate of the last Will and Testament of Martha M. Young, late of the City of Brooklyn, deceased. Kings County, towit:

I, Sarah M. F. Scott, of the City of Brooklyn, being duly sworn and examined, do depose and say that I am executrix named in the last Will and Testament of Martha M. Young late of the City of Brooklyn, in the County of Kings, deceased. That the deceased was, at the time of her death, an inhabitant of the County of Kings, and departed this life in said County, on the 14th day of November, in the year 1866. That said last Will and Testament relates to both Real and Personal Estate and that the heirs and next of kin of said deceased are as follows; no husband, children, descendants of children, father or mother, but one brother and one sister, to-wit: John M. Young, and Eleanor Reid, residing in the State of Missouri, and whose post office address is unknown. The estate of deceased is less than six thousand dollars in value to the best of deponents knowledge.

And I ask that the said Will and Testament may be proved, and letters Testamentary granted thereon, according to law.

In The Matter Of Proving The Last Will And Testament Of Martha M. Young, Late of the City of Brooklyn, deceased.

Kings County, towit:

Peter B. Crolins of the City of Brooklyn being duly sworn and examined before William D. Veedler, Surrogate of the County of Kings, doth depose and say, that he was well acquainted with Martha M. Young, now deceased, that the subscription of the name of Martha M. Young, deceased, at the end of the instrument now shown to this deponent and offered for probate as the last Will and Testament of the said Martha M. Young, deceased, and bearing date the twenty-first day of October, in the year one thousand, eight hundred and sixty five was made by the said deceased in the presence of Eliza J. Crolins, and of this deponent, that at the time of making such subscription the said Martha M. Young, deceased, declared the said instrument so subscribed by her last will and testament and that thereupon this deponent signed his name as a witness at the end of said instrument, at the request of the said Martha M. Young, deceased, and in her presence, and that the said Martha M. Young, deceased, at the time of executing the said instrument was over the age of twenty-one years , of sound mind and memory and not under any restraint.

At a Surrogates Court held in and for the County of Kinds at the Surrogates office in the City of Brooklyn on the eighth day of January, in the year 1867.

Present: William D. Veeder, Surrogate.

In The Matter Of proving The Last Will And Testament of Martha M. Young, late of the City of Brooklyn, deceased.

Satisfactory proof having been made of the due service of the citation issued in this matter, requiring the proper person to appear in this Court on the eighth day of January, in the year 1867, to attend the probate of the last will and testament of the said Martha M. Young, deceased, the witnesses to said Will were sworn by the surrogate and examined before him, their examination was reduced to writing and filed, and this Court being satisfied that the said will is genuine, doth adjudge and decree that the said Will was duly executed by the said Martha M. Young, deceased, at the time she executed the same was in all respects competent to devise real estate and not under any restraints; that the said will is a valid will of real and personal estate; and that the proofs thereof are sufficient.

And this Court doth Order; that the said will, proofs and examinations be recorded, and that letters testamentary issue to the Executrix in said Will named on her taking the oath required by the Statute.

Know Ye that at the City of Brooklyn, in the County of Kings, on the 8th day of January, in the year of our Lord one thousand eight hundred and sixty seven before William D. Veeder, Esquire, Surrogate of our said County, the last Will and Testament of Martha M. Young, late of the City of Brooklyn, deceased, was proved, and is now approved and allowed by us; and the said deceased being at the time of her death an inhabitant of the County of Kings; by reason whereof the proving and registering the said Will and the granting administration of all and singular the goods, chattels, and credits of the said deceased , and also the auditing, allowing and final discharging the account thereof, doth belong unto the Surrogate of the said County, the administration of all and singular the goods, chattels, and credits of the said deceased and anyway concerning her Will, is granted unto Sarah M. F. Scott, the Executrix in the said will named she being first duly sworn faithfully and honestly to discharge the duties of such executrix.

In Testimony Whereof, we have caused the seal of office of our said Surrogate to be hereto affixed.

W. D. Morrison, of the County of Hyde having produced for probate in said County, before R. D. Harris, Clerk of the Superior Court thereof the attached exemplification or certified copy of the last Will and testament of Martha M. Young, deceased, together with the petition, the deposition of subscribing witnesses, the decree admitting said Will to probate, and the letters testamentary granted thereon, as the same appear of record and on file in the office of the Surrogate of the County of Kings, State of New York, and it affirmatively appearing there from to this Court that the said last Will and Testament was duly executed, attested and probated in the form and manner required by the laws of North Carolina, and that the execution, attestation and probate thereof are in all respects regular and sufficient to pass title to real and personal property in this State, it is now ordered and adjudged by this Court that the said exemplification be received, filed and recorded in the office of the Clerk of the Superior Court of Hyde County aforesaid, as a full, true and correct record of the last Will and Testament of the said Martha M. Young, deceased, together with the petition, the depositions of subscribing witnesses, the decree admitting said Will to probate and the letters testamentary granted thereon, as fully to all intents and purpose as if the original will had been filed and probated before the said Clerk and as provided by law in such cases.

The foregoing certificate of the proof and probate of the within and foregoing paper writing purporting to be a certified copy of the Last Will and Testament of Martha M. Young, late of the County of Kings, State of New York, by Wm. P. Pickett, Clerk of the Surrogate's Court of the County of Kings, State of New York, attested by his official seal, is adjudged to be correct and in due form of law.

It is further adjudged that the said paper writing is a true copy of the last Will and Testament of Martha M. Young, deceased, and that the said Will has been duly and lawfully executed, proven and certified as a will of land in the State of North Carolina.

And it appearing that the testator in said will died seized of lands in the County of Tyrrell in the State of North Carolina, it is ordered that the said paper writing, together with the certificate of the aforesaid Wm. P. Pickett, Clerk of the Surrogate's Court of the County of Kings, in the State of New York, attested by his official seal, the certificate of Jas. C. Church, Sole Presiding Magistrate of the said Surrogate's Court, attested by his official seal and of Wm. P. Pickett, Clerk of the said Surrogate's Court of the County of Kings, in the State of New York, and the other papers thereto attached, including the certificate of the Clerk of the Superior Court of Hyde County, North Carolina, attested by his official seal, be admitted to probate and recorded in Tyrrell County, North Carolina.
