In the name of God amen: I Sarah Wynne of said County do make publish and declare this to be my last Will & Testament. First - I recommend my soul to God who has been very mercful to me, and desire my body to be buried in a decent manner by my executors, and as respects such worldy estate as it has pleased God to bless me with I devise and bequeath as follows ---

First - I give my daughter May Halsy and her heirs the one third part of the sum my chattle property shall sell for, I also give her the one third part of my negros Nanny, Dick, Muril, Chloe, and Darbe to be divided by three persons selected by the County Court of Tyrrell ---

Secondly - I give to Charls Hoskins and Jos. Halsy and their heirs in trust and for the express purpose herein after specified, the one third part of the negros above named the division of them to be made as stated in the precdig clause; And I expressly enjoin it upon the said Trustees to take particular care that no part of the said property shall be converted to any other use but for the maintaince, comfort and support of my daughter Lidyia Garrett and to the support, education and mainten of her child to be dealt out to her and child at ther descretion: I also give to the trustees for the benefit of my daughter Lidya and child Elizabeth one third part of the proceds of the sale of my chattle property after paying my debts & Legacies to be under the beter restrictions and to be applied to the same purposes as the negro property above given. Upon the death of Lidya Garrett the trustees shall convey all the property heretofore devised or bequeathed to her child Mary Elizabeth Garrett, upon her marriage or arriving at the age of twenty one and if she shall die without being married or arriving to the age of twenty one there upon the death of Lidy Garrett the trustees shall convey all the property herein devised to the children or legal representative of May Halsy and Sarah Sutton and I do herby give the trustees full power to appoint by will or deed under their hands and seals one or two trustees who shall have all the powers and authorty, that is now vested in the said Hoskins & Halsy---

Thirdly - I give to Charles Hoskins & Jos. Halsy and their heirs forever in trust in order to proceede effectually for the support of my daughter Sarah Sutton and her children the following property one third part of my negro property, the part to be ascertained as stated in the devise to my daughter May. I give to the trustees for the benefit of my daughter Sarah & children the one third part of the sale of my chattle property after my debts are paid. The trustees shall pay out the profits of the said property comfortly to maintain my said daughter Sarah and children I further enjoint it upon the said trustees that upon the death of Sarah Sutton to convey the property to her children or the survivors and upon the death of children of said Sarah they the trustees shall convey the said property to the children of May Halsy and Lidy Garrett - or their legal representatives - I do herby give Charles Hoskins and Jos. Halsy full power to appoint by will or deed under their hands and seals a trustee or trustees who shall have all the power they have or possess ---

I give to my beloved brother James Hoskins out of the two hundred dollars left me in my husbands will sufficent to purchase him and his daughter May a morning suit each - The remaing part of the two hundred dollars, I give the onethird part to my daughter May Halsy and one third to the trustee for the benefit of my daughter Lidya Garret & child and one third to the trustees for the benefit of my daugher Sarah Sutton & children-

I herby nominate constitute and appoint Jos. Halsy and Charls Hoskins excutor to this my last will and testament - In witness whereof I have hereto set my hand and seal the 23 Sept. 1832-

The last will and testament of Sarah Wynne was exhibited in open court and the execution of it proved by the oath Thomas Alexander one of the subscribing witnesses there to swore that she signed sealed & published the same and at the time she was of sound disposing mind & memory and that he saw Hart Fuly (?) a subscribing witness thereto sign the same in concurring testimony therewith - ordered that it be recorded.

Jos. Halsey executor of Jeremiah & Sarah Wynne returned on oath into open court the inventory & account of sales of said estates & filed.

Jos. Halsey one of the executors of Sarah Wynne came into court and qualified to said will.

Petition January Term 1833 by Joseph Halsey & Charles Hoskins executors of the last will & testament of Sarah Winn deceased and trustees specially appointed thereby for the purposes therein set forth. Diverse clauses set forth in the will give the following negroes viz. Nancy, Dick, Murel, Chloe & Darbe to be divided with 1/3 to Mary Halsey and the other 2/3 to be retained by petitioners as trustees for the benefit of Sarah Sutton & Lydia Garrett and for their exclusive support. Pray commissioners be appointed to effect said division with 1/3 set apart to petitioner Joseph Halsey and wife Mary.

Division of the negroes belonging to the heirs of Sarah Wynne on 30 Jan 1833:
to Joseph Halsey man Dick valued at $175 and woman Murel valued at $100;
to Lydia Garrett woman Chloe valued at $275;
and to Sarah Sutton man Darb valued at $400.
An old woman named Nancy was adjudged to be an invalid.
Sarah Sutton has to pay $41.44 to Joseph Halsey & Lydia Garrett.


Transcriber's Notes:

Tyrrell County marriage bonds show the marriage of Lydia Wynn to Baldy Garrett on 11 May 1818, Thomas Hardison security; also Sarah Wynn to Henderson Sutton on 17 Feb 1818, Joseph Horniblow security; also Marey Wynne to Joseph Halsey on 28 Oct 1823, W. B. Hodges security. Sarah Wynne was probably the S. Hoskins who married J. Wynne on 12 Mar 1796, Frederick Massey security.

Sarah Wynne was the wife of Jeremiah Wynne who died testate about six months before she died.
