In the name of God Amen the 13th day of December, one thousand seven hundred and sixty nine I John Wheatley of the Province of North Carolina and of Tyrrell County being very sick and weak in body but of perfect mind and memory thanks be to God therefore calling unto mind the mortality of my body and knowing that it is appointed for all men once to die I do make and ordain this my last will and testament that is to say principally and first of all I give and recommend my soul into the hands of almighty God that gave it and my body I recommend to the earth to be buried in decent and Christian burial at the discretion of my executors nothing doubting but at the general resurrection I sall receive the same by the mighty power of God and touching such worly estate wherewith it hath pleased God to bless me in this life I give demize and dispose of the same in the following manner and form - - - -

Imprimis I give unto my son Benjamin Wheatley my dwelling plantation and all the land thereto belonging and one negro man named Guy and one feather bed and furniture one new desk two guns two horses named Ball and Diment one saddle and bridle and four cows and calves I say unto my son Benjamin Wheatley to him his heirs and assigns forever - - -

Item I give unto my son John Wheatley a certain plantation and all the land belonging there unto lying over Conehoe Creek formerly called Anthonys Old Field and four cows and calves one feather bed and furniture and one gun and one gray maire named Parrot and one desk and one case of bottles and one black walnut table and one negro fellow named Robin I say unto my son John Wheatley to him his heirs and assigns forever - - -

Item I give and bequeath to my daughter Ann Wheatley a certain piece of land known by the name of the Pretty Beaver Dam I say unto my daughter Ann Wheatley to her and her heirs lawfully begotten and for want of such heir to the next heir of the family also I give to my said daughter Ann one negro girl called Dinah and one bed and furniture and two cows and calves and one chest and one woolen wheel I say to my daughter Ann to her and her heirs and assigns for ever - -

Item I give and bequeath to my daughter Mary Wheatley a certain piece of land known by the name of High Iland and Cow Island I say to my daughter Mary Wheatley to her and her heis and assigns for ever also one negro girl called Jenny I say to my daughter Mary Wheatley to her and her assigns for ever also one feather bed and furniture and two cows and calves and one woolen wheel and one chest

Item I give unto my daughter Lidia Wheatley a certain piece of land containing three hundred and eighty acres as by a patent will fully appear lying on Grindal(?) Creek I say unto my daughter Lidia Wheatley to her and her heirs and assigns for ever also one negro boy called Simon I say unto my daughter Lidia to her and her heirs and assigns for ever also one feather bed and furniture and two cow and calves and one linnen wheel - -

I give unto my loving wife one feather bed and furniture I say unto my loving wife Mary Wheatley to her and her heirs and assigns for ever also I leave the use of a certain negro woman Judah and the increase of the said negro woman to be equally divided among my said children the use of the said negro woman Judah to my wife Mary Wheatley during her natural life and one horse bridle and and sadle

Item I will and desire that my children may be educated and the charge paid out of my estate.

Item I leave a certain negro felow called Sam to be sold and the money to be reserved to purchase a negro for my son John Wheatley and if the money arising from the sale of the said negro should not be equivalent to purchase another my estate to make good the default to my son John Wheatley

Item I likewise nominate and appoint John Ballard my son Benjamin Wheatley and my loving wife executors and executrix of this my last will and testament and do disannul all and every other wills and testaments by me formerly made and do allow this and no other to be my last will and testament - - - -

Item I will and desire that the remainder of my estate may be divided among my children

Signed sealed pronounced and declared by the said John Wheatley to be his last will and testament before us the subscribers

In the term of February 1770 personally appeared Ephenitus Griffin and made oath on the Holy Evangelist of allmighty God that he heard and saw John Wheatley declare sign seal & pronounce this writing to be and contain his last will and testament and that he then was of sound mind and disposing memory and that he saw Nathl. Cooper & Poley Beloto sign as witnesses

February Session 1772

Mary Wheatley an infant came into court and chose her mother Mary Wheatley her guardain ordered that she give security in the sum of three hundred pounds proc. money which security is given by Arthur Gainer & Benjamin Wheatley.

November Session 1772

Benjamin Wheatley is appointed guardain of Lidia Wheatley orphan of John Wheatley deceased and enters in bond with John Ballard and Mathew Yarrell security in 400 pounds.
