In the name of God amen: This 6th day of Feby 1804 I Joseph Waliway of the County of Tyrell and State of North Carolina being indisposed of health body and sound mind and memory thanks be to God, but calling to mind the mortality my body and knowing that it is appointed for all men once to die, do make and ordain this to be my last Will and Testament that is to say principally and first of all I recommend my soul into the hands of God that gave it, nothing doubting but I shall receive the same again at the general resurection of the last day by the mighty power of God and as for my body I recommend to the earth to be buried in decent Christian at the discretion of my executors hereafter named and as for what worldly goods it has been pleased God to bless me with in this life, I give demise and dispose of in the following manner and form ---

Item - I give to my beloved wife Sarah Walloway all the possions that is now in the house for her and the childrens support also I give to my beloved wife the use of all the stock of cattle sheep bees hogs during her life or widdowhood to support her and her children on and after either of the two words life or widdowhood the stock to be equally divided between my wife if living and my three sons Wm. Nath and Jeferson Walloway then theirs forever, I give unto my three sons Wm. Nath & Jeferson all my land and swamp held either by deed or patent to be equal divided between them and their heirs forever ---

Item - I leave the use of my mare and young two year old horse and beds and houshold furniture to my beloved wife during her widdowhood then to be equally divided ---

I give to my three sons William Nathan and Jeferson a negro girl called Grace and her increase to be equally divided between them and their heirs forever. I leave my stud horse by the name of Commet to be sold also the shingles that I have in the swamp to be sold to payu my debts and after my just debts be paid the moneythat is left and the debts that is due me to be equally divided between my lawfull heirs, I give unto my brother John Walloway twelve acres and a helf of juniper swamp to be taken out of the fifty acres that I hold up the Norwest Fork near the head to him and his heirs forever ---

I also give unto my brother John Walloway the one half of the swamp I bought from Reuben Cohoon as per deed the one half containing thirty one acres to him and his heirs forever ---

I hereby disannul and disallow all other former Wills Gifts or leases or bequeaths whatsoever heretofore by me made and acknowledging this and no other to be my last Will and Testament ---

I appoint my loving wife Sara Walloway my trusty John Clayton Nathan Walloway my executors my last Will and Testament Signed Sealed Published by the Testator to be my last Will and Testament.
