In the name of God Amen: The eighteenth day of March in the year of our Lord 1780. I Joseph Whedbee of Tyrril County and state of North Carolina being sick and weak in body but of perfect mind and memory thanks be given to Almighty God for the same and calling to mind the mortallity of my body and knowing that it is appointed for all men once to die do make and ordain this my last Will and Testament first of all I desier that all my just debts be paid.

Item - I give and bequeath unto my well beloved wife Mary Whedbee my cubbard with all the crockery ware also one bead & furniture one spruse pine chest one pine table two horses & side saddle the two horses called Brand & Sharrad also all my hogs the old yoak of oxen also the best plow the two best weeding hoes and two grubing hoes also one cart.

Item - I give and bequeath unto my youngest son Sanderson Whedbee my land & plantation known by the name of Chappel land to him and his heirs forever also three cows & calves three ewes five pewter plates one puter Titreen one hand mill also one middle sise iron pot six black Walnut chairs one pair fire tongs and shovel also one gold ring plain I also give to my said son Sanderson Whedbee one negro boy named Lewis and my silver kneebuckels.

Item - I give & bequeath all my wearing apperrel unto my oldest sons Thomas & Joseph Whedbee.

Item - I give and bequeath unto my two sons Thomas Whedbee and Joseph Whedbee the plantation and land whereon I now dwell to be equally devided between my sd. two sons Thomas and Joseph Whedbee the derection the said lands to begin at the Second Branch at the old going over place at Woodly's Island and my Will is that my son Thomas Whedbee have that part which lyeth on the Creek and my son Joseph Whedbee have the back land the said lands I give to them and their heirs forever.

Item - I give and bequeath to my son Thomas Whedbee three cows & calves three ewes my small hunting gun five pewter plates one pewter dish also one pewter bason a mans saddle and a middle sise iron pot and a pair of iron dogs also one negro man named Mingo to him and his heirs forever also my great Bible and my silver stock buckel.

Item - I give and bequeath unto my son Joseph Whedbee one negro boy named Jacob three cows & calves three ewes five pewter plates one pewter dish one pewter bason one middle sise iron pot one iron teakittle and my musket also one large black walnut table and one small Bible.

Item - I give and bequeath to my daughter Lyda Whedbee one bead and furniture three cows & calves three ewes five pewter plates a large pewter dish one pewter bason one iron pot tramel also a black walnut table and six silver teaspoons one gold ring one linen wheel mapolrim one slay and gears No. 45 also one negro gyrl named Patience also one common prayer book & silver soe buckels.

Item - I give and bequeath to my daughter Sarah Whedbee one negro girl named Jenny one gold ring six silver teaspoons marked thus M S one feather bead & furniture three cows & calves three ewes five puter plates one puter dish one pewter bason one iron pot tramel also a linen wheel oakrimd one slay and gears number 27 also one pair of silver soe buckels & one large hackel.

Item - I give and bequeath to my daughter Elizabeth Whedbee one negro boy named Jack one gold ring one feather bead and furniture three cows & claves three ewes five pewter plates one pewter dish one pewter bason one iron pot tramel also one flat rimed linen wheel one slay & gear No. 23 one pair of silver soe buckels carved and one small hackel.

Item - I give and bequeath to my wife Mary Whedbee my loom one wooling wheel and the cards both wool & cotten also all my stocks of bees.

Item - I give and bequeath to my daughter Martha Whedbee one negro boy named Peter one gold stone ring one feather bead and furniture three cows & calves three ewes five pewter plates one pewter dish one pewter bason also one large looking glass one large linen wheel two slays & gears No. 25 & No. 16 also a meddle sise hackel and one heifer.

Item - My will is that all my land which I have not disposed of be equally devided between my two sons Thomas & Joseph Whedbee also I give ten silver dollars to be made into teaspoons at the expence of my Estate the teaspoons to be equally divided between my sons Thomas Joseph and Sanderson also my daughters Elizabeth & Martha Whedbee my Will and desier is that if any of my children should die beofre he or she shall come to age or marred my desier is that my serviving children shall be heirs of that deceased child or childrens Estate and no other person.

Item - I give to Ann Whedbee alias Williams one cow & calf to her and her heirs forever which is all her part of my Estate I likewise lend the use of my land and negros which I have given away in legises to my wife Mary Whedbee to raise my children until they come to age or marry also what corn and meat that is in the house for this years provision for the familys use and the labour of old Easter & young Ester five years from the date of these presents and then to be sold at the discretion of my Executors the residue and remeinind part of my Estate both really & personally which I have not already disposed I leave to be sold at the discretion of my Executors and the money a riseing thereform to go towards schooling my children and overplush if any to be put to intrust with the money that the two negro women old Easter & young Easter may sell for and that the sd. money be equally devided amongst my seven children to wit: Thomas Joseph Sanderson Lyda Sarah Elizabeth & Martha Whedbee as they sahll come to age or marry also I desier that my Executors sell the house & brick that is one the Chappel land and the money arising my will is that my son Sanderson shall have it I shall also constitute make and ordain my wife Mary Whedbee Executrix and Thomas Hoskins Executor of this my last Will and Testament and I do hereby utterly disallow revoke and disanull all and every other former Testaments Wills & leguices Bequeasts and Exons. by me heretofore this time named willed and bequeath rattefying and confirming this and no other to be my last Will and Testament in witness whereof I have hereunto set my hand and seal the day and year above written &c.

Tyrrell County Court of Pleas & Quarter Sessions


July Session 1780

James Parisho appeared in open court and proved on oath the last will and testament of Joseph Whitbee ordered to be recorded.

Mary Whitbee appeared in open court and qualified as extrix and Thos. Hoskins exor to the last will and testament of Joseph Whitbee.

October Session 1783

Ordered that the land belonging to the estate of Sanderson Whidbee deceased orphan of Joseph Whidbee deceased be sold in order to be divided among the surviving heirs and return make to next court.

January Session 1784

Appeared in open court Henry Norman Depy Sheriff and exhibited an account of sales on oath of the estate of a negroe wench called Jenny belonging to the estate of Owen Williams that is 2/3 of {unreadable} & 2/3 to the estate of Joseph Whedbee deceased amounting to 14 pounds & 6 shillings and ordered to be filed.

January Session 1785

Ordered that Thomas Hoskins executor of Joseph Whedbee deceased be cited to appear at our next court to render the accounts of said deceased guardianship of Judith Rhoades.

January Session 1787

Ordered that John Hoskins be appointed guardian to Martha Whidbee orphan of Joseph Whidbee deceased and give bond in 500 pounds - Francis Cummins and John Foster securities.

July Session 1788

Thomas Stewart and Hezekiah Spruill Esquires appointed to audit and inspect and settle the accounts of guardians administrators and administratrix accounts of the deceased estates which is accordingly done as per entrys following to wit - John Hoskins guardian of Martha Whedbee and find a balance due said John Hoskins of 8 pounds, 14 shillings & 1 1/2 pence filed.

January Session 1789

Ordered that William Howett be appointed guardian to Martha Whidbee orphan of Joseph Whidbee deceased and give bond in 500 pounds Abraham Howett and Jeremiah Frasier Esqr. securities.

April Session 1789

Ordered that Abner Alexander administrator of John Hoskins deceased be cited to appear to next court and render an account of the guardianship of the said John Hoskins deceased for the orphan of Joseph Whidbee deceased named Martha Whidbee.

January Session 1793

Ordered that Joseph Whedbee orphan of Joseph Whedbee deceased be bound unto Capt. Frederick Guion for the term of four years & that he learn him the art and mistery of a marriner & to read write & cypher as far as the rule of three.
