In the name of God Amen. Know all men by these presents that I, Eli Woodley of the county of Tyrrell and state of North Carolina, being in sound mind and knowing the uncertainty of human life and being anxious to arrange my affairs during my life do constitute this my last will and testament according to the decrees hereinafter stated.

Item 1st I give to my beloved wife Hester C. Woodley all of my property both personal and real to have & to hold during her lifetime. Then at her death to be divided equally between my children begotten of her.

Item 2nd I do hereby constitute my beloved wife Hester C. Woodley my lawful executrix (to be assisted by my son John L. Woodley) to settle all my lawful debts in any manner that they may find necessary and provide for me a decent burial.

In the Superior Court before the clerk a paper writing purporting to be the last will and testament of Eli Woodley is exhibited be fore me, the undersigned clerk of the Superior Court for said county by Hester C. Woodley the executrix therein mentioned and the due execution thereof by the said Eli Woodley is proven by the oath and examination of S. S. Woodley and Dr W. H. Hardison the subscribing witnesses thereto who being duly sworn, doth depose and say, and each for himself deposes and sayith that he is the subscribing witness to the paper writing now shown to him purporting to be the last will and testament of Eli Woodley that the said Eli Woodley in the presents of these deponents subscribed his name at the end of said paper writing now shown as affor said and which bears date of the 3rd day of August 1893

And the deponents further says that the said Eli Woodley the testator affor said did at the time of subscribing his name as affor said declare the said paper writing so subscribed by him and exhibited to be his last will and testament and these deponents did there uppon subscribe their names at the end of said will as attesting witnesses there to and at the request and in the presents of the said testator. And these deponents further say that at the said time when the said testator subscribed his name to the said last will as affor said and at the time when the deponents subscribed their names as attesting witnesses there to as affor said the said Eli Woodley was of sound mind and memory of full age to execute a will and was not under any restraint to the knowledge, information and belief of these deponents

It is therefore considered and adjudged by the court that the said paper writing and every part thereof is the last will and testament of Eli Woodley deceased and that the same with the fore going examination and this certificate are ordered to be recorded and filed
