I, T. L. Tarkenton of the county of Tyrrell & the state of North Carolina being of sound mind and memory considering the uncertainty of my earthly existence do make declare & publish this my last Will & Testament.
1st. My executors hereinafter named shall give to my body a decent burial suitable with the wishes of my Wife, my friends & relatives. Pay all my funeral expenses together with my Just & honest debts, out of the first money which may come into his hands belonging to my estate.

2nd. I give and devise to my beloved wife Affie Tarkenton all of my Estate of whatever nature or kind. So far as I know now the stock of goods in the store where I now reside, all of my household & kitchen furniture now on hand in my possession, or in the possession of any one for me. (a part of my household & kitchen furniture consisting of one bureau etc. is at James Tarkentons. the remainder except that which is in possession is at my father-in-laws George Batemans.

3rd. I hereby constitute and appoint my trusted friend D. M. Tarkenton and my wife Affie Tarkenton my lawful executors to all intent a& purposes to execute this my last Will & Testament according to the true meaning of the same and every part & clause there of. hereby revoking and declaring utterly void all other wills & Testaments heretofore by me made.

In Witness whereof I the said T. L. Tarkenton do hereto set my hand and affix my seal this the 27th day of January 1909.

In Re estate of
T. L. Tarkenton, deceased} Order for probate of Will

A paper writing purporting to be the last will and Testament of T. L. Tarkenton deceased is exhibited i n open court for probate by D. M. Tarkenton one of the Executors therein named and the due execution thereof by the said T. L. Tarkenton deceased is duly proven by the oath and examination of J. R. Tarkenton & D. M. Tarkenton subscribing Witnesses thereto: and it is further shown to the Satisfaction of the court by Said Witnesses that the said T. L. Tarkenton was, at the time of making said Will. of sound mind & memory. of full age to execute a will and under no restraint to their knowledge, information or belief:|
It is thereupon considered, adjudged & Decreed that Said proof is sufficient and according to law and that the said paper writing is and contains the last will & Testament of T. L. Tarkenton Dec.
And on motion it is ordered that said Will be admitted to probate & record in the book of Wills of Tyrrell County and as such filed as provided by law in the office of the clerk of the Superior Court of said county.
It is further ordered that said D. M. Tarkenton & Affie Tarkenton be allowed to qualify as executors provided by law and enter upon the Discharge of the duties imposed by said trust.

A paper purporting to be the last Will & Testament of T. L. Tarkenton deceased is exhibited before me the undersigned clerk of the Superior Court for said County by D. M. Tarkenton one of the executors therein mentioned. And the due execution thereof by the said T. L. Tarkenton by the oath & examination of J. R. Tarkenton & D.M. Tarkenton the subscribing witness thereto, who being duly sworn doth depose & say, and each for himself deposeth & saith. That he is a subscribing Witness to the paper-writing now shown him purporting to be the last Will and Testament of T. L. Tarkenton; that the said T. L. Tarkenton in the presence of this deponent subscribing his name at the end of said paper-writing which is now shown as aforesaid. And which bears date of this 27th day of January 1909. and his Deponent further saith that the said T. L. Tarkenton the testator aforesaid did at the time of subscribing his name as aforesaid declare the said paper-writing so subscribed by him & exhibited to be his last will and Testament. And his Deponent did there upon subscribed his name at he end of said Will, as an attesting witness thereto and at the request and in the presence of said testator, And his deponent further saith that at the same time when the said testator subscribed his name to the said last Will as aforesaid. And at the time of the deponents subscribing his name as an attesting Witness thereto, as afore-said, the said T. L. Tarkenton was of sound mind & memory. Of Full age to execute a will, and was not under any restraint, to the knowledge, information or belief of this deponent: And further these deponents say not.

It is therefore considered & adjudged by the court that the Said paper-writing & every part thereof is the last Will & Testament of T. L. Tarkenton, deceased. Let the said Will together with the probate be recorded and filed.
