The last Will and Testament of Joseph Tarkenton son of Joseph made the first day of February 1804 -- First and principally I give and recommend my soul unto the Almighty God that gave it and my body to the earth to be buried with a Christian burial at the discretion of my Executors ---

Secondly - I lend to my beloved wife Elizabeth Tarkenton one negro worman by the name of Rachael during her life or widdow hood two cows and calves all my sheep all my hogs two feather beds and furniture all my tables and young mare by the name of Fly with the Marriner Plantation and woodland and body field and all the farming instruments one yoke of oxen with my beaufat and kitchen furniture during her life or widdowhood with the household furniture suxh as chairs and one desk ---

I give and bequeath to my loving daughter one negro girl by the name of Annis one young mare by the name of Spinner two cows and calves one feather bed and furniture one chest to her and her heirs forever.

I give and bequeath to my loving daughter Betsey Tarkenton my daughter of Bethasheba my son Whiting Tarkenton my daughter Matilda Tarkenton and my son William Tarkenton and the child my wife is pregnant with two negro boys the name of Isaac and Freeman to be equally divided amongst them and their heirs forever. I give and bequeath to my loving son Whiting Takenton all that track of land known by the name of the body land one cow feather bed and furniture to him and his heirs forever ---

I give and bequeath to my loving daughter Betsy Tarkenton one feather bed and furniture to her and her heirs forever, I give and bequeath to my loving daughter Bethsheba Tarkenton one cow and one bed and furniture to her and her heirs forever ----

I give and bequeath to my loving daughter Mitilda Tarkenton one ocw and feather bed and furniture to hers her heirs forever, I give and bequeath to my loving son William Tarkenton the Marriner Plantation whereon I live with the woodland thereunto belonging after the death or marriage of my wife one cow calf feather bed and furniture to him and his heirs forever, I give and bequeath to my loving children Betsey Bethsheba Whiting Matilda and William and that my wife is pregnant with is should live one negro woman named Rachael with her increase and all the remains of the property but to my wife to them her heirs after her death or marriage. My will is tht the warehouse and landing field with twenty five acres of Juniper Swamp lying on the East side of Scuppernong river should be sold by my executors to discharge my debts I hereby nominate and appoint my loving brother Zibulon Tarkenton and Ase Phelps executors to this my last Will and Testament whereof I hereunto set my hand and seal the day and date above mentioned.

April Session 1804

Mr. James Ambrose came into open court and proved the last will and testament of Joseph Tarkenton deceased filed.

Capt. Zebulon Tarkenton came into open court and quallified as executor to the last will and testament of Joseph Tarkenton agreeable to law.

October Session 1804

Ordered that Mrs. Elizbeth Tarkinton widow of Joseph Tarkinton deceased be appointed guardian to her six children viz. Elizabeth Tarkinton Barsheby Tarkinton Whiten Tarkinton Matilda Tarkinton William Tarkinton & Lucy Tarkinton and hath given bond in the sum of {blank} Capt. John Batemen & Nathan Ansley securities. {Entire entry crossed out.}

July Session 1806

Ordered that Capt. Zebulon Tarkinton executor of Joseph Tarkinton deceased have leave to sell hire and rent out the negroes and land of the remaing part of the property of the said Joseph Tarkinton and make return to next court.

October Session 1806

Capt. Zebulon Tarkenton returned in court on oath the inventory of the estate of Joseph Tarkenton Junr. deceased also an account of sales to the amount of 81 pounds, 17 shillings & 9 pence.

October Session 1807

Ordered that Zebulon Tarkinton be appointed guardian to the orphans of Joseph Tarkinton Senr. to wit Penny Rhody Prescillar Polly Tarkinton also that the said Zebulon be appointed guardian to the heirs or orphans of Joseph Tarkinton Junr. deceased to wit Betsy Bathsheba Whiting William and hath given bond in the sum of five thousand pounds with Colo. Jesse Alexander and Jeremiah Wynne his securities.

December Session 1809

Ordered that Richard Wood Levi Batman Richard Davis and John Ansley Esqrs. be appointed to audite and settle the accounts of Joseph Tarkinton Senr. and Joseph Tarkinton Junr. with Zebulon Tarkinton.

April Session 1815

The audited accounts of Joseph Tarkinton Junr. was returned into court by Joseph Ansley Esqr.

October Session 1816

Ordered that Zebulon Tarkenton have leave to sell at publick sale the negroes belonging to the estate of Joseph Tarkenton Junr. deceased & the money arising from said sale to be equally divided between the legal representatives.

July Session 1817

Ordered that Richard Wood Joseph Ansley and James Wood Esquires be appointed to divide the estate of Joseph Tarkenton Junr. amonst his lawfull representatives & make return to next term.

April Session 1818

The division of the estate of Joseph Tarkenton Junr. deceased was returned into court by Richd. Wood Esqr. ordered filed.

Guardian bond dated 23 Oct 1804 in an unspecified amount appointing Elizabeth Tarkenton guardian to the six orphans of Joseph Tarkenton deceased, Capt. John Bateman and Nathan Ansley securities. Bond is not signed.

Guardian bond dated 26 Oct 1807 in the amount of 5,000 pounds appointing Zebulon Tarkenton guardian to Betsy Tarkenton Bathsheba Tarkenton Whiting Tarkenton and William Tarkenton orphans of Joseph Tarkenton Junr. deceased, Jesse Alexander and Jeremiah Wynne securities.

Petition in October Term 1807 by Urijah Phelps stating that Joseph Tarkenton Junr. died near four years ago leaving several children and a widow whom he has intermarried with. The widow paid at least 50 pounds for clothing and provisions herself and since 14 May 1806 he has paid for support of the children, for which he believes he is entitled to the further sum of 100 pounds. He further states that Zebulon Tarkenton was appointed executor of the will of Joseph Tarkenton Junr. and is only willing to pay one shilling each for said boarding and schooling of said children for eight or nine months and he is not disposed to pay for anything else, such as nursing in sickness. Petitioner has tried to settle this amicably to no avail.

Division of the estate of Joseph Tarkenton Junr. by Col. Zebulon Tarkenton guardian of the heirs. Includes income from the hire of negroes Freeman Isaac & Rachel from the year 1808 up to the year 1817. Also includes income from the sale of Isaac and Rachel on 1 Sep 1817. Total divided into four parts makes each heirs share 174 pounds & 18 shillings. Account audited in September 1817.

File also contains a number of documents relating to recovery of debt to and by the estate of Joseph Tarkenton Junr.
