In the name of God Amen. I, John Thoroughgood of the state of North Carolina and county of Tyrrell, being of sound mind and memory bless be God do ordain this my last will and testament and first I recomend my sold to God who gave it and my boddy to the earth to be buried in a Christon like manner by my executors who will be hear after named as to what wordly goods it hath pleased God to bless me with in this life I will and dispose of in the following manner

Item the first I give my beloved wife Permelia Thoroughgood the one half of the track of land that I now live on during her natral life and one negro woman named Axey and one young boy by the name of Ned and one boy by the name of Jessey and one by the name of Abel during her natral life or to do and dispose of as she thinks propper for ever furthermore I give her her chosis of my horses for ever and one years a lowans which shall be (remainder of line unreadable)

Item I give unto my daughter Anjelica Thoroughgood the tract of land none by the Howett place to her and her heairs for ever and one track of land none by the name of Cowridge to her and her hears for ever and I give to my daughter Anjelica one negro man none by the name of Ely and one negro woman my father gave me none by the name of Haley and all of her increas but one child by the name of Jane to her and her heairs for ever

Item I give unto my daughter Mary Thoroughgood the plantation where on I now live with that that I bot of Joseph Dowdy all unto the said Mary Thoroughgood and her heares for ever excepting the one half that her mother was be fore given her during life but after Permelia my wifes death to the said Mary Thoroughgood and her lawful heairs for ever

I give unto my daughter Mary Thoroughgood one negro man none by the name Caleb and one negro man by the name of Demps and one negro girl by the name of Aggy and one negro boy by the name of Ted to her and her hears for ever

Item I give to my wife Permelia Thoroughgood one negro boy by the name of Banister and to my daughter Anjelica Thoroughgood one boy by the name of Majic and to my daughter Mary one negro girl by the name of Jane to they and ther lawful heairs for ever

My will and desire is that if my wife should have a child in the time of nine months after that it if a boy should have the plantation where on I know live by ? the the other too children what I gave for the Dowdy place when ether of them comes to the years of maturity or gets married and all the rest of my land except juniper swamp or cipris to be divided between my too daughters thare is fifty acors of land that I bot of Joseph Hassell or rather of Jeramiah Wayn but Joseph Hassell now lives on it and fifty acors that I bot of John Twidy and twenty too that I bot at public sail which was sold by the owner (?) and he has not given me a dead for the same the twenty too acres belonged to John Twidy but was sold at public vandue my will and desire is that boath of them pieces or tracks of land to be sold at twelve months or too years which my executors may think most advantages for the hears and take notes with good surity as the law requires in such cases and the money that shall arise from that my desire is to be equil divided between my too daughters If my wife should have a sun as be fore mentioned but if not to be disposed of as will be here after mentioned If my wife should happen to be prignant and have a daughter my will is that she should have a equil shar with the other too

Item My wishes is that if ether of my children is living should ether of them die be fore they came to the years of maturity or have hears lawful begotten of ther boddys my will is that the living one or ones should hear all the ? property as though they boath or all would if living If my wife is prignant and should bring forth another and it should live it should have a equil of its mothers negros as well as its equil shear of its sisters property all reddy named My will is that if my wife does not stand to this my will that she must only have her third part of the land and that my executors shall rent out the land so that it shall be kept up and in as good order as it was when I lived that only one half shall be ? in indian corn and the other to be soad ? yearly and that half that is planted in corn to be soad in peas as thick as may be thought necesary by my executors hear after named

Item My wishes and will is that all of my swamp or swamps shall be equal divided between my children agreble to quality and quantity and that my children shall be sent to school as soon as they get big enough to learn and if that there is not a good school kept hear that they shall be sent to some good ? or master ? is thought by my executors that they have sufeshant for them agreble to ther standing

Item My will is that all my perishable proppity shal be sold at six months Cr and after paying my debts with the money and the notes that I have on hand shall be equal divided between my wife Permelia Thoroughgood and living children and it shall be kept on interest if any reman after paing their expenses till they come of age or get marred and then each shall have there equal shar at the coming to the age of maturity or marage If they are over seventeen and if they get marred before they are seventeen if a girl they shall not have thir property till they are nineteen years of age if a girl and if a boy till he is twenty one years of age only what is thought necesary for ther rezanable expenses

Whare fore I do do hear appoint my lawful executors to ? and carey on suits as though I was living whare fore I do appoint and name my executors my dear brother Amos Thoroughgood and my brother in law Richard Howett as my lawful executors and do ardain this my last will and testament and revoking all others up to this date whare for I do set my hand and do afix my seal this the 21 day of September 1825

April Session 1826

The will of John Thoroughgood Esqr. was offered in open court for probate but the subscribing witnesses thereto not appearing, it was upon motion of Amos Thoroughgood Esqr. one of the executors thereto, ordered that writs of sulpince (?) issue to the Sheriff of Tyrrell County comanding him to summon Edmd. Alexander John Midyett & James Sivils the subscribing witnesses thereto personally to be and appear at the next County Court then & there to prove the same agreeable to act of assembly in such case made & provided.

July Session 1826

The last will and testament of John Thorogood was duly proven in open court by the oaths of Edmund Alexander & John Midyett two of the subscribing witnesses thereto who swore that at the time of making said will he was of sound disposing mind and memory at the same time Amos Thorogood was duly qualified as executor to the last will and testament of the said deceased.

January Session 1827

An inventory of the notes, judgements, executions & money belonging to the estate of Jno. Thorogood was returned in open court by Amos Thorogood the executor.

January Session 1829

Amos Thoroughgood executor of Jno. Thoroughgood returned an account of the hire of negroes & rent of land of said estate for the year 1829.

January Session 1830

Amos Thoroughgood executor of Jno. returned an account of the hire of the negroes of Jno. Thoroughgood for the year 1830.

October Session 1830

Ordered that Eph. Mann H. G. Spruill & Edmon Alexander audite & settle the estate of John Thoroughgood with his executor Amos Thoroughgood & report to next term.

January Session 1831

Ordered that Eph. Mann, Hezekiah G. Spruill & Jos. Midget audite & settle the estate of John Thoroughgood with Amos Thoroughgood his executor.

The account of the hire of the negroes of Jno. Thoroughgood for the years 1830 & 1831 was proved by the oath of Hez. G. Spruill.

January Session 1832

Ordered that Amos Thoroughgood guardian to Ann orphan of Jno. Thoroughgood be allowed ninety six dollars for two years board & clothing and also the same sum for Mary orphan as aforesaid for the same time.

January Session 1833

Amos Thoroughgood guardian to Jno. Thoroughgood's heirs returned the hire for 1833.

April Session 1834

Amos Thoroughgood guardian of Jno. Thoroughgood heirs returned the account of hire for 1833 & guardian account.

There are numerous promissory notes, warrants, summons, judgements and executions in this estate file. All deal with recovering debts to the estate and span the time from before John Thoroughgood's death to 1834. None appear to have any genealogical significance.
