In the name of God Amen I Thomas Sykes of the county aforesaid being of sound mind and memory thanks be to God for the same calling to mind the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this to be my last will and testament in manner and form following I leave my to be interred at the discretion of my executors in a decent manner
Imprimis
It is my will and desire that all my property both real and personal shall remain in the possession of my wife Mary during her natural life or widdowhood for maintaing and educating my children its also my wish that my half of the schooner Younger Son shall be sold upon a credit of six months and the money accruing therefrom to go to the extinguisment of my just debts
I hereby constitute and appoint Timothy Jones Sen. and my wife Mary my executors to this my last will & testament authorising my said executors to dispose of my negro boy Isaac for misconduct and the money arising therefrom to be laid out for another hereby confirming this to be my only will signed with my seal and dated this 20 day of June anno domini 1824

July Session 1824

The last will and testament of Thomas Sikes was exhibited in open court and proven by the oath of John Beasly who swore that he saw the other subscribing witness sign the same as a witness and that he was present when the will was executed by Thomas Sikes.

April Session 1826

Ordered that John B. Beasley, David Clayton & Joseph White be appointed auditors to settle the estate of Thomas Sykes deceased with the executor Timothy Jones and make report to the next term.

Summons issued 27 Oct 1824 for Timothy Jones Sr. executor of Thomas Sikes deceased to appear at court on the fourth Monday of January next to answer unto Thomas Trotter executor of Henry Norman deceased of a plea that he render unto him negro man Isaac of a value of six hundred dollars which from him he unjustly detains to his damage two hundred dollars.

Summons 26 Apr 1825 for Jno. Marriner, Danl. N. Bateman & John B. Beasley to appear at the court now sitting on the fourth Monday in April 1825 to testify on behalf of the plaintiff in a suit in which Thomas Trotter executor of Henry Norman is plaintiff and Timothy Jones executor of Thomas Sykes is defendant.

Subsequent documents show that the case was tried in April Term 1825 and the defendant prevailed. Plainfiff appealed to the Superior Court where it was scheduled to be tried in September 1825. There are no documents that indicate who prevailed in the Superior Court, but it appears to have continued for some time.

Warrant issued 3 Sep 1833 for John Haughton to appear at court on the 4th Monday in October next to answer unto Benjamin Sikes, Jesse Sikes by guardian John B. Beasley, Thompson Liverman & wife Louisa, Robert Linton & wife Hannah, Lemuel Basnight & wife Mary, John Owens & wife Sarah, David Cooper & wife Phoebe and Benjamin, Mary, Amanda, Caroline & Eliza Sikes by their next friend Benjamin Sikes of a plea of trespass vi it armis to their damage & three thousand dollars.

Tyrrell County marriage bonds show the marriage of Thomas Sikes to Mary Bateman on 3 Mar 1814, Danl. Bateman security.

See the will of John Sikes in 1826 for further information. The children Benjamin, Mary, Amanda, Caroline & Eliza Sikes mentioned in the warrant above from the estate file of Abel Sikes appear to be children of Thomas Sikes. All plaintiffs mentioned in the warrant, plus Abel who died circa 1818 and left children Jesse and Louisa, are John's sons and daughters.
