In the name of God Amen: I Jesse Swain of the County of Tyrrell & State of North Carolina being of sound disposing mind, do make and ordain this to be my last will and testament in the manner and form followes Viz.

Item - I give and bequeath to my two sons Uriah & Timothy my lands estate to be divided among them as follows, the ditch that runs across my land from the branch to Joshua Swains line, to be the dividing line, The western and Norther part including the buildings to my son Timothy & the Souther & center part to my son Uriah ---

Item 2 - I give and bequeath to my two sons one bead and furniture - 1 cow and calf & five hogs each ---

Item 3 - I give and bequeath to my five daughters Mary, Abigail, Nancy, Patsey and Frebie one bead and furniture each & one cow and calf each ---

Item 4 - I give and bequeath all my other property to my beloved wife Frebie Swain during her natural life and at her death, I give it to all my daughters to be equally divided among them ---

Item - I do hereby nominate, constitute & appoint my beloved wife Frebie my lawful executrix.

In testimony whereof I have hereunto affixd my hand and seal this 1 day of October 1833 ---

October Session 1833

The last will and testament of Jesse Swain was exhibited in open court and the due execution of it proved by the oath of Hy. E. Lewis and Hz. G. Spruill at the same time came Ferebe Swain and qualified as executor thereto - Ferebe Swain executrix of Jesse Swain returned into court an inventory of her husband's estate.

April Session 1842

Ordered that Uriah Swain administer on the estate of Jesse Swain deceased and enter into a bond of five thousand dollars with Jonathan Tweedy & Jeremiah Weskett securities.

Ordered that the administration on the estate of Jesse Swain granted to Uriah Swain be set aside and that he have leave to withdraw his bond.

Ordered that administration on the estate of Jesse Swain be committed to Jesse Hassell and that he enter into bond of five thousand dollars with Thomas L. Hassell & Richard D. Hassell securities.

October Session 1842

Ordered that Benjamin Spruill be appointed guardian to Ferebee Swain and that he enter into a bond of two thousand dollars with T. B. Midyett & John McClees securities.

Bond dated 3 Feb 1842 in the amount of one thousand dollars appointing Jesse Hassell administrator de bonis non with the will annexed of the estate of Jesse Swain deceased, S. S. Simmons, T. L. Hassell & Henry Norman securities.

Petition April Term 1842 of Jesse Hassell and wife Mary Abigail Swain Nancy Swain all of lawful age Patsy & Ferebee Swain are legatees under the will of Jesse Swain your petitioners state that Patsy & Ferebee Swain are under age of twenty one to whom petitioners pray a guardian be appointed petitioners state that Jesse Swain died possessed of seven negros and one born since and by his will gave all the balance of his estate to be divided among his daughters upon the death of his wife petitioners pray an order to divide the said negroes.

Division of the negros of Jesse Swain among his five daughters on 21 May 1842 by Jos. Halsey, S. S. Simmons & Jeremiah Weskett:
Jesse Hassell and wife Mary draw Orpha and child Lovina valued at $450.
Patsy Swain draws Maranda and child Ephrus (?) valued at $500.

Ferebee Swain draws girl Eliza valued at $225.
Nancy Swain draws girl Catharine valued at $200.
Abigail Swain draws boys Allen & Tom valued at $275.
With $330 being the share of each daughter, Jesse Hassell and wife Mary owe Ferebee Swain $105; Jesse Hassell and wife pay $15 and Patsy Swain pays $115 to Nancy Swain; and Patsy Swain pays Abigail Swain $55.

Bond dated 25 Oct 1842 in the amount of two thousand dollars appointing Benjamin Spruill guardian to Ferebee Swain orphan of Jesse Swain deceased, Thomas B. Midyett & John McClees securities.
