In the name of God Amen I Jeremiah Swain of the state of North Carlina Tyrel county who am weak and sick in body but of perfect mind and understanding thank be to God for that blessing and I do call to mind that it is appointed for all men once to die and after that to come to judgment wherefore I recommend my soul to God who gave it and my body to the discresion of my executors to be buried in a cristain like manner and as with what worldly good it hath been please God to bless me with in this life I do will and dispose of in the following manner - - -

Item first I lend to my well beloved wife Rachel Swain the use of fifty acres of land during her naturel life or until she maries which land John Swain bought of Whitley Long on the south side of Alagater Creek and also I lend her one hundred acres of of juniper swamp joyning the above mentioned land to her in the above mentioned manner and also all the movable property that she had when I maried her and also one horse and also cow and calf named whiteface to her own roper use and disposal

Item I gave and bequeath to my daughter Ester Swain the fifty acres of land that I lent to my wife at her death or marige to her and her heirs forever and also the hundred acres of swamp at the dearth or marage of my wife to be sold according to law for use of my child and also one bed and furnerture one chest and two cows and calvs with their increas and twelve hives of beas with their increase and also one mill to her and her heirs for ever and I do hearby appoint my wife Rachel Swain and my brother Nathaniel Swain my lawful executors of this my last will and testement disanuling all other wills in witness whereof I have hereunto fixt my hand and seal this twenty fifth day of July one thousand seven hundred and ninety one

Personally appeared in court Paul Thoroughgood and made oath on the Holy Evangelist of almighty God, that he saw and heard Jeremiah Swain within named, sign, seal, publish, pronounce & declare the within instrument of writing to be his last will & testament and at that time he was of sound, disposing mind & memory & at the same time he saw Ann Swain & Lydia Battan subscribing witnesses make their marks thereunto & further saith not

April Session 1803

Ordered that Joseph Ansley be appointed guardian Esther Swain orphan of Jeremiah Swain and hath entered into bond in the sum of eight hundred pounds John Wynne & James Ambrose securities.

Tyrrell County marriage bonds show the marriage of Jerry Swain (son of John) to Rachel Anderson on 22 Dec 1788, Randle Johnston security;also the marriage of James Anderson to Rachel Johnson on 22 Dec 1778, Jos. Spruill security. James Anderson died about 1787 leaving a wife, Rachel.
