September Session 1764

Administration upon the estate of Martha Swain on motion of J. Charlton is commited to Stephen Swain he giving security in the sum of one hundred & fifty pounds which securitys are James Swain & Isaac Hassell.

On motion of J. Charlton for an order of sales of the estate of the sd. Martha Swain ordered that the administrator Stephen Swain sell the estate at publick vandue & return an account to next court.

December Session 1764

Isaac Hassell exhibited an acct. of sales of the estate of Martha Swain amounting to the sum of 116 pounds, & 12 shillings & proved the same on his oath ordered filed.

Stephen Swain exhibited an inventory of the estate of Martha Swain & proved the same on his oath.

June Session 1765

It is ordered that Capt. Joseph Spruill, Jos. Spruill Esqr. & William Houston or any two of them devide the estate of Martha Swain deceased & make due return to our next court.

Stephen Swain exhibited his account against the estate of Martha Swain deceased amounting to the sum of 6 pounds, and 17 shillings proved the same on his oath; ordered allowed and filed.

September Session 1765

Joseph Spruill exhibited a division of the estate of Martha Swain & proved the same upon his oath ordered filed and recorded.

Division of the estate of Martha Swain deceased on 17 Aug 1765 By Joseph Spruill Senr. & Joseph Spruill Junr. To the following nine heirs in equal parts:
The heirs of Joanna Mackey
The heirs of Jeremiah Swaine
The heirs of John Swain
The heirs of Elizabeth Hooker
James Swain
The heirs of Susana Rhoads
Rosanna Hooker
Stephen Swain
Mary Swain


Transcriber's Notes:
Tyrrell County marriage bonds show the marriage of Elizabeth Mary Swain to Jno. Hooker on 4 Jun 1746, William Downing security; also the marriage of Stephen Swain to Ann Spruill on 26 May 1760, Joseph Spruill Jr. & Hezekiah Spruill securities.
The will of Stephen Hooker in 1766 shows Rosannah Hooker as his wife and executrix. There is a marriage bond dated 26 Sep 1767 for the marriage of Rosennah Hooker (widow) to Benjamin Spruill with John Phelps as security.
Reference to the will of John Swain in 1749 will show that Martha Swain was his daughter and the heirs listed in the division of her estate were her siblings.
Reference to the will of Mary Swain in 1771 will show that she was the wife of John Swain and the mother of his children.
