I Thomas Stewart of the county of Tyrrell and state of North Carolina, being at this time of sound mind & memory - do make & ordain this to be my last will and testament hereby revoking and disanulling all other wills heretofore by me made - Imprimis, it is my will & desire that my wife have the use of the plantation whereon I now live together with the use of the negroes, stock of cattle, hoggs, horses, plantation tools & household furniture for and during her natural life and after her decease I give and bequeath the aforesaid tract of land together with the stock of cattle & household furniture to my brother William Stewart in North Britain to him and his heirs for ever. Item I give & bequeath to my sister Jean Stewart of North Britain five hundred dollars to be raised out of the debts now due me or which may be due at my decease & should there not be sufficient for that purpose & to pay my debts, it is my will and desire that it may be raised out of my land in Montgomery County for which purpose I do hereby empower my executors hereafter named to sell and dispose of the same for the best price & they or the (?) of them to convey the same to the purchasers - Item I give to my brothers son Thomas Stewart of Martin County the moiety which I hold of the land & grist mill on Walshes Creek together with all the land lying from Dwights Old Bridge over the creek thence along Dwights Old Road to the Bath Road, thence along the Bath Road to the Beaver Dam Swamp where the road crosses the same, thence down the Beaver Dam Swamp to the mouth on Welshes Creek, thence up the creek to Dwight Road the first station, to the said Thomas Stewart (son of my brother John Stewart of Martin County) to him and his heirs for ever - Item I give & bequeath to the sons of my deceased sister Jeanit Stephenson or Stevenson in North Britain one thousand acres of land as tenants in common, to be bounded by Dwights Road & Bath Road & the creek & to run up the road for complement - to the sons of my said sister Jeanit Stevenson to them and their heirs forever - Item I give & bequeath to my aforesaid brother William the land lying opposite my house being part of an island bounded as by deed from Richard Huff Esq. to him and his heirs for ever - Item I further give to my brother William four negroes to wit: Jack, Julia, Nanny & Jeany after the decease of my wife to him & his heirs for ever - I give & bequeath to Thomas Cochran Esqr. of Glasgow five hundred acres of land (adjoining the land giving above to my nephews the Stevensons) in consideration of some money which he paid for me to a merchant in Glasgow to him the said Thomas Cochran and his heirs for ever - Item I give and bequeath to my brother John Stewart all the debts due to the firm of Thomas & John Stewart he paying all the demands against said company - Item I give to John Stewart son of my brother John in Martin County all the lands belonging to the great tract on Welshes Creek not already given away, to him & his heirs for ever - I give to my brother John Stewart all the land taken in the name of Thomas & John Stewart (excepting the mill on Welshes Creek bequeathed to your son Thomas) to him & his heirs for ever - I give to my said brother John Stewart my water lott in the town of Plymouth, together with about twenty acres of land adjoining said town purchased of Arthur Rhodes, to him & his heirs forever - I also give to my brother John all the lands which I have in Magomery County after raising five hundred silver dollars for my sister Jean, to him & his heirs for ever - I give to Mrs. Sarah Long wife of Gabrial Long for the use of her daughter Ann Long fifty pounds to buy her a negroe girl - Item I give to Mrs. Sarah Long all my lands in Halifax County to her & her heirs for ever - Item I give my brother William Stewart a lot in the town of Plymouth No. ? to him & his heirs for ever - Item I give to my sister Jean a lot in the said town No. ? to her and her heirs for ever - Item I give to Thomas Stewart son of my brother John a lott in said town No. ? to him & his heirs for ever - Item I give to John Stewart son of my brother John a lott in said town No. ? to him & his heirs for ever - Item I give to each of my brothers daughters Polly, Nancy & Penelopy fifty pounds to buy them a negroe girl each, and also I give each of them a lott in the new town of Plymouth to Polly No ? to Nancy No. ? & to Penny No. ? to them & their heirs for ever - Item I give to Miss Lydia Carkeet a lot in the said town No. ? to her and her heirs for ever - Item I give to my nephews, sons of my sister Jeanit wife of Mr. Matthew Stevenson decd. the remainder of my lotts in the town of Plymouth not as joint tenants but as tenants in common to them & their heirs for ever - Item I give my brother John all my books - Item I give to John Stewart son of my brother John a small silver mounted fowling piece - It is my will that my land on the Ashley River in South Carolina which I purchased of Capt. Adam Boutwell be sold by my executors or the survivors of them which I empower them to do & the money arising from the sale to be apply'd toward the discharge of my debts - It is my desire that twelve months credit may be given to my debtors provided they give bond with appropriate security on interest to my executors - all the remainder of my estate not given away after my debts are paid I give to my brother John who together with my brother William, Gabrial Long & William McKinzee Esq. I do hereby constitute, nominate and appoint my executors to this my last will and testament wrote with my own hand this twenty fourth day of June in the year of our Lord one thousand & eighty eight.

John Stewart Esq. exhibited into court the above instrument of writing as the last will & testament of his brother Thomas Stewart decd. and the hand writing of the said Thomas Stewart decd. was proved by the oath of Robert Davison, Martin R. Byrd and Thomas Mackey to the best of their knowledge and belief and further saith not -

Execution dated 26 Oct 1792 and issued 8 Jan 1793 against the goods & chattels, lands & tenements of Thomas Stewart deceased in the hands of his executor John Stewart for 19 pounds, 12 shillings, 1 pence & 3 farthings for fees in the suit Thomas Stewart versus William Fagan abated by the death of the plaintiff.

Execution dated 31 Jan 1793 and issued 7 Mar 1793 against the goods & chattels, lands & tenements of Thomas Stewart deceased in the hands of his executor John Stewart for 8 pounds, 7 shillings & 6 pence for fees in the suit Thomas Stewart versus William Fagan.
