In the name of God Amen - I Thomas Stubbs of the sate of No. Carolina & county of Tyrrell, being of sound disposing mind & memory thanks to almighty God do this sixteenth day of December 1795 make & ordain this my last will and testament in manner & form following

Imprimis I lend unto my beloved wife Margaret Stubbs during her natural life one negroe man Henry & one featherbed & furniture, & at her decease, I give said negroe man Henry to Peggy Jones & Friley Jones children of my beloved wife & the featherbed & furniture I give to my son John Stubbs, to them & their heirs for ever

Item I give unto my beloved wife her choice of my beds & furniture & one mare named Dart & one thousand weight of pork & twenty five barrells of corn, & I lend her during her natural life or widowhood the one half of all my household & kitchen furniture & plantation utinsells except the beds, & at her decease or marriage I give all the property lent to my said wife in this clause to be equally divided amonst my children

Item I give unto my beloved son Thomas Stubbs the land I bought of John Goelet on the west side of Kendricks Creek containing one hundred & seven acres more or less & ten pounds currency to him & his heirs and assigns for ever

Item I will my half of one hundred acres of land that is between me & Caleb Bembridge may be sold by my executors for twelve months credit & the money arising from the sale of said land I give unto my son John Stubbs to him & his heirs for ever

Item I lend unto my beloved wife during her natural life two cows & calves & at her decease I give them and their increase amongst my five youngest children, & I give unto my said wife all the fat that comes from one thousand weight of pork & twenty bushells of cow peas & one toss (?) & one blade stack of fodder, & two sows & six year olds

Item I give unto my beloved son Thomas Stubbs fifty acres of land on the west side of Kendricks Creek that I bought of Nathan Rhoads to him & his heirs for ever - - & I give unto my son Thomas Stubbs one negroe boy named Dick to him & his heirs for ever -

Item I give unto my two beloved sons Archibald & John Stubbs, all the rest of my lands not already given to be equally divided between them when my son Archibald arrives to the age of twenty one years to be rented & managed at the discretion of my executors for their benefit to them & their heirs for ever

Item I give unto my beloved daughter Anna Stubbs twenty silver dollars

Item I give unto my son John Stubbs twenty silver dollars & all my waring apparell except one coat which I give unto my son Archibald

Item I give unto my beloved children (to wit) Anna Stubbs, Archibald Stubbs, Sarah Stubbs, Elizabeth Stubbs & John Stubbs one feather bed & furniture a piece, to be taken care of for them by my executors & friends & delivered to them as they come of age or marry

Item I give unto Anna Stubbs, Archibald Stubbs, Sarah Stubbs, Elizabeth Stubbs & John Stubbs my sons and daughters all the remainder part of my negroe slaves & all other property of every kind whatsoever not already given or otherways disposed of to be equally divided amongst them, the negroe slaves not to be divided untill one of them marrys or comes of age -

Lastly I nominate constitute & appoint my brother William Stubbs, & my son Thomas Stubbs, & my friend Edmond Blount whole & sole executors of this my last will & testament ratifying & confirming this & no other as my last will & testament the day & year first above written - -

Stubbs, Thomas, 1798


This file contains a number of executions against Martin R. Byrd & Wiliam Fagan and against Zebulon Tarkenton & Joseph Tarkenton who owed debts to the estate of Thomas Stubbs deceased. These executions were issued in 1798 and 1799. There is otherwise nothing of genealgical significance.


(TRANSCRIBER'S NOTES: This appears to be a second marriage for both Thomas Stubbs and Margaret Stubbs; Tyrrell marriage bonds have Thomas Stubbs marrying Margaret Jones with bond dated 4 Feb 1793 and Christopher Duckett security; Margaret's earlier marriage appears to be Friley Jones marrying Margaret Currell with bond dated 23 Sep 1763 with Edmund Blount as security; Thomas' earlier marriage appears to be Thomas Stubbs Jr. marrying Hannah Swinson with bond dated 8 Dec 1774 (?) with Archibald Corrie security. Further proof of the Stubbs children in this will being children of Hannah Swinson can be found in the will of Anne Burns.)
