In the name of God Amen the twenty fifth day of September in the year of our Lord seventeen hundred & ninety three I Everett Stubbs of North Carolina in the county of Tyrrell planter, being very sick & weak in body but of perect mind and memory, thanks be unto God for the same, and calling to mind the mortality of my body, and knowing that it is apointed for all men once to die do make & ordain this my last will and testament, that is to say principally and first of all I give and recomend my soul into the hands of God that gave it, and as concerning my body, I recommend it to the earth to be buried in a decent manner, at the discretion of my executors not doubting but at the General Resurrection, to obtain everlasting happiness in the life to come, through the might and mediation of my blessed redeemer Jesus Christ and as touching such worldly estate wherewith it hath pleased God to bless me in this life, I give devise and dispose of the same in manner and form following; that is to say - - - -

In the first place I give and bequeath to Elizabeth my dearly beloved wife all the ducks, turkeys, geese & fowls belonging to the plantation where on I now live to dispose of as she thinks proper - I also lend to my sd. wife during her natural life my plantation and lands with the improvements thereon also my negro man Bob, my wench Betty one feather bed & furniture, one desk one table, half a dozn. chairs one dozn. plates one dozn. cups and sausers, half a dozn. knives and forks, all the kitchen furniture, two w??ding plows one barr plow, three axes three saws, one horse cart & gear one saddle & bridle, two iron wedges, one loom (?) with battles, one great & one small wheal, one loome & furniture there unto belonging, one hand mill, sixty bls. corn one horse Robin one mair Jan???? (the both she ????? to be disposed on here after) four cows & four calves, her share (?) of one quarter part of my hoggs, six ???ding yews, half my fodder the whole of the ????? & ??t?n, a looking glass, all of my books, six bushells salt, one hand saw in the above plantation land & holdings after the decease of my wife Elizabeth to be equally divided betwixt my three sons Jesse, Aaron & Abner the remainder of the property lent to my wife Eliza to be equally divided amongst my children viz Mary, Jesse, Sally, Aaron, Zilphia, Elizabeth, Lowis (?) & Abner after her decease - - - -

Item I give and bequeath to my son Jesse Stubbs all the property that he has heretofore received from me, & after my wifes decease his proportion of my plantation & lands as before mentioned -

Item I give & bequeath to my son Aaron all the property that he has heretofore received from me also my largest gun, & after my wifes decease his proportion of my plantation & lands as before mentioned - - -

Item I give and bequeath to my son Abner the coalt that the Jan???? mare now carries, one bed & furniture fourteen hoggs now in his own mark, one cow and calf and after my wifes decease his proportion of my plantation & lands as before mentioned - one little gun - - -

Item I give & bequeath to my daughter Mary all the property that she has heretofore received, and after my wifes death her proportion of the property lent my sd. wife the land & plantation excepted as before mentioned - -

Item I give & bequeath to my daughter Sally all the property that she has heretofore received, & after my wifes death her proportion of the property lent my sd. wife the land & plantation excepted as before mentioned - -

Item I give & bequeath to my daughter Zilphia nine cattle that she now calls her own, one feather bed & furniture, one wheal, and after my wifes death her proportion of the property lent my sd. wife the land & plantation excepted as before mentioned - -

Item I give & bequeath to my daughter Elizabeth one bed & furniture one cow & calf one wheal and after my wifes death her proportion of the property lent my sd. wife the land & plantation excepted as before mentioned - -

Item I give & bequeath to my daughter Lois one cow & calf, one bed & furniture and after my wifes death her proportion of the property lent my sd. wife the land & plantation excepted as before mentioned - -

Item It is my further will & pleasure that all my property not heretofore disposed of be sold, and after all my just debts are paid the remainder to be equally divided amongst my children viz Mary, Jesse, Sally, Aaron, Zilphia, Elizabeth, Lois & Abner - and I hereby revoke and disannull all and every other former testament wills & legacies, bequests and executors - and that I now appoint & constitute my beloved son in law William Fagan my beloved sons Jesse & Aaron Stubbs my executors to this my last will & testament - In witness where of I have hereunto set my hand and seal this twenty fifth day day of Sept. in the year of our Lord one thousand seven hundred & ninety three and seventeenth of American independency -

Account of Robert Cushing for the estate of Everett Stubbs deceased sworn to before Robt. Davison on 3 Dec 1793.

Complaint dated 15 Jan 1795 of Robert Cushing that William Fagan, factor of Everett Stubbs deceased owes the estate 20 pounds. Judgement entered against William Fagan in the amount of 10 pounds & 15 shillings on 8 Feb 1795 and the defendant appeals with John Garrett as security.
