Testimony taken 20 Jul 1831 from James A. Spruill in a case between Zeb Tarkenton to the use of Nancy Spruill guardian to Jas. S. Spruill vs. Daniel N. Bateman. James A. Spruill deposeth that some time after the marriage of Nancy Spruill the present plaintiff with Joshua Spruill her second husband he saw him pass to Holeway Armstrong a note of about thirty dollars payable to the administrator of Selby Spruill. The deponent further saith that Selby Spruill left two children at his death one an infant of nine months & the other in his fourth year and that he left no productive estate for a maintenance and that he supposes the annual expense of those children was at least forty dollars each per year. The deponent further says that a few days before the marriage of the plaintiff with Joshua Spruill she saw her take about seventeen dollars and give to the said Joshua Spruill to buy clothing for her. The witness being examined by the defendant states that two years ago last March the plaintiff Nancy Spruill suffered a negro girl of the estate of Joshua Spruill sold by a constable at the instance of Hezekiah & Uriah Spruill for the sum of eighteen dollars & by bid off by the deponent at the request of the said Nancy Spruill as she stated for the benefit of her children & that she in a short time sold the same negro for two hundred dollars. Further the deponent saith not.

Undated report of Joseph Halsey on the suit Zeb Tarkenton to the use of Nancy Spruill guardian to Jas. S. Spruill vs. Daniel N. Bateman. Selby Spruill for the benefit of whose children this suit is brought, died in the last of the year 1816. Nancy Spruill the widow and the present plaintiff administered on his estate and on 6 Jan 1819 the estate of Selby Spruill was settled with his administrator and a balance reported due the children (two in number) of $326.30. On the tenth of the same month (January) Nancy Spruill was duly appointed guardian to Jas. & Franklin Spruill the children of the said Selby Spruill and on the 14th she intermarried with Joshua Spruill and Joshua Spruill took upon himself the guardianship of the before named children at April Term of Tyrrell County Court in 1822, upon which bond this suit is brought.
It is in evidence that Joshua Spruill received of the debts due the estate of Selby Spruill to the amount of $114.87 interest included. It is further in evidence that Selby Spruill left two infant children without any productive estate for their maintenance and the annual expense of those children was forty dollars each. Estimate, admitting the defendant liable for the whole amount as due the children of Selby Spruill agreeable to the report of the auditors, it does amount after deducting the charges to only $52.52 to divide between the two children.

Division of the negroes belonging to the heirs of Selby Spruill deceased on 19 Mar 1835. To Nancy Spruill former widow of Selby Spruill & late widow of Joshua Spruill deceased & Mary E. Spruill & William Nelson Spruill heirs of Joshua Spruill deceased Mahala and child Joe. To Franklin Spruill son of Selby Spruill deceased girls Annis & Rachel. To James S. Spruill negroes Tom & Caroline. Each lot of negroes valued at $500.
