In the name of God Amen this first day of October in the year of our Lord one thousand eight hundred and seventeen I Esther Spruill of the county of Tyrrell and state of North Carolina being sick in body but of a sound and perfect memory thanks be to almighty God calling to mind the uncertain state of this transatory life and that all flesh must yield unto death when it may please God to call do make constitute ordain & declare this to be my last will and testament and none other revoaking and annulling by these presents all and every other will or wills by me made either by word or writing and this only is to be taken for my last will and testament and none other and first of all I recommend my soul unto almighty God when ever it may be his good pleasure to call and my body to be buried in a Christian like manner by my executor here after named and my temporal estate that it hath please God to bestow on me I give & dispose of in the following manner to wit

Item I give and bequeath unto my well beloved son Zebulon Spruill his heirs and assigns for ever one moeity or half part of negro boy Harman after the death of my father John Tarkinton pensour (?).

Item I lend unto my well beloved daughter Peninnah McKimmy dureing her natural life one moeity or half part of negro boy Harman after the death of my father John Tarkinton and after the death of my daughter Peninnah McKimmy I give and bequeath the said moeity or half part of negro Harman to her children and if no children then to the children of Zebulon Spruill and Esther Swain their heirs & assigns for ever - -

Item I lend unto my well beloved daughter Esther Swain dureing her natural life one negro girl named Becka and after her death I give and bequeath negro girl Becka to Esther children but if no children then to be equally divided amongst the children of Zebulon Spruill & Peninnah McKimmy their heirs and assigns for ever

Item I give & bequeath unto my well beloved daughter Esther Swain one bed and furneture to her & heirs for ever

Item I do hereby appoint my well beloved son Zebulon Spruill executor to this my last will and testament as witness my hand and seal day and date first written

The last will and testament of Easter Spruill deceased was exhibited in open court & proved by the oath of Robert Wynn Esquire and ordered recorded.

Zebulon Spruill came into court and qualified executor to the last will and testament of Easter Spruill deceased.


(TRANSCRIBER'S NOTES: Tyrrell County marriage bonds have an Esther Spruill marrying Isaiah Swain with bond dated 4 Jan 1812 and Nathan Ansley Jr. as security; Joseph McKimmy marrying Penny Spruill with bond dated 30 Jun 1814 and Merrette Taft as security.)
