In the name of God amen: The twenty fifth day of May in the year of our Lord one thousand seven hundred and sixty five I Samuel Spruill Senr of Bartie and Tyrrel Countys in North Carolina being well in body and in perfict mind and memory thanks be given to God for the same and calling to mind the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this my last Will and Testament that is to say principally and first of all I give and recommend my sole into the hands of God and my body I recommend to the Earth to be buried in a decent Christain buriel at the duretion of my Executors nothing doubting but at the General Resurrection I shall receive the same by the mighty power of Allmighty God and as touching such worldly Estate wherewith it hath pleased God to bless me in this life I give and dispose of the same in following manner and form.

Item - I give and bequeath unto my beloved wife Elizabeth Spruill one negro wench caled Cloe and all the cattele in Bartie to geather with twenty seven head of hogs big and little as they come and the house furniture that she had when I was married to her and I lend to her Jean Mol Dick and Seasor during her ife or widdowhood ---

Item - I give unto my beloved son Samuel Spruill the plantation that was formerly Culbert Phelpes upon the Creek togeather with one hundred and fifty acres of old pattent land beginning at the head of the deep branch where Samuel Alexanders line began runing to the road upward to the first branch thence along the road to William Jennets line and along that line to the corner tree also I give to my son Samuel Spruill eighty two acres of land at the Cyprus branch also I give to my said son Samuel Spruill one hundred and twenty five acres of land on the south side Alegator Lake the part next to the river new pattent land to him and his heirs and assigns forever.

Item - I give to my son John Spruill the plantation up great Alegator and the land thereunto belonging and also one hundred and twenty five acres of land at the lake joying his brothers Samuel Spruills land also the stock up Great Alegator to him his heirs and assigns forever ---

Item - I give to my son Joseph Spruill whereon Samuel Alexander lived together with the land thereunto belonging beginning at the head of the Deep Branch and along the branch down to the Creek westerly and southerdly the various windings of the swamp to the branch next to the clearing then alonge the road to the road that goes to Joshua Phelpes and along that road to the line containing on hundred acres of land old pattent and fifty acres new pattent land also two hundred and twenty acres of land up Alegator Lake on the north side to him his heirs and assigns forever.

Item - I give to my son Steven Spruill the plantation known by the name of the Clearing with two hundred and fifty acres of land & fifty acres old pattent land and two hundred and fifty new pattent land thereunto belonging and one hundred and five acres of land joyning his Brothers John Spruill at the lake to him his heirs and assigns forever.

Item - I give to my beloved son Simeon Spruill the manner plantation whereon I did live with two hundred acres old pattent land and one hundred acres new patent land to him his heirs and assigns forever also I give to my son Samuel Spruill one half of the still that he bought for his father and the other half I give unto Simeon Spruill to them their heirs and asigns forever.

Item - I give unto James the son of Mary Dillon also one hundred acres of land known by the name of the Dogwood thickett at the South land.

Item - I leave my negroes to be divided amoungst my children when Simeon Spruill comes to the age of twenty one years as equally as possable they can and when they come to the age of twenty one years my Executors or any three freeholders to let them have som part thereof of the negros for to help them until the divission aforesaid and am equal part of my stock between Samuel Spruill Joseph Spruill Steven Spruill and Simeon Spruill at the manner plantation and at other places that is mine Great Alegator stock excepted and that to John Spuill afore mentioned and as for my houshold goods to be equaly divided between Samuel Spruill John Spruill Steven Spruill Joseph and Simeon Spruill when they come to the age of twenty one years after the division then I give my negros according as they are divided to them and the ars of their body lawfully begotten forever and I do constitute make and ordain my brother Joseph Spruill and my two sons Samuel Spruill and John Spruill Executors of this my last Will and Testament and I do hereby disannul revoak and disallow all other Testaments Wills Lagacies Bequeaths and Executors by me in any ways named Willed and Bequeathed retifying and confirming this and no other to be my last Will and Testament In witness whereof I the said Samuel Spruill Senr have hereunto set my hand and seal the day and year first above written.

March Session 1766

Personally appeared James McKeb and on his oath proved the last will and testament of Samuel Spruill deceased & on his oath saith that he was of sound mind and memory and at the same time he saw Nehemiah Spruill & Ebenezer Spruill sign as witnesses ordered that the clerk certify the same to the Secretary of the Province that letters issue accordingly.

Personally appeared Samuel Spruill and John Spruill exors. mentioned in the last will and testament of Samuel Spruill deceased and qualified accordingly.

August Session 1768

Read the petition of Simeon Spruill praying a division of the estate of Samuel Spruill deceased & ordered rejected.

On motion of Mr. Thomas Jones attorney for Simeon Spruill orphan of Samuel Spruill deceased &c ordered that Joseph Spruill Esquire be guardain to Simeon Spruill orphan of Samuel Spruill deceased & enters Mathew Caswell & Nathan Bateman Junr. in the sum of 400 pounds which is approved of by the court.

August Session 1770

On motion of Mr. Wiriot Ormand atty. in behalf of Simion Spruill for a division of the estate of Samuel Spruill deceased &c ordered rejected.
