In the name of God amen: The ninteenth day of August in the year of our Lord one thousand seven hundred and sixty I Samuel Spruill Senr. of Tyrrel County North Carolina being very sick and weak but in perfect mind and memory thanks be to God for the same and calling to mind the mortallyty of my body and knowing that it is appoiinted for all men once to die do therefore make and ordain this my last Will and Testament that is to say principally and first of all I give and recommend my soul into the hands of God and my body I recommend to the Earth to be buried in a decent Christain burial at the duretion of my Executors nothing but at the General Resurrection I shall receive the same again by the mighty power of "Allmighty God and as touching such Worly Estate where with it hath pleased God to bless me in this life I give demise dispose of the same in following manner & form.

Item - I give and bequeath unto my the heirs of my beloved daughter Mary White deceased one shilling sterling money.

Item - I give and bequeath to my son Samuel Spruill one plantation with one hundred and twenty acres of land knowe by the name of Fracis Johnstons to him his heirs and assigns forever ---

Item - I give to by beloved son Joseph Spruill one hundred acres of land more or less bounded thus beginning at a popular a corner tree at the head of the Cypress swamp thence a line of marked trees southeast and by south to a poplar thence by a line of marked trees to a gum in Normans line and on the said line to the Cypress swamp thence up the Cypress swamp and its various windings to the first station unto him his heirs and assigns forever also one negro boy Durcy by name and one third part of the orchard at the manner plantation for seven years provided he shall assist equaly in keeping it in good repair.

Item - I give my beloved daughter Joanna Blount the use and occupation of three negros during her natural life named Ruth Venus and London and after her decease to be eaqully divided among the heirs of her body by if her present husband Jacob Blount doth commence any law suit or bring any action in law in relation of the above negros then I give the above said negroes Ruth Venus & London to my son Joseph Spruill forever ---

Item - I give my beloved daughter Joanna Blount one shilling sterling money.

Item - I give my beloved granson John Spruill one hundred and fifteen acres of land more or less it being part of the land his father lived on and all that part on the West or South side of the Boxen Swamp to him and his heirs and assigns.

Item - I give unto my grandson Evan Spruill one hundred and fifteen acres of land more or less it being the other part of the land whereon his father lived all that part on the North East side of Boxen Swamp to him his heirs and assigns forever likewise one hundred acres of land at the South Fork binding on my son Joseph line to him his heirs and assigns forever.

Item - I give to my son Joseph Spruill one hundred acres of land known by the name of Jacobs land in the South Fork to him his heirs and assigns forever also one negro or mollatto man named Sam.

Item - I leave to my beloved wife Mary Spruill the use and occupation of the house and plantation whereon I now live and timber for the use of the same and after her decease or widowhood then I give the manner plantation with one hundred and twenty five acres of land thereunto belonging be the same more or less unto my son Jeremiah Spruill him and the heirs of his body lawfully begotten forever also I give unto Jeremiah one mollato boy name Mose also one negro named Samson.

Item - I give unto my son Jeremiah Spruill one beed and furniture thereunto belonging and one chest called Mothers chest unto him and his heirs forever, also one bill for money from Mary Spruill widow bearing date seventeen hundred and sixty two.

Item - I give to my son Nehemiah Spruill one hundred acres on the sound know by the name of the sand banks and one plantation with two hundred and thirty acres of land known by the name of the South land to him his heirs and assigns forever also all the cattle belonging to the South land plantation also one negro woman named Abigal to him and his heirs forever also one beed and furniture thereunto belonging also one small chest with a lock & key to it known by Mothers chest I give unto the heirs of my daughter Elizabeth Caswell Desd. one shilling sterling money.

Item - I give unto my daughter Jemima Garrett one negro man named Emporors in her possessions & one cow and calf or twenty five shillings in money to her and her heirs forever.

Item - I give to the heirs of my daughter Zilpha Hooker deceasd. one shilling sterling money also I give unto my grand daughter Elizabeth Hooker one gold ring with a stone in it.

Item - I leave to my wife Mary Spruill during her widdowhood one molatto man named Able and one negro girl named Jenney and a bill for money due from Mary Spruill widdow of twenty pounds bearing date seventeen hundred & sixty and one mair named Bonney and one horse named Jack and my riding horse sadle and bridle togeather with six cows and calves and four of the largest stears and ten sowes and piggs and ten hoggs of a year old and the beed whereon I now lie and the furniture thereunto belonging and the beed whereon the girls do lie and the furniture belonging to it and three dishes three basons and six plates and four poots and all the pewter that was here in her widdowhood and one large chest knowne by the name of Fathers chest and a smal chest that was bought of Springs one box iron & heeters and the wolling wheele that Holt made and the two linnen wheels and six chairs and the cards belongint to the wheels and five ews and all the cotton wool & flax for my wife Mary Spruill use and five hogheads her choice and one third part of the orchard and I give to Jeremiah Spruill on third part of the orchard if he helps to keep it in repair also I give to my wife Mary Spruill all the cattle over the Bay and if my wife Mary Spruill deceases or marries then the above premises to be taken into the hands of my Executors for the use of my two smal children James and Zilpha Spruill.

Item - I give to my son Nehemiah Spruill on bill for money of twenty pounds due from Mary Spruill widdow bearing date seventeen hundred and sixty one and one brass kettle --

And any law suite should be commenced against my Estate after my deceased these four which is above mentioned that is to say my wife Mary Spruill my son Jeremiah Spruill and my son Nehemiah Spruill and my son Joseph Spruill which hath a bill left them of twenty pounds apiece shall equally bear the cost of the said law suite and if either of them refuse to pay and equal part of such law suite then the bill of twenty pounds which is left them shall be refund back to my Executors to bare the cost of such law suite.

Item - I give unto my son Joseph Spruill one negro boy named Ben during his natural life and after his decease then I give the boy named Ben unto my grand son Thomas Spruill to him his heirs and assigns forever also I give to Thomas Spruill one cow calf.

Item - I give to my son Jeremiah Spruill one mair named Flower and one young horse named Litfoot and one horse named Jack and all the remaining part of the cattle belonging to the Manner plantation and all the remaining part of my Estate I leave to be divided between my two sons Jeremiah and Hehemiah eaqually and I do constitute make and ordain my two sons Samuel Spruill and Joseph Spruill Executors of this my last Will and Testament and I do hereby disanul revoak and disalow all other Testaments Wills Lagacyes bequeaths and Executors by me in any wise named Willed and bequeathed retifying and confirming this and no other to be my last Will and Testament In witness wereof I the said Samuel Spruill Senr. Have here unto set my hand and seal the day and year first above writtten.

December Session 1760

Personally appeared Nathan Miears and proved the last will and testament of Samuel Spruil deceased.

Personally appeared Joseph Spruil Esqr. and exhibited an inventory of the estate of Samuel Spruil deceased and proved the same by his oath and qualified executor by taking the oath appointed by law. Ordered that the secretary have notice that letters testamentary issue accordingly.

September Session 1761

Personally appeared Joseph Spruill and proved an account against the estate of Samuel Spruill deceased. Ordered filed.

Personally appeared Joseph Spruill and exhibited an inventory of the estate of Samuel Spruill deceased & proved the same upon his oath. Ordered filed.

March Session 1764

On motion of Jasper Charlton on behalf of the orphans of Samuel Spruill Senr. deceased, it is ordered that Alexander McKeeb who intermarried with the widow of Samuel Spruill afsd. have the care and custody of the orphan children of the sd. Saml. named James, Zephelpa & that he cloath and maintain the sd. children out of the work & labor of a certain molato man named Abel which is allowed him by the court. Also ordered that such part of the pershable estate as belongs to the said children now in the hands of Alexander McKeeb be sold at public vandue for the bennefit of the sd. children.

September Session 1764

On motion of Jasper Charlton in behalf of the orphans of Saml. Spruill deceased it is ordered that Alexr. McCabe who in virtue of an order of an order of this court sold the perishable part of the estate of Saml. Sprewell for the benefit of the said orphans do return an account of sales of the said estate to the next ensuing court and also pay the full sum for which such estate was sold to Samuel Sprewell and Joseph Sprewell exor. of said Saml. deceased.

December Session 1764

On motion of Jasper Charlton on behalf of Alexander McKib enters securities Nehemiah Norman & Isaac Alexander in the sum of one hundred pounds for the guardinship of the orphans of Samuel Spruill Senr. according to the order of last court.

Personally appeared Alexander McKeb and enters Nehemiah Norman & Isaac Alexander and acknowledges their bond for the guardainshipof the orphans of Samuel Spruill deceased.

May Session 1769

Personally appeared Alexander McKeeb & exhibited an account of James Spruill & Zilpha Spruill orphans of Samuel Spruill deceased & proved the same upon his oath ordered to be filed.

May Session 1777

Ordered that Joseph Spruill Junr. John Hooker and Nehemiah Norman be appointed to divide the land between Joseph Spruill Senr. Evan Spruill James Dillon and Nehemiah Spruill the heirs of Samuel Spruill Senr. deceased agreeable to the will of Samuel Spruill Senr. and Samuel Spruill Junior and make return to next court.

August Session 1777

Alexander Mackail {McCabe} exhibited an account of Zilpha Spruill orphan of Samuel Spruill deceased in open court and there apears to be a balance due to said orphan of 11 pounds, 9 shillings & 11 pence.

At the same time ordered that Alexander McCabe sel at publick vandue the negro Able belong to the estate of Samuel Spruill and make return to next court.

Ordered that Alexander McCaib be allowed fifteen pounds a year for the maintenance of Zilpha Spruill orphan of Samuel Spruill.

November Session 1777

Ordered that Alexander McKabe higher out the negroe belonging to the orphans of Samuel Spruill deceased.

August Session 1778

The petition of Jos. Spruill was read praying an order for the division of a peace of land between Jos. Spruill Nehemiah Spruill Even Spruill and James Dilling be divided agreeable to the wills of Saml. Spruill Senr. and Saml. Spruill Junr. deceased granted agreeable to former order.

Ordered that Alexander McKabe be paid fifteen pounds out of the estate of Zilpha Spruill for keeping the said orphan the year 1777.

Bond dated 21 Dec 1764 in the amount of 100 pounds appointing Alexander McKeb guardian of Jane Spruill & Zilpha Spruill orphans of Samuel Spruill deceased, Nehemiah Norman & Isaac Alexander securities.

Division of the lands of Samuel Spruill deceased pursuant to court order in January 1787 and containing 505 acres known as the South Land. Sons Joseph Spruill, Evan Spruill & Nehemiah Spruill receive 100, 100 & 230 acres respectively. The surplus of 75 acres was given by will of Samuel Spruill Junr. to James Dillon. Dated 1 Mar 1787.

Division of the lands of Samuel Spruill deceased pursuant to court order in January 1787. 100 acres of the tract known as Sand Banks is divided to Nehemiah Spruill in accordance with the will of Samuel Spruill, leaving a surplus of 21 3/4 acre. Dated 2 Mar 1787.
