Dated 12 March 1759


In the name of God amen The twelfth day of March in the year of our Lord one thousand seven hundred and fifty nine I John Spruill Senr. of Scupperlong in the County of Tyrrell in North Carolina being in perfect helth thanks be to God therefore calling to remembrance the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this my last Will and Testament (that is to say) principally and first of all I give and recommend my soul into the hands of God and my body I recommend to the Earth to be buried in a deceant Christain burial att the discretion of my Executors nothing doubting but att the General Resurection I shall receive the same again by the mighty power of God and as touching such worldly Estate wherewith it hath pleased God to bless me in this life I give demise and dispose of the same in the following manner and form:

Imprimis - I give to my well beloved son John Spruill one negro man called Mingo to him and his heirs forever

Item - I give to my well beloved son Even Spruill one negro or melatto man named Abram to him and his heirs forever

Item - I give to my welbeloved wife Mary Spruill the use and occupation of my whole Estate during her widowhood and when my children comes of age to make an equel devision in the Estate and let them when they come of age have their part according to the decression of my Executors and in case the negro woman named Patience should have any children let my three daughters Elizabeth Spruill Jemima Spruill and Debroah Spruill to have each of them one of the increase if any and the other part of the said negro woman to my two sons John Spruill and Evin Spruill and in case the aforesaid negro woman hath no children then I give her to my son Even Spuill to him and his heirs for ever I also appoint my welbeloved wife Mary Spruill my Executrix and with her my two brothers Joseph Spruill and James Long my Executors of this my last Will and Testament and I do hereby utterly disallow revoak and disannul all and every other Testaments Wills Legacys and Bequeaths and Executors by me any ways before named Willed and Bequeathed ratifying and confirming this and no other to be my last Will and Testament In witness whereof I have hereunto set my hand and seal the day and year first above written

Tyrrell County Court of Pleas & Quarter Sessions


September Session 1760

Personally appeared Jaccob Blount and proved the will of John Spruill deceased. At the same time appeared Mary Spruill widow of the aforsd. John Spruill and qualified executris by taking the oath by law proscribed for the due qaly. of executors & c.

March Session 1765

Personally appeared John Spruill orphan of John Spruill deceased and on his own free will chose Capt. Joseph Spruill guardain of his person & estate he giving security in the sum of 300 pounds procl. money.

On motion of Joseph Spruill for a division of the estate of John Spruill deceased it is ordered Giles Long Esqr. John Hooker & Joseph Spruill Esqr. or any two of them devide the same & make return to the next court.

June Session 1765

It appearing to this court that Joseph Sprewell who was heretofore chosen guardian to the person and estate of John Sprewell son of John Sprewell deceased hath given no security for the said estate and the said John Sprewell having appeared in open court and chose his mother Mary Alexander his guardian the same is approved of accordingly and ordered that John Alexander her husband and the said Mary give security in the sum of 300 pounds for said orphans estate also ordered John Combs & Joshua Alexander be securities.

May Session 1775

Evan Spruill orphan of John Spruill came into open court and chose Andrew Long to be his guardian and ordered that John Alexander Junr. appear here at the next court & render an account of his guardianship.

May Session 1776

Ordered that James Phelps Senr. be appointed guardian to Evan Spruill & gives security Joseph Phelps Senr. & Nathan Bateman Junr. in the sum of five hundred pounds.

John Alexander Junr. delivered on oath an inventory of the estate of Evan Spruill orphan of John Spruill.
