I B. S. Spencer of Tyrrell County, North Carolina being of sound and disposing mind and memory, but realizing that it is appointed of all men once to die, do make and declare, this my last Will and Testament, in the manner and form following:

Item - I desire that my body be buried in accordance with the wishes of my relatives and friends. A tombstone shall be erected at my grave and the expenses thereof and any just debts that I may die owing and the expenses of administering my estate are to be paid by my executor hereinafter named.

Item - Subject to the foregoing, I give devise and bequeath to my relative Benjamin Franklin Spencer son of W. E. Spencer all of my property of every kind and description, real, personal and mixed which I may own at the time of my death, whether owned by me now or hereafter aquired, including money on hand at the time of my death and all debts which may be owing to me at the time of my death.

Lastly - I hereby constitute and appoint Mark Majette of Columbia N. C. my executor to all intents and purposes to execute this is my last Will and Testament according to the true intent and meaning of the same and every part and clause there of, hearby revolking and declaring utterly void all other wills and testaments by me heretofore made..

In witness whereof, I the said B. S. Spencer do hereunto set my hand and seal, this the 18th day of July 1913.

Signed sealed, published and declared by the said B. S. Spencer to be his last Will and Testament in the presence of us, who at his request and in his presence and in the presence of each other do subscribe our names as witnesses thereof.

A paper purporting to be the Last Will and Testament of B. S. Spencer deceased, is exhibited before me by Mark Majette the executor therein mentioned and thereupon proven by the oath and examination of Mark Majette and Stephen Brickhouse the subscribing witnessess thereto: who being duly sworn, doth depose and say, that each for himself, that the said B. S. Spencer signed said paper-writing in the presence of each and declared the same to be his last Will and Testament. The deponents futher said that at the time the said B. S. Spencer subscribed his name he was of sound mind and memory and of full age to execute a will and was not under any restraint to the knowledge, information or belief of this deponent. And futher these deponents say not.
