April Session 1833

Ordered that Frederic Allcock be permitted to administer on the estate of Jos. Spence in a bond of 1,000 with Ephraim Mann & William Walker securities.

Ordered that Chas. McClees, William Meekins, Stephen Allcock & Jno. Banks lay off to Margaret Spence widow of Jos. Spence her years allowance.

David Clayton coroner returned into open court inquests held on the body of Jos. Spence, Hardy Meekins and an unknown person.

Ordered that Frederic Allcock administrator of Jos. Spence sell the perishable estate of said deceased.

October Session 1833

Frederic Allcock administrator of Jos. Spence returned into court on oath account of sales - also the widows years allowance not to credit & filed.

Promissory note by Joseph Spence dated 2 Nov 1829 to pay Benjamin Sikes $157.75 on order.

Petition April Term 1833 by Margaret Spence widow of Joseph Spence deceased who departed this life on 31 Mar 1833 intestate and seized and possessed of a tract of land of about 83 acres adjoining Jobe McGowan and Alligator River besides several swamp tracts. Petitioner requests the Sheriff summon a jury of disinterested men to lay off her dower in said land.

Court order in April Term 1833 for Charles McCleese, William Meekins, Stephen Allcock & John Banks to lay off to Margaret Spence widow of Joseph Spence her year's allowance out of her dfeceased husband's estate.

Summons dated the fourth Monday in April 1833 and issued 27 May 1833 for Frederick Alcock administrator of Joseph Spence deceased to appear in court on the fourth Monday in July next to answer unto Benjamin Sikes of a debt of $157.75 and $50 in damages.

Appearance bond dated 11 Jul 1833 in the amount of $414 for Frederick Allcock to appear at court on the fourth Monday in July next to answer to Benjamin Sikes, Stephen Allcock security.

Laying off on 14 May 1833 of the year's allowance of Margaret Spence widow of Joseph Spence deceased.

Court order July Term 1833 for the laying off of the dower of Margaret Spence in the lands of her deceased husband Joseph Spence agreeable to her petition and report at October Term 1833.

Laying off on 25 Sep 1833 of the dower of Margaret Spence in the lands of her deceased husband Joseph Spence on 21 Sep 1833 by Samuel C. Patrick Deputy Sheriff and Charles McCleese, James Davenport, Midyett Spencer, Joab Sawyer, Timothy Jones, John D. Liverman, Richard B. Liverman, John Patrick, Jechonius Neel, Thomas Sawyer, Patrick Liverman & William Bodwell all unconnected by affinity or consanguinity who set off 55 acres joining Jobe McGound and the river.

Summons dated 23 Oct 1833 for William Meekins to appear before a Justice of the Peace on 25 Oct 1833 at Frederick Liverman's store house to answer the complaint of Frederick Allcock as administrator of the estate of Joseph Spence deceased in a plea of debt due by account in the sum of $19.

Summons dated the fourth Monday in October 1833 for Stephen Allcock, James Clayton & Asa Spence to appear in court immediately to testify on behalf of Frederic Allcock in a matter in which Frederic Allcock is plaintiff and William Meekins is defendant.

Summons dated 20 Jan 1834 for Frederic Allcock as administrator of Joseph Spence deceased to appear before a Justice of the Peace on 25 Jan 1834 at Saml. C. Patrick's store house to answer the complaint of William Meekins in a plea of debt due by account in the sum of $11.56.

Summons dated the fourth Monday in January 1834 and issued 20 Feb 1834 for Stephen Allcock, James Clayton & Asa Spence to appear in court on the fourth Monday in July next to testify on behalf of Frederic Allcock in a matter in which Frederic Allcock is plaintiff and William Meekins is defendant.

Execution dated the fourth Monday in January 1834 and issued in February 1834 against Frederick Alcock administrator of Joseph Spence deceased for $157.75 with interest from 3 Nov 1829 with a payment of $20 on 25 Dec 1829 plus $8.60 in costs of the suit to Benjamin Sikes. At the time this writ was issued, the administrator had no goods & chattels of Joseph Spence in hand, and it was suggested that Joseph Spence owned lands & tenements that should be levied to satisfy his debt. He prayed a court order to sell these lands. The court ordered Frederick Alcockand wife Harriet, Edmon Clayton and wife Lucretia, Hardy Spence and Jos. Halsy guardian ad litem to Asa, Mary & Sally Spence to appear in court on the fourth Monday in April next to show cause, if any, why the judgement should not be levied upon said lands.
