I, M. .A. Snell of the County of Tyrrell and State of North Carolina being of sound mind but considering the uncertainty of my earthly existence, do make and decide this my last Will and Testament.

Item - My executors hereinafter named shall give my body a decent burial suitable to the wishes of my friends and relatives and pay all funeral expenses togeather with all my just debts out of the first moneys which may come into his hands belonging to my estate.

Item - I give and devise and bequeath to my two children Willie Ellonese Snell and John D. Snell all of my property of every kind and description real, personal and mixed which I may own at the time of my death.

Item - It is my will and desire that my executor shall sell all my personal property and after paying my burial expenses to pay the mortgage that is on my land and if there should be any surplus to turn it over to the guardian of my children when his turn in office expires. In case there should not be enough to pay the mortgage on my land it is my will and desire that my executor shall rent my land out until such time the rent amounts to enough to pay off the mortgage on the land.

Item - Whereas my children are minors I hereby constitute and appoint my friend T. J. Davenport guardian of the person and estate of my two children. It is further my will and desire that said guardian shall have the custody and care of my said children until they shall each arrive at the full age of twenty one years.

Item - I hereby constitute and appoint my friend W. E. Spencer my lawful executor to all interest and purposes to execute yhis my last Will and Testament according to the true intent and meaning thereof. I hereby revoke and declare utterly void all Wills and Testaments by me heretofore made.

In witness whereof, I the said M. A. Snell do hereto set my hand and seal this the 11th day of March, 1918.

Signed, sealed, published and declared by the said M. A. Snell to be her last Will and Testament in the presence of us, who in her presence and at her request, and in the presence of each other have hereto set our names as subscribing witnesses thereto.

A paper purporting to be the last Will and Testament of M. A. Snell deceased, is exhibited before me, the undersigned Clerk of the Superior Court for the said county, by W. E. Spencer the executor therein mentioned; and the due execution thereof by the said M. A. Snell by the oath and examination of T. J. Godwin and M. A. Swain the subscribing witnesses thereto, who being duly sworn doth depose and say, and each for himself deposeth and saith that he is a subscribing witness to the paper writing now shown him purporting to be the last Will and Testament of the said M. A. Snell which bears the date of 11th day of March 1918. And this deponent further saith that at the same time when the said testatrix subscribed her name and at the time of the said deponents subscribing his name as a attesting witness thereto the said M. A. Snell was of sound mind and memory, of full age to execute a Will and was not under any restraint to the knowledge, information or belief of this deponent: And further these deponents say not.

It is therefore considered and adjudged by the Court that the said paper writing and every part thereof is the last Will and Testament of M. A. Snell, deceased, and it is ordered that the same with the foregoing examination and this certification be recorded and filed.
