I Elizer Snell, being of sound mind and memory do make and declare this my last will and Testament: First, My executor hereinafter named shall provide for my body a decent burial, and pay all my Just debts, and also my funeral expences.


Second, Having given and put in possession my Son F D Snell the sum of Forty and 80/100 dollars being about one third of my entire estate as an advancement. the same is hereby bequeath to him as his distributive share of my estate in full.


Third Having given and put in possession of Simeon Rhodes, the father of Virginia D Rhodes, Indiana A Rhodes, Clinnie E. Rhodes, Allice Beatrice Rhodes and R. R. Rhodes minor children of my deceased daughter Euginia Rhodes. to be used for the support and maintaince of the said minors. the sum of Forty Two 50/100 dollars being about one third of my entire estate. as an advancement to them. the same is hereby bequeath to them as their distributive share of my estate in full.


Fourth; I give and devise to my son Warren Snell (with whom I now live) all the remainder of my estate. Consisting of House hold & kitching furniture. live stock. monies. notes and accounts. or any other personal property. that I may die seized and possessed of. to him and his heirs forever.


Fifth; I hereby appoint my worth son Warren Snell my lawful executor to execute this my last will and testament according to its true intent and meaning of the same. and hereby authorize and direct that should I die without fully providing as set out in Item. second and third of this my will. then my son Warren shall pay the same out of my said estate. and I hereby declare this to be my last will and testament & hereby revoking and declaring all other wills by me made heretofore uterly void. In witness whereof I have hereunto set my hand and seal this 7th day of October 1902.

A paper purporting to be the last Will and Testament of Elizer Snell deceased is exhibited before me the undersigned clerk of the superior court for said County by Warren Snell the executor therein mentioned and the due execution thereof by the said Elizer Snell by the oath and examination of John S. Snell and Abner Rhodes the subscribing witness is thereto: who being duly sworn doth depose and say and each for himself deposeth and saith that he is a subscribing witness to the paper-writing now shown him purporting to be the last Will and Testament of Elizer Snell that the said Elizer Snell in the presence of this deponent subscribed her name at the end of said paper-writing which is now shown as aforesaid and which bears date of the 7th day of October 1902. And the deponent further saith. That the said Elizer Snell the testatrix aforesaid did at the time of subscribing her name as aforesaid declare the said paper writing so subscribing her name as aforesaid declare the said paper writing so subscribed by her and exhibited to be her last Will and Testament and this deponent did thereupon subscribe his name at the end of said Will as an attesting witness thereto and at the request and in the presence of said testatrix. And this deponent further saith that at the time when the said testatrix subscribed her name to the said last Will as aforesaid and at the time of the deponent's subscribing his name as an attesting witness thereto as aforesaid the said Elizer Snell was of sound mind and memory of full age to execute a Will and was not under any restraint to the knowledge information or belief of this deponent. And further these deponents say not.

It is therefore considered and adjudged by the court that the said paper writing and every part thereof is the last Will and Testament of Elizer Snell deceased. Let the said Will together with the probate be recorded and filed. This 30 day of January 1904.
