Tyrrell County Court of Pleas & Quarter Sessions


June Session 1751

Peter Smith exhibited a petition which was read in these words viz. praying an order as administrator of the estate of James Smith late of this county deceased to sell so much of the perishable part of the said estate as may discharge the just debts of the said decedent which is accordingly granted.

September Session 1751

An account of sales of part of the estate of James Smith late of said county deceased was returned into open court and proved by the oath of John Blount.

John Swain Senr. is by the justices of the said court appointed guardian of James Smith orphan of James Smith late of said county deceased on condition the said John shall agree to give bond as the law directs.

Peter Smith is by the justices of this court appointed guardian of John Smith orphan of James Smith late of said county deceased, he giving bond as the law directs, William Mackey security. Bond not signed.

Isaac Devenport is by the justices of the said court appointed guardian of Jemiah Smith orphan of James Smith late of said county deceased, he agreeing to learn her to reed through the Bible, and give bond agreeable to law. Securitys Thomas Hawkins and James Devenport. Bond not signed.

Isaac Devenport is by the justices of the said court appointed guardian of Penelope Smith orphan of James Smith late of said county deceased, he agreeing to give bond as above said. Bond not signed.

December Session 1751

James Smith exhibeted a petition which was read in these words viz. granted and James Smith is appointed guardian of Jemiah & Penelope Smith, orphans of James Smith late of Tyrrell County deceased, he the said guardian agreeing to learn the said orphans to read. He entering security Giles Long Esqr. and Peter Smith in the sum of two hundred pounds Proclamation money and to give security according to law.

Perceila Smith orpan of James Smith deceased came into open court and made chose of James Blount for her guardian he giving security by William Mackey and Evan Jones in the sum of one hundred pounds Proclamation money.

March Session 1754

James Smith is appointed guardain of Percila Smith. Joseph Spruell & John McCaskey securitys in the sum of one hundred pounds Procl. money.

March Session 1756

The petition of Joseph Sprewell read and the parties appearing and on argument and consideration it was then and there ordered that James Smith who was sometime since appointed guardian to an orphan Prissilla Smith and for whom the said Joseph Sprewell became security do give security to the said Joseph Sprewell to indempnify him from all loss or damage which he may sustain on account of his having become bound for the guardianship of the sd. James Smith or that in default thereof the sd. James deliver to ye sd. Joseph all & singular the estate of the orphan on the sd. Josephs giving security in the sum of 20 pounds Procl.

March Session 1757

Joseph Spruill exhibeted his account against the estate of Persilla Smith as guardian & proved the same on oath and allowed.
