In the name of God amen: I Abel Sikes calling to mind that it is once appointed for all men to die do make and ordain this my last will & testament first I recommend my body to be buried according to the discretion of my executors and as touching my worldly estate I give in manner & form as follows Viz:

I give unto my wife Jula Sikes the half of my land whereon I now live including the improvements during her natural life time with all the tools belonging thereto and more Likewise I lend unto my wife Jula my negro Mills during her widdowhood or life time afterwards to remain my son Jesse, also I give unto my wife Jula one bed & furniture and table during life then to return to my heirs, Further I give to Lewiza my daughter my silver table spoons, also I give to my son Jesse my watch. Also I leave my negro girl also to be sold by the executors for the good of the heirs, further I shall mention for all my property not heretofore mentioned to be sold and after paying the debts that I justly due the balance to be divided between my wife and two children. Also I give unto my wife one large tumbler. I leave my swamp to be sold that I own on the east side of the river. My land above mentioned I leave to be equally divided between my two children. Also I leave my son part of the land to be laid off to him when he comes of age. The children is to be educated out of their money that shall be coming to them but to be raised by the apertanie of Mills. Further I mention for my wife to have one years allowance to be laid off to her further it is the large table that I leave to my wife also I do hereby make and appoint my brother Thomas Sikes executor to this my last will & Testatment. In witness whereof I have hereunto set my hand the date first written Signed in the presence of us

October Session 1818

Ordered that John A. Patrick Joseph White William Liverman Senr. & Stephen Alcock lay off to Julia Sikes widdow of Abel Sikes deceased one years provision out of the estate of said deceased agreeable to act of assembly & make return to the next term.

The last will & testament of Abel Sikes was exhibited & proved in open court by the oath of Timothy Jones Esqr. one of the subscribing witnesses thereto at the same time appeared Thomas Sikes the executor therein named and qualified agreeable to law ordered that letters testamentary issue thereon as the law directs with a coppy of the will annexed.

January Sesion 1819

The report of the years provision Julia Sikes was returned to court & filed.

The account of sales of the estate of Abel Sikes was returned by Thos. Sikes the administrator proved and filed (no inventory).

April Session 1819

A surplus inventory & account of sales of the estate of Abel Sikes was returned to court on oath by Thos. Sikes the executor & filed.

January Session 1820

Thomas Sikes was appointed guardian to Jesse Sikes & Luisa Sikes orphans of Abel Sikes deceased & entered into bond as the law directs ordered that he receive the estate of said orphans into his possession & account for the same agreeable to law.

January Session 1822

An account of sales of the hire of negro Mills belonging to the estate of Abel Sikes deceased was returned to court on oath for 1820 & 1821 amounting to $116.00 & filed.

July Session 1822

Ordered that John Beasley Joseph White & William Alfred be apointed to audite & settle the estate of Abel Sikes with his administrator & make report to the next term.

The following persons appeared in open court & renewed their guardian bonds viz. Phoeba Liverman guardian to Jesse Livermans orphans, Thomas Caroon to Patsy & Nancy Dowdy, Joseph Mann to Ivy Dowdy, Thomas Sikes to Luisa & Jesse Sikes, all who entered into bond with aproved security & their bonds filed.

Thos. Sikes returned on oath in open court an account sales of the hire of negro Mills the property of Abel Sikes deceased for the year 1822 amount $56.75 & filed.

July Sesion 1823

Ordered that Timothy Jones William Alfred & John Beasley be appointed to audite & settle the estate of Abel Sikes deceased & make report to the next term.

Thomas Sikes administrator of Abel Sikes returned in open court on oath an account of sales of the hire of negro Mills amount $55.00 & filed.

January Session 1824

Ordered that William Alfred Timothy Jones & John Beasley be reappointed to audite & settle the estate of Abel Sikes deceased and make report to the next term.

April Session 1824

Thomas Sikes appeared in open court and returned the accounts audited and settled between him and the estate of Abel Sikes with a balance of eleven hundred and thirty six dollars and eleven cents due by the executor Thomas Sikes to the said estate and the account filed.

July Session 1824

Ordered that John B. Beasly be appointed guardian to Abel Sikes heirs who entered into bond and gave for security Benjamin Sikes & Timothy Jones.

Laying off of a years provisions to Julia Sikes widow of Abel Sikes deceased out of the estate of her deceased husband on 29 Oct 1818.

Promissory note dated 12 Jan 1819 by Lemuel Basnight & John Thoroughgood to repay in six months the amount of three hundred and eighty dollars to Thomas Sikes executor of Abel Sikes deceased. Witnessed by John Bateman.

Bond dated 10 Jan 1820 in the amount of five hundred pounds appointing Thomas Sikes guardian of Luisa Sikes orphan of Abel Sikes deceased, Joseph White & Tarte White securities.

Bond dated 10 Jan 1820 in the amount of five hundred pounds appointing Thomas Sikes guardian of Jesse Sikes orphan of Abel Sikes deceased, Joseph White & Tarte White securities.

Bond dated 1 Jul 1822 in the amount of five hundred pounds appointing Thomas Sikes guardian of Luisa Sikes orphan of Abel Sikes, Thomas Dunbar & John Cahoon securities.

Bond dated 1 Jul 1822 in the amount of five hundred pounds appointing Thomas Sikes guardian of Luisa & Jesse Sikes minor orphans, Thomas Dunbar & John Cahoon securities.

Bond dated 29 Jul 1824 in the amount of one thousand five hundred pounds appointing John B. Beasley guardian of Luisa Sikes orphan of Abel Sikes, Timothy Jones & Benjamin Sikes securities.

Warrant issued 3 Sep 1833 for John Haughton to appear at court on the 4th Monday in October next to answer unto Benjamin Sikes, Jesse Sikes by guardian John B. Beasley, Thompson Liverman & wife Louisa, Robert Linton & wife Hannah, Lemuel Basnight & wife Mary, John Owens & wife Sarah, David Cooper & wife Phoebe and Benjamin, Mary, Amanda, Caroline & Eliza Sikes by their next friend Benjamin Sikes of a plea of trespass vi it armis to their damage & three thousand dollars.

Petition July Term 1835 by Joshua White, Thompson Liverman in right and behalf of his wife Louisa & John B. Beasley guardian of Jesse Sikes that they are tenants in common, said Joshua White in his own right & Thompson Liverman & Jno. B. Beasley by representation as aforesaid, of a piece of land lying in Gum Neck Landing which they want to have partitioned. Land lies in a patent by the state of North Carolina to Joseph Gibson and mentions the boundaries of Joseph White & Abel Sikes.

Division on 22 Oct 1835 of the lands belonging to Abel Sikes deceased, formerly belonging to John Smith. One fifth of the tract containing 19 acres was layed off to Joshua White and the remaining 76 acres were laid off to the heirs of Abel Sikes. Commissioners were Bartlett Jones, James Devenport, Timothy Jones, Jordan L. Jones & Adin Meekins with John McClees Deputy Sheriff.

There are numerous documents relating to suits where John B. Beasley guardian to the heirs of Abel Sikes is trying to recover debts. They are as late as 1835, which indicates the orphans were young when Abel Sikes died. Also documents relating to suits by Thomas Sikes administrator attempting to recover debts to the estate.

Hopkins security; also Lemuel Basnight to Marey Sikes on 1 Jul 1822, Z. Todd security; also David Cooper to Phoeba Sikes on 11 Jan 1814, Jesse Phelps security; also Robert Linton to Hannah Sawyer on 4 Mar 1823, Benjn. Sikes security; also Hannah Sikes to Josiah Sawyer on an unknown date, Joseph Jennett security.

See the will of John Sikes in 1826 for further information. The children Benjamin, Mary, Amanda, Caroline & Eliza Sikes mentioned in the warrant above appear to be children of John's deceased son Thomas Sikes. All others mentioned in the warrant, as well as Abel, are John's sons and daughters.
