In the name of God Amen. I Rachel Roe of the state and county aforesaid, being of sound & disposing mind and memory do make & publish this my last will & testament revoking all others I have heretofore made in the follwing manner viz -

First I give & bequeath to my beloved daughter Mary Spruill one dollar -

Secondly I give to the heirs of my son James Davenport one dollar -

Thirdly I give to my daughter Zina Davenport one dollar -

Fourthly I give to my son Robert Oliver (?) one dollar -

Fifthly I give to my son John Roes heirs one dollar -

Sixthly I give and bequeath to my grand child Rachel Roe daughter of my son William and her heirs one negro girl named Patsy Nelly

Seventhly I give and bequeath to my daughter Sally Davenport one safe and one mug to her son James, also to my daughter Sally Davenport my chest at my death

Eightly I give and bequeath to my daughter Nancy Norman negro woman Merenda to be delivered to her at my death, also one large pot, one tea kettle & pot tramel to her and her heirs -

Ninthly I give and bequeath to my grand son Richard Davenport a negro boy named Isaac to him and his heirs forever

Tenthly I give and bequeath to Charles Davenport the child that my negro woman Merenda is now pregnant with

Item I give and bequeath a negro girl named Pat to my grand daughter Mary Norman child of my daughter Nancy Norman

Item I give to my daughter Sally Davenport one bead and furniture -

Item I give all the remainder of my estate to Saly Davenport Nancy Norman and William Roe.

I hereby nominate, consitute and appoint Jos. Halsey executor to this my last will and testament & do hereby as I have already done revoke all wills by me heretofore made.

In witness whereof I have hereto set my hand and seal the 29 day of July 1834

Tyrrell County Court July Term 1835
Jos. Halsey came into open court and renounce the executorship to this paper writing purporting to be the last will and testament of Rachel Roe, whereupon F. F. Fagan appeared in open court and produced the said paper writing & proved the due execution thereof by the oath of Benj. Sikes one of the subscribing witnesses thereto, who also proved the death of Ephm. Mann the other subscribing witness & that they saw Rachel Roe sign, seal, publish and declare the said paper writing to be her last will and testament and that they subscribed the same as witness in her presence and in the presence of each other, that at the time thereof she was of sound disposing mind and memory and did the same without force or compusion, whereon Jos. Halsey the executor therein named renounced the executorship and it was ordered by the court that adm with the will annexed be granted F. F. Fagan, he entering into bond in the sum of two thousan dollars with Benj. Sikes and D. N. Bateman security administration offer in open court and qualified -

(Transcriber's Notes: Tyrrell marriage bonds have Rachel Wynn marrying Elkanah Davenport with bond dated 8 Feb 1778 and William Edwards Sr. as security; Rachel Davenport marrying Levy Roe with bond dated 6 Apr 1785 and Robert Wynne and George Wynne security; Mary Davenport marrying Dempsey Spruill with bond dated 22 Dec 1799 and Nathan Davenport security.)
