October Session 1802

Ordered that Samuel Spruill Esqr. have leave of administration on the estate of Samuel Rudder deceased and hath entered into bond in the sum of two thousand pounds Isaac Davenport and Devotion Perisho securities.

Ordered that Samuel Spruill administrator of the estate of Saml. Ruder deceased have leave to sell the perishable part of the estate of the said Saml. Rudder and make return to next court.

January Session 1803

Samuel Spruill Esqr. returned on oath into court an inventory and account of sales of the estate of Samuel Rudder deceased filed.

Ordered that Phillis Rudder be allowed for one years allowance for 14 negroes 35 balls corn 2500 lb pork also for the widow 1 barrell flour 5 bushels corn 25 lb sugar 12 1/2 lb coffee 100 lb beef 100 lb pork as returned by Abner Alexander Esqr. Henry Alexander Jesse Alexander & Thos. Leigh commissioners.

April Session 1803

Samuel Spruill Esqr. returned in court on oath the 2nd inventory and account of sales of the estate of Samuel Rudder deceased filed.

October Session 1804

Ordered that James Hoskins John Murphy & Paul Thoroughgood or a majority of them be appointed to audite and settle the accounts between the estate of Samel Rudder deceased & the administrator also to apportion off the widdows part of the estate agreeable to law.

January Session 1805

Ordered that James Hoskins John Murphy & Paul Thoroughgood Esquires be appointed to settle the estate of Samuel Rudder deceased with the estate of Thomas Hopkins deceased also to audite and settle the acounts of Samuel Rudder deceased with the administrator and lay off the widows dower agreeable to law and make returns to next court.

July Session 1805

Henry Alexander & Wife vs. Samuel Rudders Administrator
Petition for sale of negroes to make a division between the widdow and the heirs of said deceased. It appears to the court that the heirs of said Rudder live out of the state and are inhabitants of the county of Lunenberg in the state of Virginia. Ordered by the court that the notice be given to the heirs of said Rudder through the Hallifax paper in this state for three weeks that unless they appear and show cause to the contrary on the fourth Monday of October next the court wil take the petition pro confisso ? and order the sale of said negroes to be provided with in order that a division of the proceeds may be had between the widdow and the said heirs.

October Session 1805

Ordered that Jesse Alexander Paul Thoroughgood and James Hoskins be appointed to audite and settle the accounts of Saml Rudder deceased with Saml Spruill Esqr. administrator to said estate and make returns to next court & to audite and settle the estate of Thos. Hopkins with administrator executrix & make division of said estate.

The cause coming on to be heard on the petition and answer it was ordered by the court that the defendant sell at public vendue at six months credit on the first day of January next the negroes mentioned in the petition of the complainants in order to make division between the said complainants and the legal representatives of the said Samuel Rudder deceased.

January Session 1806

Samuel Spruill returned the account of sales of the negroes belonging to the estate of Samuel Rudder deceased including the rent of two small plantations to the amount of three hundred and forty four pounds two shillings filed.

James Hoskins returned an audited account of Saml. Rudder deceased with the executor of Thos. Hopkins deceased to the amount of three hundred and nine pounds five shillings.

James Hoskins returned into court the audited account of Saml. Rudder deceased with Samuel Spruill Esqr. administrator of said estate filed.

July Session 1806

Ordered that Paul Thoroughgood and Jas. Hoskins Esquires and Cols. Jesse Alexander be or a majority of them be appointed to audite and divide the monies arising from the sale of the negroes of Samuel Rudder deceased betwen Henry Alexander and wife Phillis and the heirs of the said Samuel Rudder deceased and the administrator of the said deceased do pay to the said Henry Alexander and Phillis his wife there respective shares of the said Samuel Rudders estate and that a return be mad to next court.

October Session 1806

Jesse Alexander Paul Thoroughgood & James Hoskins being appointed to audite the account of sales of negroes and rents of the lands of Samuel Rudder between Henry Alexander & Philis his wife & the heirs of Samuel Rudder deceased we do say that there are two hundred & fifteen pounds 16/3 due Henry Alexander husband of the widow of the said deceased as her one third part.

James Hoskins returned in court the audited account and division of the money arising from the sale of the negroes belonging to the estate of Samuel Rudder deceased and they find a ballance due the heirs of Saml. Rudder of 215 pounds, 13 shillings & 3 pence and also due Henry Alexander husband of the said deceased to the amount of 107 pounds, 16 shillings & 3 pence it being the one third part account filed.

Rudder, Samuel, 1802


Bond dated 26 Oct 1802 in the amount of two thousand pounds appointing Samuel Spruill administrator of the estate of Samuel Rudder deceased with Isaac Davenport & Devotion Perisho securities.

Petition January Term 1805 of Henry Alexander & Phillis his wife who state that Samuel Rudder, late husband of your petitioner Phillis departed this life intestate without leaving issue and leaving considerable personal estate, including a negro man and woman. Administration on this estate was granted to Samuel Spruill who took everything into his possession. Your petitioner Phillis is advised that she is entitled to 1/3 part thereof but a division can't be accomplished without sale of the negroes. Petitioners pray that the court direct the sale of the negroes, have Samuel Spruill account for the personal estate that came into his hands, and after the sale of the negroes cause a division of the estate to be made.

Summons dated 24 Apr 1805 and issued 1 May 1805 for Samuel Spruill, administrator of Samuel Rudder deceased to appear at next court to answer to Henry Alexander and wife concerning the value of the estate of Samuel Rudder deceased in his hands. Answer of Samuel Spruill to the petition of Henry Alexander & Phillis Alexander, his wife, in July Term 1805. Samuel Spruill states that he administered upon Samuel Rudder's estate, sold the perishable property of his estate and paid the debt of the intestate out of the proceeds of the sale. He further admits that after the debts he knows of have been paid, a balance will remain in his hands, the amount of which he can not ascertain at this time. As to the negroes being sold for a division among the widow and the heirs of said Rudder, he does not think it proper without said heirs being signatories of the petition and not having notice of said sale and division.

This file also contains executions against Thomas Mann for debt to the estate and executions against the estate as well.
